adjusting remuneration for certain types of artistic activities performed outside the employment relationship
The Ministry of Culture of the Czech Socialist Republic provides according to § 13 paragraph 2 and § 39 paragraph 1 of Act No. 35 / 1965 Coll., on works of literary, scientific and artistic:
Scope
This decree regulates the remuneration of artists who are not employed
(a) operate in public concert, drama or music drama programmes (hereinafter referred to as "concert and play-action"), with the exception referred to in Section 2 (a);
(b) host in state theatres, State Symphony Orchestras and in state ensembles of songs and dances, as well as those who assist in this artistic activity (hereinafter referred to as "hosting and artistic assistance");
(c) perform at show and variety programmes;
(d) act as professional musicians in public production;
e) procure in the theatre sound recordings of scenic music, singing or spoken words for the purpose of public use of these recordings.
This decree does not apply to the remuneration of artists who
a) act as concert artists-soloists at separate concerts of classical music not subject to compulsory mediation, *)
(b) operate abroad under contract with a foreign organisation;
c) act on the territory of the Czech Socialist Republic as foreign exchange foreigners.
Remuneration
Concert and mimodical activity
(1) A one-off remuneration of up to 200% of his basic monthly salary is payable to the director, conductor and choreographer for studying opera, operetta, ballet, drama, music theatre, etc.; The same applies to a stage artist who will design a scenic expedition.
(2) The costume artist shall be remunerated for each costume design prepared and accepted up to 60 CZK.
(3) The director and choreographer shall be remunerated up to 5% of his basic monthly salary for the supervision of the study.
(4) The remuneration awarded to the stage and costume artists pursuant to paragraphs 1 and 2 shall also include the remuneration for the necessary supervision in the implementation of the art designs.
(5) For the performance in the performances referred to in paragraph 1, the soloist and conductor shall be remunerated up to 20% of his basic monthly salary, a member of the collective body, up to 15% of his basic monthly salary.
(1) For performing in concert, recital, ballet or pantomime performances, the soloist shall be remunerated up to 30% of his basic monthly salary; If there are more soloists in such a performance, each of them shall be remunerated up to 20% of his basic monthly salary.
(2) A remuneration of up to 15% of his basic monthly salary shall be payable to a member of the theatre or symphonic orchestra or singing, ballet and pantomime choir for performing in the performances referred to in paragraph 1.
(1) For performing in opera and opera cross-section or in matinee, in literary or musical bands, the soloist shall be remunerated up to 20% of his basic monthly salary; If there are more soloists in these performances, each of them shall be remunerated up to 15% of his basic monthly salary.
(2) A remuneration of up to 10% of his basic monthly salary shall be payable to a member of the theatre or symphonic orchestra or singing, ballet and pantomime choir for performing in the performances referred to in paragraph 1.
(1) A member of the accompanying orchestra shall be remunerated up to 10% of his basic monthly salary and of his conductor up to 15% of his basic monthly salary for the performance referred to in paragraphs 4 (1) or 5 (1).
(2) If only one artist performs this feature, he shall be remunerated up to 15% of his basic monthly salary. If this artist also acts as a soloist on the show, the remuneration may be increased up to 20% of his basic monthly salary.
(1) A member of the symphonic orchestra or theatre orchestra shall be remunerated up to 10% of his basic monthly salary for the performance of educational concerts of at least one hour.
(2) For the original analysis of the work and expert interpretation in the concerts referred to in paragraph 1, the performer shall be remunerated for the first interpretation up to 250, - CZK, in each subsequent performance up to 120, - CZK.
(1) An artist shall be paid up to 10% of his basic monthly salary for artistic presentation at schools of at least one hour.
(2) If there are more artists present at the school, each of them shall be remunerated up to 5% of his basic monthly salary.
(1) Artists who are not a performer of a theatre, orchestra or other similar artistic establishment, or who act in an art field other than that in which they work in an employment relationship, shall derive a remuneration from the salary the performers would pay if working in the same or comparable arts field.
