Decree of the Slovak Labour Safety Authority on checks, revisions and tests of gas installations

on checks, revisions and tests on gas installations
The Slovak Labour Safety Authority provides, pursuant to § 5 (1) (d) of Act No. 174 / 1968 Coll., on State Professional Safety Supervision, in agreement with the Slovak Trade Union Council and other central bodies:

INTRODUCTORY PROVISIONS
§ 1
Scope
(1) The Decree applies to organisations producing, assembling, operating, repairing, maintaining, or revising gas equipment (hereinafter referred to as "equipment").
(2) For the purposes of this Decree, equipment subject to state professional occupational safety oversight, carried out by the Slovak Labour Safety Authority and labour safety inspectors, shall be considered as an installation for:
(a) gas production and treatment;
(b) storage and transport of gases;
(c) filling of vessels with gases, including pressure stations;
(d) liquefaction and evaporation of gases;
(e) increasing and reducing gas pressure;
(f) gas distribution;
(g) gas consumption by combustion.
(3) Equipment which is in the personal use of apartment users and non-residential rooms shall not be considered as equipment referred to in paragraph 2.
(4) Substances with a critical temperature of less than 50 ° C or substances with an absolute vapour pressure (tension) of more than 0,3 MPa (3 kPa / cm2) at 50 ° C shall be considered gases for the purposes of this Decree.
§ 2
General provisions
(1) By carrying out revisions (§ 4) or examinations (§ 9), the establishment shall entrust the organisation of the worker with a certificate of professional competence for this activity ("revision technician"). This certificate (2) shall be issued by the Safety Officer (3) (hereinafter referred to as the "Inspectorate ') responsible for the place of work of the authorised officer.
(2) An organisation may ensure that revisions or tests of an installation are carried out through another organisation which has a right to such activity (4), issued by the inspector.

