on the safety of work and technical equipment in the operation of road vehicles
The Czech Labour Safety Authority provides in agreement with the competent authorities and organisations pursuant to § 5 (1) (d) of Act No. 174 / 1968 Coll., on State Professional Safety Supervision:
§ 1
Scope
(1) The Decree lays down the obligations of organisations, other operators, (1) which provide certain services and repairs on the basis of the authorisation of the National Committee (hereinafter referred to as "operator") and of workers with regard to the safety of work and technical equipment in operation, i.e. in particular on the movement, operation, maintenance and repair of road vehicles (hereinafter referred to as "vehicles"), and on the work related thereto, as well as organisations involved in road transport operations.
(2) The decree does not apply to the operation of vehicles:
(a) the armed forces of the Federal Ministry of Defence,
(b) armed corps of the ministries of the Interior, the National Security Corps and the Border Guard services and the protection of state borders.
(3) For the purposes of this Decree, vehicles shall mean all vehicles moving with motor power on the road, (2) on reinforced or unpaved roads and in the field which are not linked to tracks or to electrical lines. The term "vehicle 'includes any vehicle combination.
OBLIGATIONS FOR VEHICLE OPERATIONS
§ 2
Driver eligibility
(1) The transport of goods and persons by vehicles with a total mass exceeding 7,5 tonnes may be carried out by drivers meeting the conditions laid down in the special Regulation (3) and having undergone at least 200 hours of demonstrable training on vehicles with a minimum mass of 7,5 tonnes. Training means driving under the supervision of an experienced driver.
(2) Only drivers with at least 2 years of experience in driving vehicles of equal or greater weight may carry out journeys where the driving of a vehicle takes more than 8 hours during the working shift.
§ 3
Safety breaks
(1) The continuous driving time must not exceed 3 hours. The driving time shall be considered as a continuous driving time and the stay of the driver in the vehicle when stopped for reasons of passenger traffic or handling. If that period is interrupted for a period shorter than those laid down in the following paragraphs, the driving time shall be deemed to be continuous.
(2) Drivers must interrupt driving for reasons of occupational safety at the latest after 3 hours of continuous driving for a period of 30 minutes (hereinafter referred to as "the safety break ') during which drivers do not carry out activities arising from their duties.
(3) The 30-minute security breaks may be split by the operator, the shortest time available for this purpose being 10 minutes, except for long-distance transport.
(4) The provisions on safety breaks do not apply if two drivers are assigned to the vehicle at the same time and are always alternated after 3 hours of continuous driving. 4)
(5) The operator shall check the driving times and other work, as well as the time of safety breaks and rest periods on the basis of tachograms, vehicle traffic reports and other documents.
(6) Tachograms must be kept by the operator for three years.
§ 4
Accommodation of vehicles
(1) The operator is obliged to provide the members of the vehicle crew with proper accommodation on business trips. If vehicles are equipped with beds enabling crew members to lie down comfortably, rest periods may be spent on these beds provided the vehicle is stationary. These beds cannot be used when drowning in the vehicle.
(2) The beds in vehicles intended for the crew must comply with the provisions of the specific regulations. 5) Where vehicles used for long-distance transport are equipped with beds for a vehicle crew, the operator shall provide them with the necessary quantities of bedding, which shall be converted clean:
(a) when the vehicle crew has changed,
(b) in cases specified by the health service authority.
§ 5
Traffic Regulations
(1) The operator and the organisations in whose premises loading, unloading or other work connected with the operation of vehicles are carried out are obliged to draw up a timetable for transport.
(2) In particular, the traffic rules are addressed by:
(a) the way in which internal roads, parking, weaning and storage areas, garages and other areas are secured in terms of safety of work and technical equipment, in particular:
- the implementation and maintenance of communications (width, surface),
- the way in which communications are used (speed, direction),
- road marking (horizontal and vertical road signs),
- reserved parking areas, no parking,
- identification of loading and unloading areas,
- lighting of roads, loading and unloading areas and parking lots,
- cleaning and repair of communications;
(b) movement of all means of transport on internal roads
- prohibitions or orders to enter or enter certain objects and premises,
- restrictions on the movement of vehicles in certain situations, such as alternating shifts, collecting workers, etc.,
- the transport of special costs,
- the movement of special vehicles,
- the operation of foreign vehicles and the movement of persons at the premises of the organisation,
- transport of persons within the organisation;
(c) maintenance and repair of vehicles
- the suspension of vehicles for repair and repair,
- means of towing a non-mobile vehicle,
- garaging;
(d) organisation of checks and training and checking of staff
- the organisation of checks on compliance with the traffic rules and the relevant safety regulations,
- how workers are trained and checked.
