Decree of the Ministry of Agriculture, Forestry and Water on the sale of certain agricultural products to employees of state goods and other state organisations with agricultural production

of 9 December 1963
on the divestment of certain agricultural products to employees of State goods and other state organisations with agricultural production
The Ministry of Agriculture, Forestry and Water Management, in agreement with the participating ministries and with the Central Council of Trade Unions, provides for the legal measure of the Bureau of the National Assembly No 84 / 1963 Coll., on the National Labour Commission and pursuant to Section 18 of Act No 66 / 1961 Coll., on veterinary care:
§ 1
Scope
(1) State goods controlled by production agricultural administrations and other state-owned organisations with agricultural production (hereinafter referred to as "agricultural holdings") may, in accordance with Article 2 to 6 of this Decree, sell agricultural products to their own producers solely for their own use at their request,
1. at the prices referred to in § 7 (1) and (2)
(a) workers in plant and animal production;
(b) repairers, handlers and other auxiliary personnel, including construction groups and sections;
(c) technical operators of the economy and of production groups or other operating units which are organised by the economy or production groups;
where they are not remunerated under uniform national arrangements;
2.
(a) other technical operators;
(b) workers of industrial and ancillary production centres;
(c) members of racing guards, guards and doormen,
(d) workers of canteen and canteen;
(e) drivers and drivers of road motor vehicles;
(f) workers who are remunerated under uniform national arrangements.
(2) Drivers and drivers of other undertakings temporarily carrying out the autumn transport of sugar beet, potatoes and other agricultural products on the holding may sell the holding for one working day of the grain referred to in Article 3 (4).
(3) Apprentices and students of secondary and higher education institutions who carry out the prescribed practice in the course of their studies may sell milk to the farm in accordance with Section 6.
(4) Participants to organised brigades from establishments and businesses are excluded from the sale of agricultural products.
§ 2
In kind
(1) The agricultural holding sells cereals and potatoes from the turnip fund.
(2) The planned fund in kind is determined by multiplying the planned number of workers (Section 1 (1)), the basic quantity of cereals and potatoes per worker when the production plan is fulfilled.
(3) The basic quantity, if the cereal and potato production plan is complied with, per worker, is 400 kg per year and 240 kg of potatoes. For farms which do not plan to produce potatoes and do not grow potatoes, the basic quantity of cereals shall be increased to 460 kg.
(4) In the event of failure to meet the planned production of cereals and potatoes, the basic quantity referred to in paragraph 3 shall be reduced by 12 kg for cereals for each 1% of their planned production and 7 kg for potatoes for each 1% of their planned production.
(5) If the cereal and potato production plan is exceeded, the holding may sell one third of the quantity produced above the plan to its workers (Section 1 (1)), the total quantity of cereals and potatoes sold out not exceeding 130% of the planned fund in kind.
(6) In the event of non-compliance with the plan for the production of cereals and potatoes (natural disasters, etc.), the holding may, with the agreement of its immediately superior authority, sell to grain workers and potatoes, with a maximum of 70% of their basic quantities (paragraph 3).
(7) The agricultural holding shall include in the planned fund in kind the planned yields of rye, wheat, barley, oats, both from pure crops and cereal mixtures per grain, and total maize and potatoes. The management of the holding shall decide on the representation of the different types of cereals in the actual fund in kind after consultation with the race committee of the Revolutionary Trade Union Movement.
(8) For the purpose of determining the planned and actual fund in kind, a plan for the production and performance of cereals and potatoes of the whole undertaking shall be responsible for the state goods managed by production management and for those agricultural organisations which are organised in a similar manner as the said state goods. For other holdings, the competent central authority shall decide whether the establishment of the planned and actual fund in kind shall be carried out for the whole undertaking or for its individual units after consultation with the central committee of the relevant trade union.
§ 3
Breakdown of the fund in kind
(1) The quantity of cereals and potatoes to be sold to individual workers of the fund in kind pursuant to Article 2 shall be determined by the manager of the holding in agreement with the race committee of the basic organization of the Revolutionary Trade Union Movement. In doing so, it shall take into account how individual workers perform their tasks, how they have deserved to achieve production results; take into account, in particular, the merits of those who work in progressive forms, are the best workers and winners in the socialist competition.