CHECKS, REVISES AND EQUIPMENT TESTS
§ 3
Control of equipment
(1) Control of equipment is an assessment of whether the condition of the equipment operated complies with the requirements of safety of work and technical equipment and fire protection.
(2) The inspection shall be carried out by an organisation of a worker who has proven to control the safety regulations for the operation of the controlled equipment, the safety regulations related, the fire rules and the alarm directive, and who is trained in the operation of the equipment.
(3) The check of the equipment shall be carried out by the authorised staff member on an alert in an operational log containing:
(a) the name and surname of the official who carried out the check;
(b) date of inspection;
(c) the scope of the check;
(d) the defects identified and the proposals for their removal;
(e) the signature of the official who carried out the check.
(4) The inspection shall be carried out annually; where the technical condition of the equipment or the operational experience requires more frequent checks, the management shall order the organisation to implement it at shorter intervals.
§ 4
Equipment revision
(1) Revision of equipment is initial (§ 6) and operational (§ 8); they shall mean the overall assessment of the equipment at which the operational safety and reliability of the equipment or parts thereof shall be established by inspection, testing or measurement, as appropriate, and the technical documentation and professional competence of the operator.
(2) Where electrical, pressure, lifting or other equipment is included in the equipment, it shall be checked when the whole equipment is being revised whether such equipment has undergone a revision in accordance with specific regulations. 5) A record shall be made of this in the revision report.
(3) In order to carry out the revisions, the organisation operating the installation shall draw up a revision schedule for at least three years and adjust it according to the operational experience and technical condition of the installation.
(4) In justified cases, the inspector may provide for an extraordinary revision.
§ 5
Preparation of equipment revision
Prior to the start of the revision of the equipment, the organisation shall prepare the equipment for the revision and in particular:
(a) ensure, where necessary, a reliable disconnection of the equipment from the power supply to prevent the possibility of accidents and accidents;
(b) degasifying the equipment or gases in the installation into a state of inert atmosphere (inertization), 6) or, if necessary, providing a breathable and safe atmosphere in the installation;
(c) carry out the necessary measurements in places where the health or life of persons or property is likely to be at risk and, according to the result of the measurement, determine and implement the necessary measures;
(d) implement, in accordance with local conditions, to the extent necessary, fire-fighting measures in accordance with general regulations, 7)
(e) ensure the necessary number of qualified personnel and provide them with the necessary tools, instruments and personal protective equipment;
(f) ensure breathing and reviving technology, if necessary, and if the technological process so requires, gas or rescue services.
§ 6
Default revisions
(1) On each installation, the supplier organisation shall ensure that the initial revision and preparation of the revision report included in the supply of the installation are carried out before the installation is put into service.
(2) The equipment must not be put into service unless defects which make safe and reliable operation impossible and are indicated in the initial revision report are removed.
(3) The initial revision shall examine in particular:
(a) the completeness and accuracy of the technical documentation of the installation;
(b) whether the prescribed tests have been carried out on the equipment and the accuracy and completeness of the test documents;
(c) whether the equipment complies with the rules and requirements of safety of work and technical equipment and fire protection;
(d) that the equipment is equipped with prescribed measuring, control and safety devices;
e) quality of assembly work (results of non-destructive tests of welds, etc.),
(f) whether the assembly work has been carried out by personnel with prescribed competence;
(g) quality of installation documentation (material quality, fittings, welds, etc.),
(h) whether a revision has also been carried out on electrical, pressure, lifting or other equipment if they are part of the revised equipment;
(ch) other circumstances relevant to the safety and reliability of operations and fire protection required by the technological process.
§ 7
Operational revisions
(1) On facilities in operation, organisations are required to ensure that operational revisions are carried out.
(2) Operational revisions shall be carried out in particular after completion of the test operation, after overhaul, after interference affecting the safety and reliability of the operation, after forced shutdown of the equipment, after shutdown of the equipment for a period of more than 6 months and in cases specified by the specific Regulation (8) in accordance with the instructions of the manufacturer (supplier) of the equipment.
(3) The operational revision shall in particular examine:
(a) changes in the condition of the installation since the last revision, whether the installation has been shut down for more than 6 months and whether it has experienced failures or other deficiencies in operation;
(b) documentation of the checks and tests carried out on the equipment;
(c) completeness and accuracy of the operational technical documentation;
(d) the functions of the signalling, control, measuring and control devices, including the testing of simulated fault states;
(e) the function of towing systems, ventilation, suction and the overall function of the installation;
(f) tightness of the device;
(g) firefighting equipment, personal protective equipment, breathing and reviving equipment;
(h) the state of the workplace, the equipment of the workplace by means of safety signs and tables, the occurrence of effects which make it difficult for the operator and cause excessive overload of the equipment;
(i) whether the operator meets the prescribed requirements of competence;
(j) completeness and accuracy of the operating rules and operating instructions;
(k) other circumstances relevant to the safety and reliability of operations and fire protection required by the technological process.
§ 8
Review report
A revision report shall be prepared on the outcome of the revision by the revision technician, which shall include:
(a) the name and registered office of the organisation with the precise operation designation in which the revision was carried out;
(b) the date of the revision, the name and surname of the inspection technician and the registration number of his certificate;
(c) type of revision (operational, default);
(d) the designation, type and technical value of the revised installation;
(e) the measurement and testing of the equipment carried out, including the production or registration numbers of the measuring instruments used;
(f) defects and deficiencies detected, their severity in terms of safety and reliability of the operation of the installation;
(g) draft measures and deadlines to address the deficiencies identified;
(h) details of whether and how the defects identified during the previous revision or, where appropriate, during the inspection of the equipment have been corrected;
(i) an overall assessment of the revised equipment in terms of safety and operational capability and fire protection;
(j) signature and stamp of the inspection technician;
(k) where the review has been carried out by the approved organisation, its name and approval number.
§ 9
Equipment test
(1) The test of the equipment shall be carried out on completion of the installation or reconstruction with regard to whether it complies with the regulations and requirements of safety of work and technical equipment, fire protection and design technical values. The installation test shall be carried out by the organisation which has performed the installation or reconstruction of the equipment.
(2) Prior to the start of the installation test, the revision technician responsible for carrying it out shall, on the basis of the design documentation of the installation, develop a technological test procedure containing in particular:
(a) the extent of the test and a detailed description of the operations carried out during the test;
(b) the necessary measures for the safe conduct of the test;
(c) the conditions under which the test is recognised to be successful.
(3) If the test of the device has not been successful, it shall be repeated after the defects detected have been corrected.
§ 10
Preparation of equipment test
Before starting the test, the organisation shall carry out the measures referred to in Article 5 and shall ensure:
(a) the identification and the clear marking of the safety zone according to the requirements of the installation project where the tests exceed operating values or artificially create emergency situations, or where the equipment is overloaded in the short term;
(b) in the cases referred to in (a), do not delay in the security zone during the test;
(c) that the personnel responsible for carrying out the test stay in a safe place established by the technological procedure during the test;
(d) that the measuring and control devices used during the test are placed in a safe place;
(e) the connection lines and pressure vessels needed to carry out the test shall be tested in advance for a specified test pressure;
(f) to ensure that the main measuring instruments are correct in accordance with specific rules. 9)