(2) The member of the collective body, who acts as a soloist in the performances referred to in paragraphs 3 to 8, shall be remunerated by the Director of the intermediate organisation on the salary that the artist would pay if he worked as a soloist.
Rewards for artistic performances according to the provisions of § 3 to 8 also include fees for examinations, preparation, make-up, etc.
(1) The amount of the specific remuneration will be negotiated separately by intermediate organisations with artists for each programme.
(2) In socially relevant and justified cases, the Director of the intermediate organisation may increase the remuneration of artists up to 50% above the upper limit of the rates specified in the previous provisions. An artist to whom a personal salary has been established shall be admitted by the Director of the intermediate organisation to such an increase in remuneration, taking into account that the personal salary is also expressed in the valuation of the social importance of his artistic activity.
(3) Furthermore, the intermediate organisation may negotiate a share of the gross sales of the performances that artists deserve by their extraordinary performance with the organiser for performing artists. The amount of this share for all performers may not exceed 5% of the gross sales achieved during the performance.
Host and artistic assistance
(1) Host means a single or repeated performance of artistic performance outside the employment of an alien artistic establishment.
(2) Artistic assistance means performing outside employment in small acting events in a foreign artistic establishment.
(1) The guest conductor, director and choreographer is responsible for studying the work of a dramatic, musically dramatic, musical, ballet or pantomime one-off remuneration up to 200% of his basic monthly salary; The same applies to a stage artist who will design a scenic expedition.
(2) The guest costume artist shall be remunerated for each costume design accepted up to 60, - Kčs.
(3) The remuneration of the visiting conductor referred to in paragraph 1 shall also include the remuneration for conducting the first study; For further conducting of the study, the visiting conductor shall be remunerated up to 30% of his basic monthly salary.
(4) The remuneration of the visiting director or choreographer referred to in paragraph 1 shall also include remuneration for overseeing and choreographic supervision at the first performance of the work studied; for the supervision of further replicas of the work studied, the visiting director or choreographer shall be remunerated up to 5% of his basic monthly salary.
(5) The remuneration awarded to visiting artists under paragraphs 1 and 2 shall also include the remuneration for the necessary supervision in the implementation of the art proposals.
(1) The host soloist shall be remunerated for each hosting up to 30% of his basic monthly salary for the performance, opera, operetta, state symphony orchestras, state ensembles of songs and dances, ballet soloist and pantomime; in these cases, artists from the audience of the higher education institutions shall be remunerated up to 10% of the starting monthly salary of the graduate.
(2) Up to 15% of its basic monthly salary is payable to the visiting member of the collective body; However, if he is a soloist, his remuneration shall be derived from the salary which he would receive if he were a soloist in employment.
For artistic assistance, the performers shall be remunerated for each performance and for each main exam up to 50, - Kčs.
Rewards for hosting and artistic assistance under the previous provisions shall also include fees for examinations, preparation, events. making-up, etc.
(1) The director of the artistic establishment shall negotiate the amount of the specific remuneration with the artist for each hosting or assistance.
(2) A guest artist who is not a worker of a theatre, orchestra or other similar institution, or who is engaged in an art field other than that in which he is employed, shall be remunerated by the Director from the salary which the artist would pay if he worked in the same arts field in which he hosts.
(3) In socially relevant and justified cases, the director of the art establishment may increase the remuneration of the artist up to 50% above the upper limit of the rates laid down in the previous provisions. An artist to whom a personal salary has been set shall be admitted by the director of an art establishment to this increase in remuneration, taking into account that the personal salary is already expressed in the valuation of the social importance of his artistic activity.
Achievement during show and variety programmes
(1) Artists shall be remunerated under the following rates for the individual qualification stages of the relevant arts programmes for performing in the event of show and variety programmes.
