GOVERNMENT REGULATION
of 20 December 2012
amending Government Regulation No 361 / 2007 Coll., laying down conditions for the protection of health at work, as amended
The Government mandates pursuant to Section 21 (a) of Act No. 309 / 2006 Coll., which regulates other requirements of safety and health at work in employment relations and on ensuring health and safety in the activity or provision of services outside employment relations (the Act on other conditions of safety and health at work) and for the implementation of the Labour Code:
Government Regulation No. 361 / 2007 Coll., laying down conditions for the protection of health at work, as amended by Government Regulation No. 68 / 2010 Coll. and Government Regulation No. 93 / 2012 Coll., is amended as follows:
1. In Paragraph 25 (7), "60 'is replaced by" 90'.
2. Annex 2 shall read as follows:

Procedure for determining the permissible exposure limit of a chemical mixture
The procedure for establishing the permissible exposure limit (PEL) of a chemical mixture shall be determined according to the following principles:
1. If there are 2 or more substances that act on the same organ system, it is expected to act additive (the effect is added) unless there is scientific evidence to the contrary. The sum of their measured concentrations to their PEL or NPK-P shall not exceed 1. The calculation shall be made using the formula:

k1NPK-P1 + k2NPK-P2 +....... knNPK-Pn ≤ 1
where
k1, k2 to kn - are the measured concentrations of individual substances
PEL1, PEL2 to PELn - the determined PEL values for each substance are
NPK-P1, NPK2 to NPK-Pn - are determined values of NPK-P of individual substances.
2. The formula for the calculation of NPK-P is used for substances with significant acute effects such as irritants or narcotic substances.
3. If the additive effect of each substance cannot be predicted, the concentration of any component of the mixture shall not exceed its NPK-P or PEL.
PEL procedure for higher pulmonary ventilation
1. Pre-treatment of PEL with higher pulmonary ventilation should be performed
(a) how much the lung ventilation value of 20 litres / min is exceeded during work;
(b) whether the work is continuous or interrupted;
(c) the health status of a group of employees who will perform hard physical work;
(d) whether work is carried out simultaneously under unsatisfactory microclimatic conditions.
2. For the determination of PEL adjustments,
(a) 20 litres of minute ventilation and 100% of PEL, correspond to an average minute output of 11,7 kJ / min (195,0 W) - net, 40 litres of minute ventilation and 50% of PEL, corresponds to an average minute output of 26,4 kJ / min (440,0 W) - net,
(b) for a pulmonary ventilation value of 40 litres per minute, the PEL shall be 50% of the PEL applicable to pulmonary ventilation value of 20 litres per minute; for pulmonary ventilation between 20 and 40 litres per minute, the proportion of PEL by linear interpolation shall be determined.
PEL procedure for more than eight hours
1. Before editing PEL for more than eight hours shall be collected:
(a) how many hours are extended,
(b) the nature of the chemical's action on the human organism;
(c) the health status of a group of employees who are to work more than 8 hours a day;
(d) whether there are several pollutants at the same time, or work is carried out under adverse microclimatic conditions, or if it is heavy physical work and other circumstances that may affect the level of risk.
2. In cases where there are no factors adversely affecting the level of risk, PEL shall be adjusted as follows:
(a) where longer shifts are separated by free days or by eight-hour shifts
PELL = 8 × PELL
(b) if the weekly working time is more than 40 hours, with a maximum of 8 hourly exchange exposures:
PELt = PEL × 40T
(c) if the days with a longer shift are followed immediately
PELt = 8 × PEL × 24-t16 × t
PELt - is the new PEL for other exposure periods
t - is the exposure time in hours per working time
