DECLARATION
of 18 December 2003
amending Decree No. 291 / 1991 Coll., on Primary School, as amended
The Ministry of Education, Youth and Sports provides, pursuant to § 13 (a) and (m) of Act No. 564 / 1990 Coll., on State Administration and Self-Government in Education:
Decree No. 291 / 1991 Coll., on Primary School, as amended by Decree No. 225 / 1993 Coll., Act No. 138 / 1995 Coll. and Decree No. 234 / 2003 Coll., is amended as follows:
1. In Article 3, the following paragraph 5 is inserted after paragraph 4:
"(5) A student with a mental disability may, at the request of a student's representative and the opinion of a competent specialist and pedagogical psychological counselling or a specially educational centre, be included by the school director. Classification is only possible if the necessary specific pedagogical support is provided in the individual training programme. Its scope and content shall be determined on the basis of an expert assessment of the pupil, in agreement with the representatives of the pupil of the pedagogical-psychological guidance centre or a special teaching centre. ';
Paragraphs 5 to 10 shall be renumbered paragraphs 6 to 11.
2. in Section 5, paragraph 1, including footnote 6, reads:
"(1) The school director may establish special classes for pupils with hearing disabilities, pupils with visual impairment, pupils with physical disabilities, pupils with mental disability, pupils with speech defects and pupils with medical diagnosis autism.6)
6) Paragraph 2 (10) of Decree No. 127 / 1997 Coll., on special schools and special maternity schools. '
This decree shall take effect on the day of its publication.
