of 23 April 2014
amending Act No. 198 / 2002 Coll., on Voluntary Service and on the Amendment of Certain Acts (Act on Voluntary Service), as amended
Parliament has decided on this law of the Czech Republic:
Act No. 198 / 2002 Coll., on Voluntary Service and on the amendment of certain laws (Act on Voluntary Service), as amended by Act No. 436 / 2004 Coll., Act No. 495 / 2005 Coll., Act No. 420 / 2011 Coll., Act No. 458 / 2011 Coll., Legislative measure of the Senate No. 340 / 2013 Coll., Legislative measure of the Senate No. 344 / 2013 Coll. and Act No. 64 / 2014 Coll., is amended as follows:
1. footnote 1 is deleted, including the footnote reference.
2. In Paragraph 3 (4), the words "or civil services' are deleted.
3. In Article 3, the following paragraph 5 is added:
"(5) A member of a social cooperative may not volunteer for the needs of the social cooperative of which he is a member."
4. In Article 4 (1), the words "public service 'shall be inserted after the words" public service'.
5. In Paragraph 4 (2), the word "person 'is replaced by the words" natural person or public-interest legal person'.
6. In Article 4 (3), the second sentence is replaced by the following: "The condition is that a volunteer performs a voluntary service outside his / her obligations arising from his / her membership with the sending organisation and has no other legal relationship with it."
7. In Article 4, the following paragraph 4 is added:
"(4) The sending organisation shall demonstrate its public utility by means of a written declaration that it fulfils the conditions set out in Section 146 of the Civil Code. '.
8. In Article 5, the following paragraph 5 is inserted after paragraph 4:
"(5) The sending organisation shall, upon request, issue a certificate to the volunteer for a long-term volunteer service, a model of which is set out in the Annex to this Act. ';
Paragraph 5 shall become paragraph 6.
9. In Article 5 (6), the words ", pocket money" and the words "and the provisions on travel refunds shall apply mutatis mutandis when the amount of the allowance is agreed 'are deleted.
10. In the first sentence of Article 6 (2), the words "civil society 'are replaced by the words" association, foundation, foundation, institution, social cooperative' and in the second sentence, "3 'is replaced by" 4'.
11. in Article 6, the following paragraph 5 is added:
"(5) The sending organisation shall inform the Ministry of the change in the facts relevant to the accreditation which took place during the validity of the accreditation within 1 month of the date on which it became aware of the change. ';
12. in Article 8 (2), the words "the business of which is" shall be replaced by the words "to such activities as a volunteer would carry out in the course of the business of the receiving organisation."
13. In Article 10, the first sentence is replaced by the following: "The State authorities, the state bodies, the authorities and the bodies of the local authorities, the state contribution organisations, the local authorities' contribution organisations and the educational legal persons may use the voluntary service for the purposes and under the conditions laid down in Article 2; in this case they shall have the status of beneficiary organisation under this law."
14. the following Annex to the Act is added:
"Attachment to Act No. 198 / 2002 Coll.

"
Efficacy
This Act shall take effect on the 15th day following its publication.