(3) A schematic ground plan of the organisation with the marking of all communications, including the marking of narrowed profiles, the marking of crossings, entrances and entrances to the various objects of the organisation, parking lots, parking spaces, garages, workplaces for the treatment, maintenance and repair of vehicles is also part of the transport operating order.
§ 6
Participation of bogies and guides in operations
(1) An operator is required to assign a driver to a vehicle if:
(a) this is necessary for loading or unloading and if the nature of the load and, where appropriate, the structure of the vehicle so require;
(b) it is a combination of vehicles to be divided or combined, 6)
(c) the vehicle must revert and enter narrow spaces, or caution should be exercised;
(d) this requires road safety, 7) or the nature of the work requires the assistance of the driver;
(e) this lays down specific rules (transport of explosions, etc.).
(2) The operator may arrange the work otherwise performed by the driver, including by other means, such as loading and unloading crews at permanent workplaces or by assigning more than one driver or by technical means appropriate to the safety of work.
(3) An operator shall assign to a vehicle with a trailer for the carriage of passengers of a conductor, unless the trailer is equipped with a secure trailer door locking device operated from the driver's seat and on the driver's cab by optical signaling the opening and closing of the trailer door; the operator is obliged to ensure the control and maintenance of the locking and signalling equipment.
(4) The driver of the vehicle shall be entitled to give instructions to drivers and guides.
§ 7
Allocation of other drivers
Where two or more drivers are assigned to a vehicle, the operator shall designate a crew manager who is entitled to instruct the members of the vehicle crew.
§ 8
Back and back
(1) The driver is obliged to take caution when reversing and to comply with special regulations. 8) When operating outside the road, the driver shall be required to comply with these rules mutatis mutandis; If the driver backs without a helper, he must step forward and check the nature of the terrain and any obstacles. If the vehicle is equipped with reversing lamps, it shall be activated when reversing. The start of reverse without a helper is required by the driver to emphasize the audible warning signal.
(2) The driver can only drive to sandpits, quarries, landfills, construction sites and similar places if the way to them is wide enough, firm and passable. Under reduced visibility, the driver may only enter the loading and unloading areas if the space is sufficiently illuminated. 9) The vehicle shall be obliged to stop so far from the edge of the quarries, fills and landfills, according to the loading capacity of the land, so as to avoid the risk of the vehicle falling down or being buried. The places where it is necessary to stop must be marked by the organisation operating such a workplace with well-readable tables, signs and railing and red light at night; If circumstances so require, the driver must be alert to the situation at the site.
(3) At workplaces where vehicles without drivers (guides) are reversing, in particular at bus stations, urban public transport loops, transports, construction sites and other similar places, an organisation operating such workplaces is required to entrust a qualified and properly trained worker to guide the driver in reverse.
(4) The authorised staff member shall be obliged to direct the driver to reverse the signals agreed between them in such a way as to avoid confusion or confusion; is obliged to move so that it is still in the driver's direct field of view. If the driver loses sight of him, he shall stop immediately; they may only continue to back up on a signed sign of an authorised official. In case of reduced visibility or at night, the authorised staff member shall be obliged to give signals with agreed light signals.
§ 9
Stop and stop of the vehicle
Stopping and standing is not allowed in workplaces where the vehicle
(a) obstructs the safety of work and technical equipment;
(b) is threatened by work in its vicinity;
(c) is threatened by the nature of the terrain (landslide, stone fall, soft clay etc.),
(d) standing within 20 m of the fuel pump if it is not waiting for pumping;
(e) is threatened by high or very high voltage guidance.
§ 10
Connection and disconnection of trailers
(1) Connecting and uncoupling of trailers is carried out according to the manufacturer's instructions. They can only be performed by a properly trained and trained worker who has been assigned to do so. Unless otherwise specified in the manufacturer's instructions, when the trailers are connected or disconnected in or on them, they shall be braked, wedges shall be securely positioned, semi-trailers supported by safe supports. It is prohibited to drive a trailer on a towing vehicle. When connecting trailers, the worker is obliged to use protective gloves and to adjust the curtain in advance to the emergency condition. The driver shall not enter between the vehicles involved before the towing vehicle curtain is not more than 250 mm from the trailer's eye. At this distance, the towing vehicle shall stop at the agreed signal. The driver may only complete reversing to the stop of the suspension device on the prescribed sign of the guide worker and brake the vehicle after stopping. If the driver does not feel the impact, he must stop immediately, step out of the cab and see why the vehicles have not been connected.
