amending Decree No. 330 / 1997 Coll., implementing § 18 (a), (d), (j) and (k) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related laws, for tea, coffee and coffee
According to Article 18 (a), (d), (j) and (k) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related acts (hereinafter referred to as "the Act") for tea, coffee and coffee:
Čl. I
Decree No. 330 / 1997 Coll., implementing § 18 (a), (d), (j) and (k) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related laws, for tea, coffee and coffee, is amended as follows:
1. In Article 1 (h), the words "(aromatised) 'and" genuine' are deleted.
2. in Article 1, the following point (j) is inserted after point (i):
"(j) flavoured tea tea containing flavourings,"
Points (j) and (k) shall be renumbered as points (k) and (l).
3. Paragraph 3 (2) reads as follows:
"(2) Herbal and fruit tea is referred to as species and subgroups."
4. In Article 3, the following paragraph 3 is inserted after paragraph 2:
"(3) Tea products by the name of the group and sub-group."
Paragraphs 3 and 4 shall be renumbered paragraphs 4 and 5.
5. in Article 3 (4) (a):
"(a) in the case of fruit teas, herbal teas and tea products, fruit or herbal warnings on caffeine content, if any, '.

8. in Article 7, the following point (e) is inserted after point (d):
"(e) decaffeinated coffee extract product containing not more than 0,3% caffeine in the dry matter,"
Points (e) to (g) shall be renumbered (f) to (h) and points (h) to (s) shall be deleted.
9. In Article 7 (f), the words "contains less than 'are replaced by the words" contains at least'.
10. in Article 7 (g), "not more than" is replaced by "not more than" and "not less than" is replaced by "least."
11. in Article 7 (h), the words "not more than" shall be replaced by the words "not more than" and the words "not less than" shall be replaced by "least."
12. in Article 7, the following point (i) is added:
"(i) the ingredients of roasted coffee are roasted coffee beans, black or light, which, when broken, have a fragrance other than coffee."
13. in Article 9 (1) (a) and (b):
"(a) the name of the species and subgroup,
(b) near the product name, the words "decaffeinated," provided that the caffeine content in the dry matter of coffee based products does not exceed 0,3% for coffee extract and 0,1% for roasted coffee, '.
14. in Article 9 (1), point (c) is deleted;
Points (d) and (e) shall be renumbered (c) and (d).
15. in Paragraph 9 (1) (d), at the end of the dot, the following point (e) is added:
"(e)" aromatised "where the coffee has been aromatised."
16. The following Section 3 is inserted after Section 10:

„ODDÍL 3

COFFEE AND PARTS THEREOF
§ 10a
For the purposes of this decree:
(a) coffee products obtained by roasting various parts of polysaccharides-rich plants;
(b) roasted chicory product obtained from chicory roots (Cichorium intybus L.) which have not been used in the form of "witloof," sufficiently pure, dry, roasted with or without added small quantities of food oils or fats, natural sweeteners and molasses; may contain traces of insoluble substances not derived from chicory;
(c) a cereal-based coffee product made from roasted barley, rye or wheat;
(d) malt coffee product made from malted and roasted barley, rye or wheat;
(e) fig coffee product made from fig fruit;
(f) a mixture of coffee and other raw materials, including roasted minced coffee;
(g) coffee extract product obtained by extraction of coffee with the use of water as an extraction environment, excluding all hydrolysis processes, including the addition of acid or bases;
(h) dried chicory extract or soluble chicory or instant chicory chicory extract powder, granulated, in flakes, cubes or other solid forms, for which the dry matter content of the chicory is at least 95% by weight; the product shall not contain any ingredient other than those derived from extraction. Substances not derived from chicory shall not exceed 1% by weight,
(i) by the chicory extract paste, the chicory extract in grazing form, for which the dry matter based on chicory is not more than 85% and not less than 70% by weight; the product may contain only components derived from extraction. Substances not derived from chicory shall not exceed 1% by weight,
(j) a liquid chicory extract, in liquid form, for which the dry matter based on chicory is not more than 55% and not less than 25% by weight; the product may contain only components derived from extraction. Sugar may contain only a quantity not exceeding 35% by weight,
(k) an instant mixture of coffee products obtained either by mixing individual extracts or by a common extraction of a mixture of coffee products, possibly mixed with coffee;
(l) an instant coffee product containing coffee extract and other ingredients intended for the preparation of beverages by dissolving in water.
§ 10b
Breakdown of species, groups and sub-groups
Breakdown of species, groups and sub-groups is set out in Annex 8.
§ 10c
Labelling
(1) In addition to the information provided for in the Act and in the Special Legislation (1), the following shall be added:
(a) the percentage by weight of the content of coffee or coffee extract of coffee mixed with coffee and coffee extracts;
(b) "roasted with sugar" if the extract is from raw materials roasted with sugar,
(c) "sugar" or "containing added sugar," if the sugar has been added to the raw material after roasting.
(2) The permitted negative mass deviations are set out in Annex 7.
§ 10d
Quality requirements
The sensory, physical and chemical requirements are set out in Annex 9. ';

Čl. II
Transitional provisions
(1) Foodstuffs produced and put into circulation before the date of application of this Decree are assessed in accordance with existing legislation.
(2) Food labelling according to existing legislation may be used until 1 September 2001.
Čl. III
Efficacy
This Decree shall take effect on 1 September 2000.
