THE LAW
of 23 April 2014
amending Act No. 201 / 2012 Coll., on Air Protection
Parliament has decided on this law of the Czech Republic:
Čl. I
Act No. 201 / 2012 Coll., on Air Protection, is amended as follows:
1. In the third sentence of Article 11 (5), the words "for a stationary source whose" shall be replaced by "for a stationary source or infrastructure whose" are.
2. In Article 12 (1), the words "Paragraph 11 (1) and (2) shall be replaced by the words" Paragraph 11 (1) to (3) shall be replaced by the words "The Ministry, the Regional Office and the Regional Office of the Municipality with extended scope."
3. In Article 12 (3), "Article 11 (1) (b) or (2) (b) 'is replaced by" Article 11 (1) (b), (2) (b) or (3)'.
4. In Article 12 (8), the words "and infrastructure 'shall be inserted after the words" a stationary resource'.
5. In Paragraph 15 (8), the words "less than CZK 5,000 'are replaced by the words" less than CZK 50,000'.
6. In Article 17 (3) (c), the words "reporting aggregated traffic records annually 'are replaced by the words" reporting aggregated traffic records for the previous calendar year by 31 March each year'.
7. In Paragraph 20, at the end of paragraph 1, the sentence "State tangible reserves entered into free tax circulation in the tax territory of the Czech Republic shall not be included in the compulsory reduction."
8. In Paragraph 37, the sentence "Operators of combustion stationary sources as referred to in the first sentence may exchange parts of emission ceilings, unless the sum of the emission ceilings of those combustion stationary sources is increased compared to the pre-exchange situation, the exclusion of such combustion stationary sources from the transitional national plan or the emission ceiling of the combustion stationary source in the agglomeration is increased. '
9. In Paragraph 39 (1), the words "usable manufactured 'are deleted and the words" supplied for use from a stationary source' are inserted after the words "heat '.
10. In Paragraph 41, the sentence "Operators of combustion stationary sources according to the first sentence may exchange parts of emission ceilings between themselves, unless the sum of the emission ceilings of those combustion stationary sources is increased compared to the pre-exchange state, their total rated thermal input below 50 MW or the emission ceiling of the combustion stationary source in the agglomeration is increased. '
11. In Annex 4, Part B, the following point 2 is inserted after point 1:
'2. Continuous emission measurement according to point 1.1 shall not apply to combustion stationary sources with a rated thermal input of 50 MW or more whose total rated thermal input is below 100 MW and which serve as backup energy sources, and whose operating hours, determined in accordance with the procedure laid down in the implementing legislation, shall not exceed 300 hours in a given calendar year. ';
Points 2 to 5 shall be renumbered 3 to 6.
12. In Annex 10, Part I, point 2, including footnote 1, read:

1) It refers to dry flue gas, 273,1 K, a pressure of 101,325 kPa and a reference oxygen content of 3% for boilers, 5% for piston combustion engines and 15% for gas turbines. '
Čl. II
Transitional provision
For 2013, the operator of the stationary source is obliged to declare by 30 June 2014 the aggregated traffic records provided for in Article 17 (3) (c) of Act No 201 / 2012 Coll., as effective from the date of entry into force of this Act.
Čl. III
Efficacy
That law shall take effect on the first day of the calendar month following its publication.