(2) After the connection of both vehicles, the driver shall be obliged to examine on the spot the proper connection and securing of the suspension device against uncoupling, to ensure that the braking and electrical coupling devices of the two vehicles function properly and that the hinges (ropes, chains) are properly connected to the safety coupling devices if these hinges are mandatory under specific regulations. 10)
(3) The driver must check
(a) before disconnecting that the trailer is securely secured against spontaneous movement;
(b) after disconnection, that the trailer is stopped and, if necessary, its wheels are reliably secured on both sides; the semi-trailer shall be supported by safe supports.
§ 11
Vehicle pressure
Vehicles are only allowed to push with a tow bar using motor power. Unsuspended trailers shall not be pushed with motor force.
§ 12
Repair and control of vehicles
(1) The vehicle fitted to the repair must be empty and properly cleaned. The repair of the laden vehicle is allowed only exceptionally in simple repairs where the composition of the load would cause exceptional difficulties. In such a case, a correction shall be made under the direct supervision of the manager, who shall determine the technological process. Dangerous goods vehicles shall not be repaired in enclosed spaces.
(2) The technical condition of the underside of the vehicle shall be checked only when the engine is off. No gear shall be included during the check; the vehicle shall be secured against movement. Control of engine running and engine-dependent devices shall be permitted only if the engine is reliably fixed and is not endangered by the engine running. In case of major vehicle repair, the power source may only be connected when checking the parts of the vehicle that cannot be tested without its connection.
(3) It is not permitted to handle the control device of the vehicle (towing, forks, latches, safety devices, etc.), automatically or servo-controlled by the gearbox or with the additional gearbox of the vehicle, etc., without prior measures to prevent undesirable movement of the vehicle and the possibility of injury.
(4) The control and repair of the folding device are only allowed if the raised tilting part of the vehicle is securely supported by a fixed support, reliably preventing self-folding.
(5) During repair, the vehicle or parts thereof shall be securely secured. The provisions of this paragraph shall not apply in the case of the exchange of wheels outside the premises of vehicle repair and repair services.
(6) If the vehicle is checked on a test cylinder, the vehicle shall be so secured that it does not automatically leave the cylinders.
(7) If the engine overheated, the radiator can only be opened when the pressure drops.
§ 13
Engine spin
(1) Each motor vehicle shall have an effective start-up device in operational condition.
(2) It is forbidden to warm the engine with an open flame unless the engine is designed for it.
(3) Input of a vehicle for the purpose of putting its engine into operation in enclosed spaces and objects is permitted only at designated places and, if the conditions laid down by specific provisions are maintained. 11)
§ 14
Tyre densification, assembly and dismantling
(1) When the tyres of wheels not mounted on a vehicle with a rim fitted with a fixing and safety ring or with a split rim are inflated, the worker shall be protected by a safe cover of the approved type. If a worker makes a tyre thaw outside the garage and workshop area (for petrol pumps, during the journey, etc.), it does not need to be protected by cover, but must stand aside so that it is not threatened.
(2) It is not permitted to release the tyre by inflating it.
§ 15
Mechanisms and equipment of special vehicles
The displacement, lifting and similar mechanisms of special vehicles (road cranes, excavators, mechanical loaders, lifting platforms, ladders, etc.) shall not be activated during transport and shall be securely secured against spontaneous movement. The carrying of suspended loads on the lifting device of the road crane shall be prohibited unless otherwise specified under the technical conditions of the manufacturer.
WORKING EQUIPMENT AND MAINTENANCE
§ 16
Maintenance of vehicles
The operator shall ensure proper condition and cleanliness of the cab, bodywork, platform, ladder and handrails, if fitted with them, and ensure the removal of the resulting icing in winter.
§ 17
No flammable liquids or readily flammable substances shall be stored in the driver's cab. No articles shall be stored in or on the battery compartment.
§ 18
Working site for vehicle maintenance and repair
(1) The maintenance, inspection and repair sites of vehicles must be separated from the vehicle stationary area in accordance with specific regulations. 12)
(2) Workplaces (rooms, etc.), storerooms, sanitary facilities must be equipped and maintained in good condition in accordance with the Specific Regulations (13) and sufficiently illuminated by non-dazzling light. 14) Their floor, including the floor of pits, shall be adapted in accordance with special regulations, 15) shall not be uneven, twisted or ground. The floor at the permanent workplaces must be heat insulated. The ceiling structure and the floors shall correspond to the load of use.
(3) In the rooms where water, oil, etc., is used, the floor shall be placed in the direction of the refrigerated waste.
(4) The operator shall immediately repair damaged floor areas, restore wall and ceiling coatings as required, and clean all working areas and accessories before each shift so as not to cause dust and remove floor slippiness. Every worker must keep order and cleanliness in his workplace.
