amending Act No. 6 / 1993 Coll., on the Czech National Bank, as amended, and Act No. 136 / 2011 Coll., on the circulation of banknotes and coins and amending Act No. 6 / 1993 Coll., on the Czech National Bank, as amended, as amended, and repealing Act No. 76 / 1976 Coll., on the caking of Czechoslovak ducats
Parliament has decided on this law of the Czech Republic:
Amendment of the Act on the Czech National Bank
Act No. 6 / 1993 Coll., on the Czech National Bank, as amended by Act No. 60 / 1993 Coll., Act No. 15 / 1998 Coll., Act No. 442 / 2000 Coll., Act No. 145 / 2005 Coll., Act No. 41 / 2011 Coll., Act No. 92 / 2011 Coll., Act No. 136 / 2001 Coll., Act No. 131 / 2002 Coll., Act No. 160 / 2007 Coll., Act No. 36 / 2008 Coll., Act No. 124 / 2008 Coll., Act No. 57 / 2006 Coll., Act No. 62 / 2006 Coll., Act No. 281 / 2009 Coll.
1. In Section 12, the words "banknotes a 'are inserted after the word" i'.
2. In Article 16 (2), the words "banknotes a 'shall be inserted after the words" commemorative'.
3. Article 16a is deleted.
4. Sections 20 and 21 read:
(1) The Czech National Bank has the exclusive right to issue commercial coins called Czech ducats. Paragraph 15 shall apply mutatis mutandis to them.
(2) Business coins are coins issued by the Czech National Bank, which are not legal money and have no nominal value.
(1) No one may produce, import, offer, sell or otherwise expand medals, tokens or similar objects which by their execution are capable of misleading their holders that they are coins issued by the Czech National Bank.
(2) No one shall use the word "coin" when marking or describing a chip, medal or similar item in connection with their offering, selling or other expansion. ';
5. In Paragraph 22, the present text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The Czech National Bank shall establish a decree in the case of a commercial coin, whether it is issued as one Czech ducat or multiple thereof, the dimensions, weight, material, appearance, its additional formalities and the date of issue."

Transfers
(1) The transfer shall be made by the person who:
(a) in contravention of Paragraph 21 (1), produce, import, offer, sell or otherwise extend medals, tokens or similar items interchangeable with coins issued by the Czech National Bank; or
(b) in contravention of Paragraph 21 (2), uses the word "coin" in the designation or description of a chip, medal or similar object in connection with their offering, sale or expansion.
(2) A natural person, legal or business, commits an offence by:
(a) does not provide the necessary information or background pursuant to Paragraph 44a (1);
(b) fails to comply with the obligation imposed by the decision on the remedy measure under Paragraph 44a (4); or
c) does not inform the Czech National Bank of the correction of the deficiency pursuant to § 44a (5).
(3) A legal or commercial natural person as referred to in § 41 (1) (a), (b) or (c) commits an offence by:
(a) fails to draw up or submit a statement in accordance with Paragraph 41 (3); or
(b) contrary to Paragraph 41 (4), it shall not ensure the correction, specification or explanation of the statement.
(4) A penalty may be imposed in respect of an offence:
(a) 5 000 000 CZK if the offence referred to in paragraph 1 (a) or 2 (b) is committed;
(b) 1 000 000 CZK if the offence referred to in paragraph 1 (b), paragraph 2 (a) or (c) or paragraph 3 is committed. "
7. Article 46a shall be deleted, including the title.
Amendment to the law on circulation of banknotes and coins
Act No. 136 / 2011 Coll., on the circulation of banknotes and coins and amending Act No. 6 / 1993 Coll., on the Czech National Bank, as amended, as amended, Act No. 254 / 2012 Coll., Act No. 278 / 2013 Coll., Act No. 323 / 2016 Coll. and Act No. 183 / 2017 Coll., is amended as follows:
1. In Article 2, the following paragraph 3 is inserted after paragraph 2:
"(3) The commemorative banknote is a domestic banknote intended for collector's purposes."
Paragraphs 3 to 5 shall be renumbered paragraphs 4 to 6.
2. In Article 2 (4), the words "general or 'are deleted.
3. In Article 5 (2) (b), the words "commemorative banknotes' are inserted after the words" it is'.
4. In Article 6 (1), the words "commemorative banknotes or" shall be inserted at the beginning of point (d) and the words "commemorative banknotes or" shall be inserted after the words "commemorative banknotes."
5. In Article 10 (2), the words "commemorative banknotes or" shall be replaced by "commemorative coins or commemorative coins."
6. In the second sentence of Article 10 (4), the words "banknotes or commemorative banknotes' shall be inserted after the words" except commemorative '.
REPEAL PROVISIONS
Act No. 76 / 1976 Coll., on the stamping of Czechoslovak ducats, is repealed.
EFFECTIVE
This Act shall take effect on the 15th day following its publication.
