DECLARATION
Ministry of Agriculture
of 11 April 1997
defining the species of plants and the conditions under which their propagating material may be put into circulation as commercial, characteristics and control material by the end of 1997
According to Article 32 (1) of Act No. 92 / 1996 Coll., on Varieties, Seeds and Propagating Plants, hereinafter referred to as "the Act", the Ministry of Agriculture provides:
The species of plants whose propagating material may be put into circulation as commercial in 1997, hereinafter referred to as "plant species', are spring wheat, barley, oats, clover, reptile, lucerne, peas, pellet and vines.
The propagating material of the plant species referred to in § 1 shall not have a germination capacity lower than:
78% for spring wheat,
78% for spring barley,
75% for oats,
60% for meadow clover,
60% for reptiles,
60% for alfalfa,
70% for peas,
70% for the pellet.
The propagating material of spring wheat, spring barley and oats put into circulation as commercial must have a moisture content of less than 17%; the propagating material of meadow clover, reptile clover and lucerne must have a moisture content of less than 15%.
The propagating material of the plant species referred to in Section 1 may contain the ingredients of other cultural species in a maximum quantity of 0,5%.
In the case of vine seedlings, the length of matured aeroplanes shall be at least 10 cm.
The propagating material of the plant species referred to in Section 1 shall:
(a) be made from seed crops recognised under Article 22 (4) of the Act and be marked with the name of the variety. In the case of reptile clover, meadow clover and lucerne clover, it may only be produced from crops where the origin of the propagating material is known,
(b) comply with the requirements laid down for certified seed or seed of those species in accordance with a specific Regulation, (1) unless otherwise specified in this Decree;
(c) bear a mark from which it is clear to the purchaser that the material is commercial propagating material under this decree.
Propagating material of reptile clover, meadow clover and lucerne from importation may be put into circulation as commercial subject to the conditions laid down in Sections 1 to 4 and 6 (b) and (c), provided that the quality of the imported propagating material is demonstrated by the International Seed Testing Association (ISTA) certificate and a control sample has been taken.
Checks on the characteristics of commercial propagating material shall be carried out in the same way as checking on the characteristics of certified propagating material of those species.
This decree shall take effect on the day of its publication.
