State Arbitration of the Czechoslovak Socialist Republic
of 13 September 1974
on the transitional arrangements for certain provisions on economic commitments in the external trade sector
The State Arbitration of the Czechoslovak Socialist Republic in the Agreement with the Federal Ministry of Foreign Trade and the Federal Ministry of Finance provides, pursuant to § 395 (b) of Economic Code No. 109 / 1964 Coll. in the full version published under No. 37 / 1971 Coll. (hereinafter referred to as "the Act"):
(1) This decree regulates certain provisions on economic commitments involving CENTROTEX, a public limited company in Prague, KOOSPOL, a public limited company in Prague, KOVO, an undertaking in foreign trade in Prague and MOTOKOV, an undertaking in foreign trade in Prague ("the organisation of foreign trade ').
(2) To the extent provided for in Section 5, this Decree also provides for certain provisions on economic commitments involving TUZEX, a foreign trade undertaking in Prague.
(1) Property penalties for non-compliance with an obligation, or other legal obligations of foreign trade organisations provided for by law or implementing act, shall be lifted where the right to an approved organisation arises between 15 August 1974 and 30 April 1975. However, the penalty payment for late delivery (1) for economic supply contracts from imports concluded from 1 November 1974 shall not be cancelled.
(2) The organisation of foreign trade does not have to charge or enforce property penalties for which they have a right under the law or implementing regulation between 15 August 1974 and 31 October 1974; if in this case the foreign trade organisation does not charge and enforce the property penalty, unpaid property penalties for damages shall not be taken into account.
(1) The deadline for the complaint by the foreign trade organisation based on the timely report of the foreign customer on delivery defects, (2) which starts to run between 30 July 1974 and 31 March 1975, is extended to 30 days, with the fact that for the reports of the foreign customer on delivery defects received by the foreign trade organisation until 14 August 1974, it will only start to run on the date of delivery of the urgency of the foreign customer.
(2) The deadline for the dispatch of the complaint by the foreign trade organisation (3) is extended by a further 6 months, unless otherwise it would have expired by 31 October 1974 at the latest.
Foreign trade organisations may apply by 30 April 1975 at the latest
(a) liability rights, (4) which would otherwise expire between 2 August 1974 and 2 April 1975,
(b) rights with respect to the carrier in respect of economic arbitrage, (5) which would otherwise have died no later than 31 March 1975;
(c) rights to property sanctions (not for property sanctions which are part of liability rights), 6) which would otherwise have expired between 2 August 1974 and 2 April 1975,
(d) rights other than those referred to in points (a) to (c), (7) which would otherwise have expired not later than 2 January 1975.
Paragraph 2 also applies to TUZEX, a foreign trade firm in Prague if it is obliged to pay or charge and enforce the property penalties provided for in the rules on invoicing and payment.
This decree shall take effect on the day of its publication.
