Decree of the Ministry of Finance on the remuneration of certain non-employment work

of 18 November 1966
on the remuneration of certain outside-employment work
According to Section 239 of the Labour Code No. 65 / 1965 Coll. in agreement with the State Commission on Finance, Prices and Wages and the Central Council of Trade Unions:
§ 1
Scope
(1) This decree regulates the remuneration of workers for work done for organisations
(a) on the basis of labour agreements [Paragraph 232 (2) (b) of the Labour Code],
(b) on the basis of employment agreements [Paragraph 232 (2) (a) of the Labour Code], save as otherwise provided in the specific provisions *. * *)
(2) The decree does not apply to remuneration
(a) activities carried out pursuant to Act No. 47 / 1959 Coll., on the modification of the legal conditions of experts and interpreters,
(b) creative activities which result in works protected by Act No. 35 / 1965 Coll., on works of literature, scientific and artistic, and artistic activities of performers carried out on the basis of agreements to carry out the work.
(c) lecturing and teaching activities and professional assessment and similar activities carried out for schools and educational establishments forming a single school system * * *), including graduate studies, except for courses organised at a racing school, †)
(d) project activities carried out under non-employment employment agreements;
(e) political farming activities carried out by social organisations.
§ 2
Lecture and teaching activities
(1) The level of remuneration for teaching and teaching activities is determined taking into account its nature and difficulty and the extent of the necessary preparation as follows:

