GOVERNMENT REGULATION
of 31 January 2001
laying down the conditions and principles for providing support for a programme to increase the consumption of processed milk and selected milk products by pupils who are obliged to attend school (to encourage an increase in consumption of selected milk products by pupils)
The Government hereby orders, pursuant to § 12 (2) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund) (hereinafter referred to as "the Act") to implement § 1 (2) (a) (7) of the Act:
§ 1
(1) The State Agricultural Intervention Fund (hereinafter referred to as "the Fund") shall grant financial aid, in accordance with the principles and under the conditions laid down in this Regulation, to a natural or legal person producing dairy products (hereinafter referred to as "the manufacturer") for the sale of the nominal types of selected milk products or processed milk (hereinafter referred to as "milk products") set out in Annex 1 to this Regulation, to pupils of primary schools, special schools and compulsory school support schools (hereinafter referred to as "pupils").
(2) Each student of primary school, special school and auxiliary school (hereinafter referred to as "school") has the right to receive at least once in the calendar week of the school year in which school education is held (hereinafter referred to as "week") the selected milk product in the type, quantity and price laid down in this Regulation.
§ 2
(1) The type and quantity of milk products covered by financial support under this Regulation shall be fixed per pupil per week as follows:
a)zpracovatelsky upravené mléko500 ml, nebo
b)jogurtové mléko500 ml, nebo
c)jogurt300 g, nebo
d)smetanový krém160 g, nebo
e)kombinace 2 kusů balení mléčných výrobků podle písmen a) až d).
(2) The milk products supplied to school producers referred to in paragraph 1 shall be packed in such a way that the individual milk product does not exceed the following by volume or weight:
a)zpracovatelsky upravené mléko250 ml,
b)jogurtové mléko250 ml,
c)jogurt150 g,
d)smetanový krém80 g.
§ 3
(1) An application, drawn up in accordance with the model set out in Annex No 2 to this Regulation, shall be submitted by the manufacturer who delivered milk products to the school, hereinafter referred to as the applicant. The Fund shall not exceed 30 days after the end of the first quarter and the second quarter and the end of the period from September to December of the calendar year concerned. In addition to the application, the applicant shall provide the accounting documents showing the quantity of products delivered to the school. The application shall also be accompanied by an officially certified copy of the current extract from the Commercial Register or, where applicable, a valid trade certificate.
(2) Aid may be granted to an applicant who:
(a) submit to the Fund a contract concluded with the school in which the school has undertaken that the sale of dairy products to pupils will be carried out under the conditions laid down in Sections 1 (2) and 2 of this Regulation and at the prices set out in Section 6 of this Regulation, and declare that it does not have a contract with another body to supply milk products under the conditions laid down in this Regulation;
(b) ensure the supply and sale of products under conditions which comply with specific legislation;
(c) on the date on which the application is submitted, it has settled due obligations for the supply of raw cow's milk with all suppliers and has provided evidence of that fact by an honorary declaration as set out in Annex 2 to this Regulation.
§ 4
(1) The Fund shall, within 30 days of receipt of the request, assess whether the applications submitted comply with the requirements laid down in the law and in Article 3 of this Regulation. If the Fund finds that the conditions for granting aid under the law and this Regulation are met, it shall decide to grant aid.
(2) If the Fund finds that one of the conditions laid down in the law or this Regulation is not met, it shall reject the application and inform the applicant in writing, stating the reason for the refusal.
§ 5
(1) The aid shall be fixed for milk products delivered as follows:
(a) 14 CZK per 1 kg or 1 litre for the products listed in point 1 of Annex 1 to this Regulation;
(b) CZK 12 per litre for the products listed in point 2 of Annex No 1 to this Regulation;
(c) 25 CZK per 1 kg for the products listed in point 3 of Annex 1 to this Regulation.
(2) The aid granted will be reflected by the producer in the final price of milk products for pupils.
§ 6
(1) The price of the individual milk product supplied in the package as provided for in § 2 (2) must not exceed CZK 3 per piece.
(2) The price of processed milk or yoghurt milk delivered in the volume of 180 ml to 250 ml shall be converted according to the price referred to in paragraph 1, depending on the volume.
(3) The price of individual yogurt delivered between 125g and 150g shall be converted according to the price referred to in paragraph 1, depending on the weight.
§ 7
The applicant shall communicate to the Fund in writing, on a regular basis by the 15th day of each calendar month, the information to the extent and in the manner set out in point 3 of Annex 2 to this Regulation.
§ 8
Efficacy
This Regulation shall enter into force on the day of its publication.

List of milk products
1. Full-fat dairy products with 14 CZK support for 1 litre of milk or 1 kg of yogurt
(a) whole milk 2) pasteurised or treated with very high temperature;
(b) whole milk (2) pasteurised or treated with very high temperature, flavoured with cocoa or other flavouring ingredients, containing not more than 10% of flavouring ingredients,
(c) yoghurt milk, 2)
(d) yoghurt white or flavoured, (2) containing not more than 30% by weight of flavouring ingredients.
2. Semi-skimmed dairy products with 12 CZK support per 1 litre of milk
(a) semi-skimmed milk 2) pasteurised or treated with very high temperature;
(b) semi-skimmed milk (2) pasteurised or treated with very high temperature, flavoured with cocoa or other flavouring ingredients, containing not more than 10% by weight of flavouring ingredients.
3. Milk products with 25 CZK support per 1 kg cream creamy.2)