(2) An individual worker referred to in Paragraph 1 (1) (1) may be disposed of on completion and overrun of the planned production of cereals and potatoes each year not more than 600 kg of cereals and 360 kg of potatoes. Where two members of the same family are working on the holding and are granted disposal, they may be disposed of together on completion and exceeding of a production plan of not more than 900 kg of cereals and 500 kg of potatoes. Where there are three or more members of the same family working on the holding, they may all be disposed of at most 1200 kg of cereals and 600 kg of potatoes when the production plan has been completed and exceeded. However, if a worker in crop production who has entered into a contract with an agricultural holding for only a limited period of time to carry out seasonal field work, the holding may sell him cereals or potatoes in quantities corresponding to the size and importance of the work carried out; the products sold out shall not exceed the above maximum quantities. The provisions of this paragraph shall apply to workers referred to in Paragraph 1 (1) (1), even after they have started to be remunerated under uniform national arrangements; However, these agricultural products are also sold to them at the prices mentioned in Section 7 (3).
(3) A maximum of 450 kg of cereals and 270 kg of potatoes may be sold to the individual worker referred to in Article 1 (1) (2) on completion and overrun of the production plan for cereals and potatoes per year. Where two members of the same family are working on the holding who are granted disposal, they may be disposed of together at a maximum of 700 kg of cereals and 400 kg of potatoes if the production plan is exceeded and exceeded. Where there are three or more members of the same family working on the holding, they may all be disposed of at most 900 kg of cereals and 500 kg of potatoes when the production plan has been completed and exceeded.
(4) Drivers and drivers referred to in Article 1 (2) may sell off a maximum of 2 kg of cereals per working day.
(5) The head of the holding may, in agreement with the race committee of the basic organization of the Revolutionary Trade Union Movement and taking into account the estimate of the harvest, allow the advance sale of cereals or potatoes, where appropriate, up to a maximum of 50% of the basic quantity referred to in Article 2 (3).
(6) The head of the holding may, in agreement with the Race Committee of the Revolutionary Trade Union Movement, allow the replacement of cereals for potatoes or potatoes for cereals in proportion to 100 kg potatoes per 25 kg cereal, taking into account the results of the harvest.
(7) Farmers who do not plan the production of potatoes and do not grow potatoes may sell cereals (including grain maize) instead, in the proportion referred to in paragraph 6.
§ 4
Sale of piglets
(1) At their request, the agricultural holding may sell back to the workers referred to in Article 1 (1) one pig per year from the surplus of piglets after the planned arrest has been completed.
(2) Where two members of the same family are working on the holding, the holding may sell them only one pig under the conditions laid down in paragraph 1 if three or more members of the same family are working on the holding, the holding may sell them no more than two piglets.
(3) The number of piglets to be sold pursuant to paragraphs 1 and 2 shall be decided by the head of the holding in agreement with the race committee of the basic organization of the Revolutionary Trade Union Movement.
§ 5
Sale of agricultural products to pigs in large-scale food stores
(1) Pigs and other workers (Section 1 (1)) in large farms or other places of work (hereinafter referred to as "large farms") which are prohibited from keeping pigs under veterinary legislation may be sold annually instead of piglets, cereals and potatoes by a pig with a maximum live weight of 140 kg. Paragraph 4 (2) and (3) shall apply mutatis mutandis to the sale of fattening pigs.
(2) The Grand Feedingstuffs to which the provisions of paragraph 1 apply are determined by the Ministry of Agriculture, Forestry and Water.
§ 6
Sale of milk
(1) An agricultural holding may sell back 1 / 2 litre of milk and 1 / 2 litre of milk to the workers referred to in Paragraph 1 (1) per day for each child under 15 years of age who is living in a common household and on whom family allowances are payable.
(2) An agricultural holding may sell back 1 / 2 litre of milk for each working day to workers in crop production who enter into a contract with the holding only for a limited period of time to carry out the seasonal field work and apprentices and students referred to in § 1 (3) daily 1 / 2 litre of milk.
(3) In the absence of a milk purchase plan, the head of the farm may reduce the milk levies referred to in paragraphs 1 and 2 for persons over 18.
§ 7
Common provisions concerning Sections 2 to 6
(1) The agricultural holding shall sell to the workers referred to in § 1 (1) No 1 and to the apprentices and students referred to in § 1 (3) agricultural products referred to in § 2 to 6 at the following prices:

In order to determine the price of milk, the operating unit of the holding (farm, production group, etc.) in the preceding quarter is the decisive implementation of the milk production plan.
In order to determine the price of milk when it is sold to non-dairy workers, the full farm is responsible for the implementation of the milk production plan.
(a) If the operating unit or the whole holding, a quarterly milk production plan, has been completed, the workers will be sold milk for a price of 1,12 per litre in the next quarter.
(b) If the operating unit or farm, the quarterly milk production plan, has not been complied with, the workers will be sold milk in the next quarter at the retail price of legalised milk.
(2) In order to determine the price of fattening pigs, the implementation of the plan for the purchase of pigmeat is decisive.
(a) If a large feed has been completed on the annual plan for the purchase of pigmeat, fattened pigs will be sold to workers at a price of CZK 10,80 per kg live weight.
(b) If the bulk feed has failed to comply with the annual plan for the purchase of pigmeat, fattened pigs will be sold to workers at the price of Kčs 15, - 1 kg live weight.
(3) The agricultural holding shall sell to the workers referred to in § 1 (1) (2) and to drivers and drivers referred to in § 1 (2) of the agricultural products referred to in § 2 to 6 at the following prices:

(4) Workers who themselves manage land that can be used for the cultivation of agricultural crops are obliged to reduce or refuse the extent of the sale of agricultural products in proportion to the area and the bonality of the land being cultivated. The highest area of land where the sale of agricultural products may not be reduced shall be:

With a higher agricultural area, sales are reduced by at least 30%. The sales of agricultural products shall not be made at an area above 30 ars. However, the head of the agricultural establishment may exceptionally authorise the sale of a reduced quantity of agricultural products in the potato-oat and mountain areas, provided that the area of agricultural land does not exceed 0,5 ha.
The provisions of this paragraph may also apply where such land is managed by members of the family of workers.
(5) The agricultural holding shall, in agreement with the race committee of the basic organization of the Revolutionary Trade Union Movement, ensure, in particular, the conclusion of contracts of employment, that workers do not hold more livestock than they can feed from sold or produced agricultural products.
(6) The manager of the holding is obliged to keep proper records of the sale of agricultural products on the prescribed forms (Annex 1 and Annex 2). The lists of workers, indicating the quantities of agricultural products sold to them, must be published before they are sold to the workplace.
§ 8
Sales of fruit, vegetables and poultry
(1) An agricultural holding may sell back to all workers of the holding for their own use an adequate quantity of fruit and vegetables at purchase prices after completion of the planned task in purchasing the species concerned.
(2) An agricultural holding may also sell back to its personnel poultry not complying with the quality conditions (non-standard) which the purchasing organisation refused to take over at the price determined by the holding.
§ 8a
Sale of sheep
A sheep-keeping farm may sell off to its workers at the purchase price of a ram and a sheep of junk.
§ 9
Sale of marc wine
(1) Farmers who grow vines and are entitled to produce wine may, in the case of particularly strenuous work in vineyards, issue free of charge grape marc wine for a maximum of 50 litres per worker per year.
(2) All its workers may, at their request, sell 50 litres of marc wine annually at a price equal to their own costs plus turnover tax. Other persons, undertakings, organisations and establishments shall not be disposed of or otherwise disposed of with grape marc.
§ 10
Sales of products to public fishing workers
(1) National fisheries undertakings and establishments, including school fisheries in Aquatic waters, which hold and process fish and poultry may sell to all workers fish and poultry which do not comply with the quality conditions (non-standard) which the purchasing organisation has refused to take over.
(2) State fisheries may sell the products to the following workers:
workers in fish and poultry farming,
repairers, handlers and workers in other auxiliary operations,
technical staff of enterprises and establishments of state fisheries,
to the total price of Kčs 210, - per year to one worker.
Other workers up to the total price of Kčs 70 per year.
(3) State fishing shall sell fish at purchase prices and poultry which do not comply with quality conditions (non-standard) and which the purchasing organisation has refused to take over at a price determined by the state fishing industry.
Final provisions
§ 11
(1) Agricultural products sold out under this decree are not subject to the provisions on the sale of surplus agricultural products. *)
(2) Milk sold under this decree must come from healthy cows and must be overcooked before use. Paragraph 30 (2) of Decree of the Ministry of Agriculture, Forestry and Water No 154 / 1961 Coll., implementing the provisions of the Veterinary Care Act, does not apply to this milk.
§ 12
Decree No 51 / 1958 of the Ministry of Agriculture, Forestry and Water Management of the Ministry of Agriculture and Rural Development No 51 / 1958 of the Ú. l., on the sale of certain agricultural products to employees of state goods and other agricultural plants of the State Socialist sector, and the guidelines published for its implementation in the Bulletin of MZLVH in amounts No 20 / 1958, No 3 / 1961, No 47 and 48 / 1962 and No 49 / 1962 are hereby repealed.
§ 13
This Decree shall take effect on 1 January 1964.

*) Paragraph 3 (2) of the Decree of the Central Administration of the Purchase of Agricultural Products No 47 / 1963 Coll., on the purchase of agricultural surpluses from small agricultural users and on the sale of surplus agricultural products.