(5) The connecting and escape routes, as well as the stairs, must be marked, 16) adapted and maintained so that walking on them is safe; in particular, it shall be prohibited to store any items in such places.
(6) In the case of vehicles with a fixed movement line, depositable and removable wedges shall be placed on each vehicle unit. The keys of the previous position shall not be removed until the wedges of the following position are in the position to stop and secure the vehicle.
(7) The workplaces where the underpants of vehicles are operated shall be equipped with effective and safe lifting devices, ramps or inspection and assembly pits so that workers can stand at work. The ramps shall have guide rails adjusted to prevent the vehicle from moving sideways from the ramp. The longitudinal inclination of the ramps measured in their longitudinal axis shall not exceed 14%. The working site at a height of more than 0,60 m17) shall be provided with a fixed and safe railing at least 1,10 m high on the free edges, with a central bar and a minimum of 0,10 m high rail protection. The width between the width of the vehicle and the railing shall be at least 0,75 m.
(8) The workplaces where the combustion engines are started shall be equipped with an effective device for the perfect exhaust extraction outside the working area in accordance with specific regulations. 18)
Working pits
§ 19
(1) In the premises where the working pits are located (hereinafter referred to as "pits"), safety instructions for work in pits issued by the operator must be placed in a clearly visible place.
(2) Unused pits shall be secured by enclosures which do not prevent their permanent ventilation or shall be enclosed by a safe tilting or portable railing. The covers shall have sufficient load capacity and shall be inserted in the metal frame with selection at the surrounding floor level.
(3) In the event of a permanent immediate rotation of vehicles above the pit, the floor shall be permanently and clearly marked with a zone to which, in addition to vehicles placed in the repair or maintenance and personnel performing these work shall not enter or enter. The prohibition of entry into that zone shall be marked with clear and clearly visible warning signs, indicating the risk of slipping and falling into depth. 19) On pits for more than two vehicles, the bridges for safe passage through the pit shall be located behind each other trailer.
(4) Safe entry and exit must be ensured at all times in each pit. The pits whose length allows the addition of two or more vehicles at the same time shall have a separate safe entry and exit for each of the two imported vehicles. It is forbidden to cross and jump the pit.
(5) The depth of the pits must correspond to the types of vehicles being repaired; The pits shall have smooth walls of light colour. The surface of the walls and floors shall be easily washable and kept clean. Electrical equipment in pits shall comply with specific regulations. 20)
§ 20
(1) The pit must be equipped with:
(a) at least one socket preferably placed in a pit, covered and executed according to special regulations, 21)
(b) fixed lamps, covered and executed in accordance with specific regulations, 22)
(c) niche in the walls, located at a height which allows convenient disposal of tools at work;
(d) where the nature of the work so requires, at least once with an assembly platform adjusted so that it can be increased, as necessary, by the worker's post in a way that guarantees perfect stability at work;
(e) tables highlighting the prohibition of smoking and the use of open fire in the pit or other obligations of workers;
(f) by a receptacle (cleansing), placed at the lowest point and covered by a protective grate.
(2) The pit used shall be cleaned at least once per shift and ventilated before and after use; the pit shall be immediately cleaned and ventilated in the event of leakage of flammable substances into the pit.
(3) Only personnel designated by the senior staff shall have access to the pits for inspection, maintenance or repair of vehicles or cleaning, inspection and repair of pits.
(4) It is prohibited to:
(a) use open fires and smoke in pits or at a distance of less than 1,5 m in any direction from them; only welding on vehicles from which fuel has been released in pits is permitted, equipped with functional air-conditioning equipment under conditions laid down by specific regulations; (23) efficient exhaust systems shall also be considered as functioning air-conditioning equipment;
(b) use flammable liquids to clean vehicles standing above pits;
(c) to carry into the pits containers which contain or contain explosive substances, flammable liquids or other dangerous substances and gases, including pressure vessels and accumulators;
d) delay during work in the pit, especially at the end of the pit, parts of its cover so as to make it difficult to escape from the pit in case of danger;
(e) to stay inside the pit at the time of the vehicle's arrival and departure;
(f) dismantle on a vehicle standing above the pit parts or parts liable to compromise the safety of workers by their weight, without pre-securing against release and fall;
(g) to lay down in pits instruments and components other than to nibs intended for that purpose;
(h) release any operating fluid to the bottom of the pit.
§ 21
(1) The manager shall be required to check the status of the pit continuously and in particular to check before using any pit which has not been used for one working week and any pit in which welding works are to be carried out.