II. Přednášková a výuková činnost odpovídající svou náplní výuce na školách poskytujících střední a úplné střední vzdělání (např. kursy, ve kterých se opakuje nebo doplňuje učivo škol poskytujících střední a úplné střední vzdělání, přípravné kursy pro podnikové instituty a vysoké školy, odborné jazykové kursy apod.), s výjimkou přednáškové a výukové činnosti uvedené pod III až 17,- Kčs
III. Přednášková a výuková činnost, odpovídající svou náplní výuce odborných technických a zdravotnických disciplín na školách poskytujících úplné střední vzdělání (např. školení vybraných pracovníků o některých otázkách technických, zdravotnických apod.) až 20,- Kčs
IV. Přednášková a výuková činnost, odpovídající svou náplní výuce na vysokých školách (např. kursy pro vedoucí pracovníky a specialisty o nejnáročnějších hospodářských a technických otázkách, výuka v postgraduálním studiu absolventů vysokých škol apod.) až 35,- Kčs
(2) The provisions of the preceding paragraph shall also apply to remuneration for discussion, consultation or seminars related to lecture and teaching activities.
(3) The remuneration referred to in paragraph 1 shall be reduced by between 25% and 50% for exercises, practical training with demonstration and excursion management.
(4) If the final examination is linked to the teaching activity, up to 16 Ccs shall be awarded to the President of the Examination Committee for 1 hour of the duration of the examination and to the examiners of the Panel for 1 hour of testing according to the difficulty of the test substance.
(5) In the context of the teaching activity, if the written work defined in advance by the curriculum has to be assessed, a staff member shall receive a remuneration of up to 8 Ccs for 1 hour of this activity. For the preparation, management, consultation and assessment of any final work, up to 10 CZK per hour shall be awarded.
(6) For syllabus (gross syllabus of lectures or teaching), remuneration shall be granted only if their preparation between the organisation and the worker has been agreed in advance. Rewards for syllables shall be awarded by the organisation according to the difficulty and extent of the processed substance up to one half of the total remuneration for the relevant lecture or teaching.
(7) If the activities referred to in the preceding paragraphs are carried out in a language other than Czech or Slovak (hereinafter referred to as "foreign language ') and if the foreign language is not the mother tongue of the worker, the remuneration shall be paid up to 25%. This increase does not, however, depend on teaching foreign languages and activities related thereto.
Translation and revision of translations
§ 3
(1) Translations of texts into Czech or Slovak from a foreign language are rewarded
a) u všech cizích jazyků s výjimkou jazyků uvedených pod písm. b) částkou až 16,- Kčs za jednu stránku překladu,
b) u čínštiny, korejštiny, japonštiny a dalších znakových jazyků částkou až 0,30 Kčs za jeden slovní znak.
(2) Translations of texts from Czech or Slovak to foreign language are rewarded
a) u všech cizích jazyků s výjimkou jazyků uvedených pod písm. b) částkou až 23,- Kčs za jednu stránku překladu,
b) u čínštiny, korejštiny, japonštiny a dalších znakových jazyků částkou až 0,50 Kčs za jeden slovní znak.
(3) When determining the level of remuneration referred to in paragraph 1 (a) and paragraph 2 (a), account shall be taken of the difficulty of a foreign language, in particular whether it is of European origin or other languages, such as oriental.
(4) For translation from a foreign language into another foreign language, the remuneration referred to in paragraph 2 is increased by up to 50%.
(5) Překlady textů z češtiny do slovenštiny a naopak se odměňují částkou až 5,- Kčs za jednu stránku překladu.
(6) The remuneration referred to in the preceding paragraphs may be increased by:
(a) if the translation is made by up to 30% from a tape recorder or other audio recording;
(b) if the translation is exceptionally linguistic and professionally demanding by up to 20%,
(c) if the translation is otherwise labour-intensive by up to 20%.
(7) The remuneration referred to in paragraphs 2 and 4 may be increased by up to 30% if it is for translations of extremely demanding scientific materials.
(8) Za překlad a utřídění hesel z cizího jazyka do češtiny nebo slovenštiny se místo odměn uvedených v předchozích odstavcích poskytne odměna až 1,80 Kčs za jedno heslo.
§ 4
(1) A reward shall be provided for language revisions of translations
a) u všech jazyků s výjimkou jazyků uvedených pod písm. b) a jazyků uvedených v odst. 2 částkou až 3,- Kčs za jednu stránku překladu,
b) u čínštiny, korejštiny, japonštiny a jiných znakových jazyků částkou až 0,05 Kčs za jeden slovní znak.
(2) For language revisions of translations from Czech to Slovak, and vice versa, a reward of 1 CZK per page will be provided.
(3) For professional revisions of translations, the remuneration referred to in the preceding paragraphs shall be increased by up to 50%.
(4) Za jazykové nebo odborné revize hesel (včetně hesel slovníkových) je možno místo odměn uvedených v předchozích odstavcích poskytnout odměnu až 0,50 Kčs za jedno heslo.
(5) If the translation text had to be revised mainly or completely at the time of the revision, the organisation may provide the revision worker instead of the remuneration referred to in the preceding paragraphs with a remuneration up to the amount not paid by the translator for that reason (§ 14).
§ 5
(1) One page of translation within the meaning of this decree means a text written by a machine containing 30 lines, in each row on average after 50 letters.
(2) The fees for translations provided for in this decree include fees for the production of a net translation written on the machine or, where appropriate, a pre-agreed number of pens.
Interpretation
§ 6
(1) Workers interpreting Czech or Slovak from a foreign language, or vice versa, shall be paid a remuneration for each hour of such activity, determined according to the difficulty of the interpreted substance up to the amount of 14 CZK.
(2) If a worker interprets from a foreign language into a foreign language, he shall be paid for each hour of such activity a remuneration determined according to the difficulty of the substance being interpreted up to the amount of 17 CZK.
(3) If the worker interprets only a normal conversation when accompanying foreigners, he shall be rewarded for each hour of interpretation up to an amount of 8 Ccs.
§ 7
(1) Workers who interpret public speeches, speeches at congressional conferences and other similar speeches of political or professional importance shall be provided for each hour of interpretation:

(2) In the case of cabin interpretation, the remuneration referred to in point (b) of the preceding paragraph shall be provided; the duration of the necessary preparation and rest directly related to the interpretation shall also be included in the interpretation period.
Professional opinions and other similar activities
§ 8
(1) A remuneration shall be set for the written drawing up of expert and lecturer opinions, analyses, studies, professional advice and observations of a similar nature, in such a way as to reflect the professional complexity of the action, its social importance, scope, expected results or other relevant aspects.
(2) Where, as a matter of importance for the determination of remuneration, the aspects of the time necessarily incurred to carry out the work, expressed in number of working hours, are used, work shall be provided for one hour.

