DECLARATION
Ministry of Agriculture, Forestry and Water Management
of 12 August 1965
on the protection of trees growing outside the forest
The Ministry of Agriculture, Forestry and Water Management, in agreement with the participating central authorities, provides in accordance with Section 55 of Act No. 166 / 1960 Coll., on Forests and Forestry (Forest Act):
Purchase of raw wood
Mining and purchase of raw wood from trees growing outside the forest
(1) The cutting down of trees growing outside the forest not covered by the provisions of the Plant Production Development Act (*) is only possible with the approval of the local national committee.
If, however, there are trees
(a) on shore,
(b) acting as windmills,
(c) intended for the protection of drains, slopes, salts and peat,
(d) registered in the interests of general nature protection,
(e) specially protected under the rules on national nature conservation;
(f) belonging to a cultural monument;
(g) in the flood zone, * *)
they may be reported only with the agreement of the District National Committee given in cooperation with the State Nature Protection Authority (points (d) and (e)), or with the State Monument Care Authority (points (f)), as appropriate. In particular, the national committees shall ensure that the felling of trees is not permitted which would cause their excessive extraction or disturbance in the landscape.
Final provisions
The following shall be deleted:
1. Decree of the Ministry of Agriculture No. 32 / 1960 Coll., on the purchase of raw timber and on the exceptional supply of timber,
2. the provisions of Decree No 331 / 1951 Ú. l (No 360 / 1951 Ú. v.) which have not yet been repealed, on the protection of trees growing outside the forest and on the management of timber derived therefrom,
3. the Implementing Directive for Decree No. 32 / 1960 Coll. (Reg. 64 / P-1960 Collection of Guidelines for National Committees) and the Appendix to these Directives No. 58 / 1961 Bulletin of the Ministry of Agriculture, Forestry and Water.
This Decree shall take effect on 1 September 1965.