In doing so, he is obliged to check in particular the state of
(a) floors, covers, railing and warning marks;
(b) interior lighting;
(c) the purity of walls, floors and staircases of access staircases;
(d) assembly platforms and other equipment,
(e) air purity in the pit and the operability of the air-conditioning plant, if fitted;
(f) security of escape routes from the installation pit and that the pit is not cleaned with the substances referred to in Article 20 (4) (b).
(2) The manager shall be required to check continuously whether workers in pits correctly use the prescribed personal protective equipment by the operator.
§ 22
Equipment for non-mobile motor vehicles and trailers
(1) The pits and ramps on which roadworthiness checks, maintenance and repairs of non-mobile motor and trailer vehicles are carried out must be passable or must be equipped with a device enabling them to be safely introduced and unloaded.
(2) The non-passable (end) pits must be fitted with stops which can be moved according to the type of vehicles which drive over the pit.
(3) The placing and unloading of vehicles above the pit (s) and on ramp (s) by pulling or pushing persons shall be prohibited.
§ 23
Garages, storage areas and roads
(1) Specific provisions lay down how garages and storage areas must be furnished and equipped. 24)
(2) The entrances and exits of mass garages, fixed and similar spaces to which vehicles enter shall be provided on both sides with oblique colour scraping of yellow and black stripes, 25) of the same width as the vertical axis of symmetry of the entrance (exit) at an angle of 45 ° upwards, up to a height of 3 m, so that colour markings can be seen even when the doors are open. Screwing must be carried out within a distance of 0,20-0,30 m from the gate edge. The width of the coloured stripes shall be 0,14- 0,22 m. The lower parts of tilting doors to a height of 0,3 m must also be fitted with the same shrafting. The open door shall be capable of being secured against self-closing; The tilting door in the open position shall be secured against spontaneous fall.
(3) Waste saturated with oil or flammable liquids shall not be allowed to be stored or disposed of in the garage. Flammable cleaning products are only allowed to be stored in metal sealed containers. Easily flammable substances shall not be stored more than 8 m from the garage.
(4) (26) where applicable, additional fire extinguishers shall be fitted in the garage; fire extinguishers shall be tested in the manner and within the time limits laid down by specific regulations. 27) All garage workers must be trained in the use of fire extinguishers and fire extinguishers and know the fire and alarm guidelines. In the garage it is prohibited to replenish the tank of the vehicle with propellant and to start the engine heating device, the driver's compartment, or passengers, if harmful gases occur.
(5) The engine of the vehicle is allowed to run in the garage only for the purpose of an immediate exit from the garage.
(6) The garage must not be used as a space for the treatment, maintenance or repair of vehicles (except for the daily service of the vehicle before and after the journey).
(7) The maximum permissible speed of the vehicle at the premises of the organisation and at the workplaces shall be specified in the transport timetable according to local conditions but shall not exceed 30 km / h. The place of work is also the place of work carried out on roads. The competent labour safety inspector may allow an increase in the maximum speed up to 60 km / h. This adjustment shall be indicated in the transport timetable. Organisations are required to mark the specified maximum speed and, where necessary from an operational point of view, the direction of traffic signs.
(8) In open spaces, vehicles may be unloaded only if they comply with specific rules. 28)
§ 24
Battery charging stations
(1) Accumulator batteries with a total power output above 500 W or discharge voltage above 65 V are only allowed to charge and recharge in special rooms with a floor inclination towards the sink, separated and closed from other operating rooms, properly tempered and with forced ventilation of air vacuum (hereinafter "battery rooms").
(2) Electrical devices in accumulators must comply with specific regulations. 29)
(3) Each battery room shall be equipped with a cabinet containing prescribed drugs and means of first aid, the number of respirators needed, the snow extinguisher and the sink with running water and soap.
(4) Only authorised personnel may enter the battery room. The entry ban shall be indicated on the outside table on each door leading to this room.
(5) It is forbidden to eat, drink, smoke and use open fires in the battery room.
(6) The charge of battery batteries shall be prepared only in the manner specified by the manufacturer and in specially prepared containers; overdrawing is permitted only by equipment adapted so that the worker cannot come into direct contact with the corrosive agent. Workers are required to use the plexiglas label to protect the face, rubber gloves, rubber shoes and corrosive apron when working with corrosive substances; the aprons shall extend beyond the edge of the footwear.
(7) The coupling of the batteries during charging shall be made by a firmly adjacent coupling which prevents the spark. It is not permitted to connect battery terminals with wire.
(8) The operator is obliged to assign lockers for separate storage of work and walking clothes to workers who work in battery rooms.
