Decret of the President of the Republic on the regulation of certain organisational and service issues in the field of justice

Decret of the President of the Republic
of 2 October 1945
adapting certain organisational and service issues in the field of justice.
On the Government's proposal, I state:

ČÁST I.

Designation of ordinary courts (public action offices).
§ 1.
Good civil and civil courts have the following designation:
(a) the district court;
(b) a regional court, if it is the choir court of the I. stools;
(c) the Land Court, if it is the Court of Appeal of the Second Chamber;
(d) the Supreme Court.
§ 2.
The District Court or the Regional Court, which exercises jurisdiction exclusively in civil judicial matters, in matters of commercial, enforceable or criminal matters, shall attach to the designation within the meaning of Article 1 of this Decree the additional designation "civil," "commercial," "enforceable" or "criminal" according to which of those powers it exercises.
§ 3.
The authorities set up in the Choir Courts and in the Supreme Court to perform the tasks assigned to them by the Code of Criminal Procedure shall bear the following designation:
(a) the Public Prosecutor's Office;
(b) the Regional Prosecutor's Office;
(c) the Prosecutor General.

ČÁST II.

Judge's actions.
§ 4.
(1) The Minister of Justice may authorise judges appointed for the District of the Land Court to deal separately in this district:
(a) the matters of the court of admonition;
(b) survivor's cases;
(c) matters of the guardian, except for the waiver of incapacity, the conversion and revocation, the smuggling and disposal of property of the guardian, the approval of adoption contracts, the approval of legal proceedings with the guardian and the issue of their assets;
(d) execution of movable material and claims on claims for cash;
(e) the enforcement of criminal penalties of any kind and the costs of criminal proceedings;
(f) land books.
(2) The powers referred to in the preceding paragraph shall be conferred on the President of the Regional Court, to which it is for the purpose of determining the extent to which authorisation is to be used in individual cases.
(3) Paragraph 3 (2) of the Law of 27 November 1896, No 217, on judicial organisation, is otherwise unaffected.

ČÁST III.

Systemisation and functional service.
§ 5.
Paragraph 40, paragraph 4 of the Law of 24 June 1926, No 103 Coll. (Salary Act), as amended by the Decree of 12 January 1944, No 15 Coll. (Amendment to the Salary Act), is amended as follows:
(4) In addition to the basic service charge, it is for the judges, in the places of employment of the first group (§ 36), to serve as a service, which is to be determined in annual amounts as follows:

§ 6.
Paragraph 40 (7) of Law No 103 / 1926 Coll. is amended as follows:
(7) It shall be for the senior court and Supreme Administrative Court to be the head of the Secretariat of the Supreme Court and the Supreme Administrative Court to be responsible for the functional service of the V., the other powers of the Secretariat of the Supreme Court and the Supreme Administrative Court to be responsible for the functional service of the VI scale; The functional service scale shall be the head of the auxiliary forces set up in the Land Court.
§ 7.
Paragraph 53 (2) of Law 103 / 1926 Coll. is amended as follows:
(2) The posts of these officials shall be organised as follows:

V. Ostatní konceptní úředníci ustanovení u zemských státních zastupitelství, přednostové ostatních státních zastupitelství, náměstkové přednostů státních zastupitelství, kteří jsou ve IV. stupnici.
VI. Ostatní konceptní úředníci, ustanovení u státních zastupitelství.

ČÁST IV.

