Act on the Education of Adoption to the Occupation in the Teaching Ratio (Apprentice Act)

The National Assembly of the Czechoslovak Republic decided on the following Act:

Training courses
§ 24
(1) Education of apprentices is carried out in vocational schools.
(2) Where apprenticeship education can be fully secured in the enterprise's facilities according to the requirements of effectiveness, they shall establish and manage vocational training centres in which vocational training is carried out, vocational and general training subjects and non-school and non-working apprenticeship.
(3) Where the conditions for the establishment of a vocational training centre as a whole are not met, vocational training or, where appropriate, the non-working education of apprentices in apprenticeships set up and managed by undertakings or at the appropriate places of work of the enterprise, and training of vocational and general education subjects or, where appropriate, of apprenticeships in apprenticeship schools set up and managed by the executive body of the competent national committee (hereinafter referred to as "apprenticeships') or in another undertaking.

(5) It is also possible to provide accommodation and meals for apprentices in vocational schools.
§ 25
(1) The head of the holding is responsible for the education of apprentices in the establishment.
(2) Training courses set up and managed by the enterprise as a whole are managed by the manager. It shall be established by the director of the undertaking in agreement with the executive body of the relevant national committee and after consultation of the Trade Union Racing Committee.
§ 26
(1) The Ministry of Education and Culture shall establish and adapt, in accordance with the State Plan for the Development of the National Economy and in agreement with the competent central authorities and bodies, according to the proposals of the relevant national committees, a network of vocational training centres established and managed by enterprises as educational units, apprenticeships and apprenticeships, and shall ensure their effective deployment and economical use.
(2) The establishments which on 1 April 1957 served or were intended for the education of pupils at the schools of the State Reserves of Employment under Act No. 110 / 1951 Coll., on State Reserves, and apprentices at the Apprenticeship Schools under Government Decree No. 19 / 1954 Coll., on the recruitment and preparation of youth for the occupation of non-State Reserves of Employment shall, in principle, be maintained for their purpose and shall be used for the establishment of vocational schools under this Act.
(3) Derogations from the provisions of paragraph 2 are provided for by the Ministry of Education and Culture in agreement with those central authorities and bodies as regards the facilities of undertakings subordinate to other central offices or authorities.
(4) The Ministry of Education and Culture may, in agreement with the competent central authorities and the authorities, delegate its powers under paragraphs 1 and 3 to the executive bodies of the national committees and adapt the procedure for its implementation.
§ 27
(1) Teachers of vocational schools established and managed by enterprises as educational institutions and directors, teachers, educators and other staff of apprenticeships are public servants. The other employees in the establishment are employees of the enterprise.
(2) The Ministry of Education and Culture shall, in agreement with the Central Council of Trade Unions and with the competent central authorities and bodies, issue the Conditions of Employment for Teachers of Vocational Schools set up and managed by enterprises as a training unit, which shall also lay down the rights and obligations of such teachers towards the institutions of the enterprise.
(3) The Ministry of Education and Culture is responsible for the education of educational staff involved in the education of apprentices.
Training of apprentices
§ 28
National committees and their executive bodies shall ensure the creation of conditions for the successful education of apprentices, shall ensure that, in the education of apprentices, the deployment and use of vocational training is carried out in accordance with the requirements of effectiveness and economy, shall control the education of apprentices and shall organise and manage them in apprenticeship schools in accordance with the principles laid down by the Ministry of Education and Culture.
§ 29
The Ministry of Education and Culture organises and organises, ideally and methodically, apprenticeship education throughout the national economy and coordinates and controls this education.
§ 30
(1) The competent central authorities and bodies in their field of competence organise, manage and control apprenticeship education in accordance with the principles established by the Ministry of Education and Culture.
(2) The competent central authorities and authorities and undertakings are obliged to create the conditions for the successful conduct of apprenticeship education in the figures set out in the national plan for the development of the national economy and to respect the requirements of effectiveness and economy.
(3) In the education of local economy apprentices, the executive bodies of the Regional National Committees shall exercise the powers which, pursuant to the preceding paragraphs, belong to the central offices and authorities.
§ 31
(1) The Ministry of Education and Culture establishes a Central Advisory Council for the Coordination of the Education of Trainees. Its task is to comment on fundamental issues of organisation and on proposals for major methodological measures concerning apprenticeship education. As a general rule, the Minister for Education and Culture will appoint members of this Advisory Board according to the proposals of the Heads of Central Authorities and bodies involved in the education of apprentices or the care of them from excellent pedagogy workers and people with rich experience in apprenticeship education.
(2) An Advisory Council for the Coordination of Educational Education shall be set up in charge of education and culture. Its members shall be appointed by the Education and Culture Officer mutatis mutandis in accordance with paragraph 1.

Common provisions
§ 32
Save as otherwise provided for in this Law or in specific regulations, teaching conditions shall be governed by the rules applicable to working conditions.
§ 33
Financing apprenticeship education
(1) Undertakings shall pay in principle the personal and material costs of the education of apprentices in their establishments, with the exception of the personal costs of teachers, for the total own costs.
(2) The relevant national committees shall pay for the personal and material costs of apprenticeship education in apprenticeship schools and the personal costs of teachers in vocational schools established and managed by enterprises as educational units.
§ 34
Compensation of costs
An undertaking whose apprentices are raised in another undertaking shall be obliged to compensate that undertaking for the personal and material costs incurred by its apprentices.
§ 35
For the purposes of this Act, other organisations and establishments and the head of the undertaking shall also be considered to be the head of such organisations and establishments. For single agricultural cooperatives, the Ministry of Agriculture and Forestry and for consumer and production cooperatives shall determine the central authority responsible for carrying out the tasks of the director of the holding.
Transitional and final provisions
§ 36
(1) Measures taken in accordance with this Act before its entry into force shall be considered as measures under this Act.
(2) Teachers of state job advances under Act No. 110 / 1951 Coll. count the time they spent in these schools until the period of the teaching relationship.
§ 37
(1) The regulations implementing this law shall be issued by the Ministry of Education and Culture in agreement with the participating central authorities and authorities and by the Central Council of Trade Unions and, as regards the provisions of Sections 33 and 34 of the Ministry of Finance.
(2) For the education of apprentices in agriculture, the Ministry of Agriculture and Forestry may, in agreement with the Ministry of Education and Culture and the Central Committee of the Union of Workers in Agriculture, authorise derogations from the provisions of Sections 16 and 24 (3).
§ 38
All provisions shall be repealed if they are contrary to this law; in particular:
1. Act No. 110 / 1951 Coll., on State Job Advances,
2. Government Regulation No. 111 / 1951 Coll., regulating the relationship between vocational training centres or schools of racing training and enterprises,
3rd Government Decree No. 22 / 1952 Coll., on the reorganisation of apprenticeship examinations,
4. § 5 (2) and (3) of Act No. 31 / 1953 Coll., on the School System and Teacher Education (Education Act),
5th Government Decree No. 71 / 1953 Coll., on Vocational Schools for Education of Masters of Production Training,
6th Government Decree No. 19 / 1954 Coll., on the recruitment and preparation of youth for the occupation outside the school of state job advances.
§ 39
Efficiency and execution
This Law shall take effect from the date of its publication; It shall be carried out by Ministers for Education and Culture, Agriculture and Forestry and by other members of the Government.