(3) If the scale of the work in question, expressed in terms of number of its pages, is used as the consideration factor, a remuneration of up to 4 Cds shall be provided for one page of the text under consideration.
§ 9
If the expert opinions, expert advice and observations are submitted in writing or orally in the context of the deliberations of the expert commissions, the worker shall be remunerated for the expression of the expert opinion, which shall be laid down mutatis mutandis in the light of the considerations set out in Section 8; however, the highest amounts of remuneration may be used only exceptionally, if the professional work is of exceptional importance.
§ 10
Annotation and other documentation records
A reward of up to 5 CZK shall be granted for the production of one annotation or other similar documentary record made of material in Czech or Slovak language, of material in foreign language, a reward of up to 9 CZK, depending on the difficulty of the matter.
General and final provisions
§ 11
The remuneration for the activities referred to in Sections 2 (1) and 8 may exceptionally exceed the amount resulting from those provisions,
(a) the activities carried out by particularly excellent experts,
(b) when it comes to the transfer of scientific knowledge and experience from a few research sections of science and technology,
(c) are particularly important issues of ideological, political and cultural importance.
§ 12
(1) If the amount of remuneration for an activity falling within the scope of the activities referred to in paragraphs 2 to 10 is not specifically provided for in those provisions, the organisation shall grant a remuneration corresponding to that of a similar activity referred to in those provisions.
(2) For activities carried out on the basis of work agreements outside the employment relationship, other than those referred to in paragraphs 2 to 10, a remuneration shall be granted, in principle, equal to the remuneration for the same employment.
§ 13
Where several different activities have been agreed with the worker in one agreement, the total remuneration may be agreed for all such activities, in particular where they are related; However, this remuneration may not exceed, except in the cases referred to in Paragraph 11, the sum of the maximum amounts of remuneration which would otherwise be covered by the above provisions for each activity.
§ 14
The organisation may reduce the remuneration accordingly if the work carried out does not correspond to the conditions agreed upon; the agreement also provides that the organisation may withdraw from the agreement in such a case.
§ 15
(1) They are repealed.
(a) Decree 261 / 1953 of the State Labour Commission No. Ú. l., on the remuneration of lecture and teaching activities in racing schools, in central working schools, in boarding and other courses, and on the remuneration of heads and teaching assistants of boarding schools and courses;
(b) Decree No 79 / 1954 of the State Labour Commission on translation fees and translation corrections,
(c) Directives of the Ministry of Finance No. 163 / 88 671 / 1954, published under the heading No. 190 / 1954 Coll. instr. pro zk. org. NV, on the remuneration of interpretation performances,
(d) Directives of the Ministry of Finance No 163 / 114 529 / 1954, published under No 240 / 1954 Coll. instr. pro zk. org. NV, on the remuneration of employees for drawing up expert (expert) opinions, finalisation, studies and other professional observations,
(e) Directives of the Ministry of Finance No 283 / 96 816 / 1953, published under heading No 457 / 1953 Coll. for KNV, on the remuneration of lecturing and teaching activities in racing schools of work, central working schools, in boarding and other courses and on remuneration to senior teaching assistants (instructors) of boarding schools and courses,
(f) Directives of the Ministry of Finance No 283 / 25 641 / 1954, published under No 70 / 1954 Coll. for KNV, on the remuneration of employees for translations and corrections of translations.
(2) This decree shall take effect on 1 January 1967.

†) The decree does not therefore apply in the field of so-called corporate education to the remuneration of lecturing and teaching activities in corporate institutions, in corporate technical schools and in post-graduate studies; However, it applies to the remuneration of lecturing and teaching activities in the labour racing schools and all other courses in corporate education.