(2) The qualification levels for the range of artistic performance rewards in the various fields of artistic performance are determined as follows: *)

(3) Artist can also be qualified for several fields of art. The Director of the Intermediate Organisation shall decide on the classification of the artist in the relevant qualification grade in each field of art.
(1) A remuneration of up to twice as much as the remuneration that would be due to it as a member of the ensemble may be awarded to the head of at least three members of the vocal, instrumental, ballet and pantomime ensemble which is simultaneously active in the ensemble.
(2) Aides in the field of artistic activity are remunerated in the same programme from 30, - Kčs to 80, - Kčs.
(1) The Director of the intermediate organisation shall negotiate the amount of the specific remuneration for each programme separately. However, the reward of the artist for repeated appearances at permanent estates or different workplaces can also be negotiated in the form of a one-off fee (flat-rate).
(2) In socially relevant and justified cases, the Director of the intermediate organisation may increase the remuneration of artists up to 50% above the upper limit of the highest level of qualification.
(3) Furthermore, the intermediate organisation may negotiate a share of the gross sales of performances that artists deserve by their extraordinary performance with the organiser for performing artists. The amount of this share for all performers may not exceed 5% of the gross sales achieved during the performance.
Activity of professional musicians in public production
Musicians and professional singers (hereinafter referred to as "musicians') who act in public production shall be remunerated within the limits set for each qualification grade, namely: * *)
a) during dance parties, fashion shows, musical accompaniment of artists and athletes, crematoria and ceremonial halls etc.

the first and the last hour of production shall be considered as a full hour, while the second and the second hours of production shall be reduced accordingly,
(b) in the case of feature music productions, lasting at least two hours, having the character of concert performances, for the whole production

where the remuneration of musicians, unless the production of the specified minimum time scale, is reasonably reduced.
(1) To the manager of at least a three-member file, if it is simultaneously active in the file, or to the conductor of the file, the production referred to in Article 21 (a) shall be remunerated up to twice the remuneration that would be due to it as a member of the file.
(2) To the manager of at least a three-member file, if it is simultaneously active in the file, or to the conductor of the file, the production referred to in Article 21 (b) shall be remunerated up to three times the remuneration that would be due to it as a member of the file.
(1) The level of the specific remuneration will be negotiated separately by intermediate organisations with musicians for each production.
(2) In socially relevant and justified cases, the director of the intermediate organisation may increase the remuneration of the music company by up to 50% above the upper limit of the highest qualification level.
(3) Furthermore, the intermediate organisation may negotiate a share of the gross sales of the musicians' outstanding performance with the organiser for the performers. The amount of this share for all performers may not exceed 5% of the gross sales achieved in production.
Making sound recordings in the theatre
It is for the recording of stage music, singing or spoken words in the theatre

for every minute and every minute of the recording.
(1) The director of the theatre and the artist will negotiate the amount of total remuneration for each recording separately.
(2) In socially important and justified cases, the theatre director may increase the reward of artists up to 50% above the upper limit of the rates set out in § 24.
The director of the theatre may also award remuneration for the acquisition of the audio recording provided that the recording is performed outside the scope of the obligations laid down in the contract of employment.
The manner and extent of public use of the recorded sound, or other conditions, are laid down in a contract negotiated between the theatre and artists.
Provisions common and final
The evaluation and registration of performers covered by this decree and the compulsory mediation of their activities shall be governed by specific provisions. *)
In the territory of the Czech Socialist Republic:
1. the provisions still in force (Paragraph 10) of the Decree of the Ministry of Culture of 24 November 1953, No 8623 / 53-HSU / 7, on the modification of the working and pay ratios of artistic workers in theatres (Reg. in the amount of 15 / 1967 Coll.);
2. the provisions still in force (Paragraph 11) of the Decree of the Ministry of Culture of 26 March 1954, namely 21 575 / 54-XVII / 2, on the modification of the working and pay ratios of artists in symphonic orchestras (reg. 15 / 1967 Coll.);