REVIEW TECHNICAL
§ 11
Professional competence
(1) The organisation is required to report to the Inspectorate for the examination of professional competence to the staff to whom it intends to entrust revisions or tests of equipment.
(2) A worker who has applied for a proficiency check must be medical10) and must:
(a) have a technical degree and at least one year of professional experience; or
(b) have full secondary technical training and at least three years of professional experience; or
(c) be taught in the relevant field and have at least 10 years of experience; in this case, however, the worker may only be responsible for testing the equipment.
(3) The application for a proficiency check must include:
(a) the name and surname of the worker;
(b) details of the training and duration of professional experience of the worker;
(c) a description of the type and scope of the certificate requested and an indication of the equipment to be revised or tested by the worker;
(d) the type of work and the place of work of the worker;
(e) the name and registered office of the organisation, the stamp and the signature of the head of organisation.
(4) The date and place of examination shall be communicated by the inspector to the organisation at least 30 days in advance.
(5) When checking professional competence, the inspector shall check the worker's inspector from the knowledge of the rules on safety of work and technical equipment and from the theoretical knowledge of the field of gas equipment, taking into account the type and scope of the certificate required.
(6) Where an organisation requests an extension of the scope of the certificate, the inspector shall examine the professional competence of the worker by checking in accordance with paragraph 5 and issue him a new certificate. An application for extension of the scope of the certificate shall be accompanied by an existing worker certificate.
§ 12
Certification
(1) On the basis of the successful examination referred to in Article 11 (5), the inspector shall issue the inspector within 30 days of the examination of the certificate in which he shall indicate the type and extent of professional competence acquired.
(2) The type of certificate shall be determined by the type of establishment referred to in Paragraph 1 (2).
(3) An inspection technician carrying out revisions or tests of an installation contrary to this Regulation or to the rules for ensuring safety of work and technical equipment may withdraw or restrict the scope of the certificate.
§ 13
Obligations of the revision technique
(1) The Revision Technique responsible for the revision of the installation shall in particular:
(a) carry out inspections of the establishment within the scope of its certificate;
(b) develop a technological revision process;
(c) prepare a revision report on the outcome of the revision;
(d) if the establishment directly threatens the life and health of workers or property, propose immediately the decommissioning of the establishment;
(e) on the basis of the outcome of the revision, propose measures to address identified defects and deficiencies;
(f) cooperate in the training of personnel operating equipment and participate in their examination.
(2) The Revision Technique responsible for carrying out the test shall in particular:
(a) carry out tests on equipment within the scope of its certificate;
(b) develop a technological test procedure (Section 9 (2));
(c) in the framework of the mandate of the organisation to manage the preparatory work for the test of the equipment and to check whether the applicable regulations, technical standards and technological procedures are complied with during the test;
(d) make a record of the result of the examination;
(e) on the basis of the test result, recommend the putting into service of the equipment.

TRANSITIONAL AND FINAL PROVISIONS
§ 14
In the case of equipment put into service before the effective date of this decree, the organisation shall carry out the first operational revision within one year of the effective date of that decree.
§ 15
Exemptions from the provisions of Paragraph 11 (2) may be authorised by the Slovak Labour Safety Authority at the request of the organisation if there are serious reasons for doing so and if the inspector recommends it.
§ 16
This Decree shall take effect on 1 January 1979.