Official titles.
§ 8.
(1) The official title of the "First President of the Supreme Court" belongs to the Judge, who is appointed in a post of office systemised for the administration of the Supreme Court. His deputy, if appointed in the post of office for the systematic purpose, shall be entitled "Second President of the Supreme Court."
(2) The official title of the "Senate President of the Supreme Court" is hereby assigned to the Judge who is appointed as President of the Supreme Court Chamber on a case-by-case basis.
(3) The official title "Judge of the Supreme Court" shall be laid down for judges appointed at the posts of judges, as set out in the III scale of the functional servant at the Supreme Court.
§ 9.
(1) The official title of the "President of the Regional Court," shall be for the Judges, who are appointed in a place of service systemically designed to govern the administration of the Regional Court, if appointed in the post of service for that purpose, the official title of "Vice-President of the Regional Court."
(2) The official title of the "Senate President of the Regional Court 'shall be laid down for the Judges appointed as Presidents of the Chambers of the Regional Courts in the places for which it is organised.
(3) The official title of the "Regional Judge 'shall be laid down for judges appointed at the posts of judges systemised in V.
§ 10.
(1) The official title of the "Chief Secretary of the Supreme Court" shall be to the head of the forces of the Secretariat of the Supreme Court, established at the posts of service set out in the Staff Regulations set out in the V scale of the functional servant. The other forces of the Secretariat of the Supreme Court, established at the posts of the service organised in the VI. scale of the functional service, shall have the official title "Secretary of the Supreme Court."
(2) The official title of the "Secretary of the Court of Justice" is for the head of the auxiliary forces set up in the Land Courts at post offices, as set out in the VI. scale of the serving officer.
§ 11.
(1) The official title of the "President" and of the Deputy President, if appointed at the post of service for which the "Vice President" is organised, is to be held by the Judges. This official title shall be accompanied by the title of the competent regional court, also taking into account the provisions of Section 2 of this Decree.
(2) The official title "Senate President of the Regional Court 'shall be laid down for the judges appointed before the Regional Courts at the official posts, which are systemised in the V scale of the functional servant. If such a judge is mandated within the meaning of Article 25 (2) of Law No 217 / 1896, the administration of the District Court at the seat of the Regional Court, he shall, in addition to that title, be entitled to the service title" Head of the District Court, "to which he or she shall be accompanied, if necessary, by a further designation within the meaning of Article 2 of this Decree.
(3) The official title of the "Regional Judge 'shall be laid down for the judges appointed before the Regional Courts at the posts of service systemised in the VI. scale of the functional servant.
§ 12.
(1) The official title of the "presiding officer of the District Court" shall be laid down for judges who are appointed at the posts of the departments of the District Court in V or VI.
(2) The official title of the "District Judge" is for the Judges, appointed at the posts of the service systems set out in the VII scale of functional service.
§ 13.
The official title of the "Judge" is for judges appointed at the posts of the judges' second group (§ 36, paragraph 1 of the Law No. 103 / 1926 Coll.).
§ 14.
The term "Prosecutor-General" shall be understood as the term of office of the Chief Prosecutor-General, which shall be laid down in the Staff Regulations of the General Prosecutor. The official title of the "Prosecutor-General 'shall be laid down for his Vice-Presidents, if they are appointed in post for this.
§ 15.
(1) The official title of the "Prosecutor of the Land" is hereby established for a conceptual official, established in a place of service systemised for the Head of the Regional Prosecutor's Office. The official title of the "Deputy Prosecutor of the Land 'shall be laid down for his Deputy Director, who shall be appointed at the post of office for this.
(2) The official title of the "Prosecutor of the Land" shall be given to the conceptual officials appointed at the posts of the Regional Prosecutor's Office at the Regional Public Prosecutor's Office in V. Staff.
§ 16.
(1) The title "Prosecutor," his deputy, if appointed at the post of service for that systematic, is the official title "Vice-Prosecutor."
(2) The official title of the "Prosecutor" shall be given to the conceptual officials who are appointed at the posts of the Office of the Public Prosecutor's Office at the VV scale of the official service.
§ 17.
Staff members referred to in this decree shall be entitled, in active employment, to use the official title attached to the post lent to them and shall be entitled to be appointed by that title. In retirement they may continue to use the official title which they were entitled to when they were retired, but are obliged to add to their official title a note indicating the retirement ratio; However, they are inadmissible for any official title in the conduct of the trial and in the defence of criminal matters.
§ 18.
The official titles of the judges and of the conceptual officials of the public action offices, who, within the limits of the rules in force, are only assigned to another court or office, shall not be recognised by such assignment.

ČÁST V.

Transitional and final provisions.
§ 19.
(1) If the staff member is appointed on the effective date of that decree at a post which, according to that decree, is included in a higher scale of the post of office, he shall acquire the rights arising from that higher classification only by leasing the post in the relevant higher scale of post. If a post with which the service allowance is linked pursuant to the provisions of § 40, § 6 or § 148 of the Staff Act No. 103 / 1926 Coll., is actually granted, it shall receive, on a higher scale, a functional service service equal to the sum of the current functional service and the corresponding allowance, and if such a functional service is not the highest.
(2) If the functional service resulting from the hire of a post on a higher seniority scale exceeds the sum of the current functional service allowance and the corresponding service allowance, the service allowance shall cease; otherwise the current allowance will continue to be payable to the staff member within the limits of the applicable rules, at the rate of the difference.
(3) In the absence of a post on a higher scale of functional service as referred to in the preceding paragraph, the current official status of the staff member referred to in the preceding paragraph shall remain unchanged, with the exception of the provisions of the next sentence concerning the official title. As from the effectiveness of this Regulation, it shall be for the staff members who have so far

(4) If there is no change in the classification of the post on which the staff member is appointed on the effective date of that decree, the current official title shall be replaced by a new official title under that decree. In addition to the official title of the "Regional Judge ', the term" Prenost of the District Court' may be added to the subsequent designation within the meaning of Article 2 of this Decree.
(5) Employees who, on the date of application of this decree, are assigned to a certain post but are assigned a service to another court or office are entitled to an official title belonging to them under that decree, in view of their last provision.
§ 20.
(1) General rules governing the organisation and general rules on jurisdiction of courts in civil matters and in criminal matters remain unchanged, unless otherwise provided for in this decree.
(2) Where the Organisational Act No 217 / 1896 refers, and other regulations on:
(a) the Councils of the Supreme Court of the Land;
(b) the Councils of the Regional Court,
(c) district judges (formerly council secretaries),
(d) judges (formerly adjuncts), meaning only judges, provisions in the places of employment of judges systemised
in the case of (a): in the courts of the Land of IV or V, a scale of functional service;
in the case of (b): in the regional courts in V or VI, a scale of functional service;
in the case of (c): in the regional or district courts in the VII. scale of the functional servant,
in the case of (d): in the second group of judicial posts.
§ 21.
(1) This decree is valid only in Czech and Moravian-Silesian countries and takes effect on the day of its publication; it shall be carried out by all members of the Government.
(2) On the date of its effectiveness, all provisions will cease to apply if they contradict it, in particular the Law of 9 November 1928, No 201 Coll., on the treatment of certain organisational issues in the field of the judiciary.
