Decree of the Ministry of Labour and Social Affairs amending and supplementing Decree No. 102 / 1964 Coll., implementing the Social Security Act

Ministry of Labour and Social Affairs
of 28 June 1968
amending and supplementing Decree No. 102 / 1964 Coll., implementing the Social Security Act
The Ministry of Labour and Social Affairs shall, in agreement with the Central Council of Trade Unions and the participating central authorities, and in respect of members of the armed forces and members of the armed forces of the Occupational Corps, also provide for social security, as amended by Act No. 89 / 1968 Coll. ("the law '):
Čl. I
Decree No. 102 / 1964 Coll., implementing the Social Security Act, is amended as follows:
1.
„§ 26
Children's pension and education
Articles 33 (4) and (6) and 38 (5) of the Law
Not included in the child's own income
(a) scholarships provided under the applicable scholarship regulations; However, grants which are in the nature of compensation for earnings shall be included in the own income,
(b) the value of free boarding and free meals and clothing provided in accordance with the provisions on the physical arrangements for young people preparing for the future occupation and the value of natural resources granted to university students in the course of military duties on holidays;
(c) child support;
(d) the earnings for work held between the end of teaching in one school year and the beginning of teaching in the following school year, if the child continues to continue to study without interruption at the same or other school, the earnings for work during the school holidays immediately following the end of the study, if the child did not enter into permanent employment, or if the child did not start to engage in other permanent work activities, as well as the earnings of the apprentice or youth preparing for a future career in employment at the time of his or her retirement leave;
(e) student's earnings for work organised or awarded by the school or in agreement with the school authorities;
(f) occasional earnings for assistance or similar temporary work, as well as earnings for work under agreements on work outside employment; *)
If there is an education allowance, neither the child's own income nor his orphan's pension, including any increase in helplessness, shall be regarded as income.
2. Article 29 shall be deleted;
3. The title of the second part reads:
"Sickness, mother and child security and artist pension security"
4. Article 59 (1) reads as follows:
"(1) Writers, musical composers, artists, architects, scientists, performers and artists, recognised by the relevant top idea organization (" artists "), who:
(a) carry out their activities as a profession constituting a permanent and principal source of income but not in employment;
(b) are no longer involved in pension insurance for any other reason;
(c) do not benefit from an old-age, invalidity or personal pension,
are involved in sickness, mother and child security and pension insurance as workers with derogations referred to in this part of the Decree (compulsory security). ';
5. Article 63, including the headings, reads as follows:
"Health and safety of the mother and child
§ 63
Benefits
(1) These benefits are granted from sickness and mother and child security
(a) spa care;
(b) sick leave,
(c) maternity assistance;
(d) aid for the birth of a child;
(e) child allowances,
(f) death grants.
(2) Save as otherwise provided, the provision of the benefits referred to in the preceding paragraph shall be governed by the provisions on the provision of similar benefits applicable to workers. *)
6. Paragraph 66 (1) reads as follows:
"(1) Money assistance in the mother of an artist is provided on calendar days and is made at the reception stage

7. The following Section 67a is inserted after Section 67:
„§ 67a
Child allowance
(1) Children's allowances are due only if the allowance is duly paid.
(2) Artists also benefit from child allowances for calendar months for which the allowance is not paid (Paragraph 62 (2)); the condition is, however, that the allowance has been duly paid for the period prior to the establishment of the entitlement to sickness or monetary assistance in maternity or, where appropriate, before the entry into service of the armed forces. ';
8. In Paragraph 133 (1), the words "and if it is a child to whom the child is entitled to a pension shall be deleted for more than six months."
As a result of this amendment, in the same paragraph in paragraphs 2 to 4, the words relating to the report on the constitutional treatment of the child to whom the education is due shall be deleted.

This decree shall take effect on 1 July 1968.

The provision of medical preventive care is governed by Act No. 20 / 1966 Coll., on the care of the health of the people, and by the regulations issued for its implementation, in particular by Decree No. 42 / 1966 Coll.
