Ordinance on the Management of the Development of the Technical Gas Sector

DECLARATION
Ministry of Chemical Industry
of 2 June 1960
on the management of the development of the technical gas sector
The Ministry of Chemical Industry, in agreement with the participating ministries (central offices and authorities) and the main arbiter of the Czechoslovak Republic, provides pursuant to § § 1 to 4 of Decree No. 109 / 1945 Coll., on production management:
§ 1
(1) Securing the planned management of the development of the technical gas sector in line with the tasks of the forward development plan for the national economy and ensuring the economical and efficient supply of technical gases to a national scale requires coordination of production and construction in the field of technical gases and uniform national management of their sales.
(2) To this end, the national company Technogas Praha is entrusted with the pursuit of a branch gesture for the field of production of technical gases and with the implementation of balance sheet and sales.
§ 2
In particular, to carry out these tasks, the national undertaking Technogas
(a) obtain and promote and coordinate, in accordance with them, the appropriate development of resources for drawing up comprehensive summaries of the long-term national economic needs of technical gases;
(b) draft long-term national plans for the prospective development of the field of technical gases, in particular forward-looking investment plans, in cooperation with other organisations that produce or will produce technical gases;
(c) propose, in cooperation with the participating organisations, the use and, where appropriate, the extension of existing production facilities, the deployment and scope of new capacities or the elimination of non-compliant production; taking into account the profitability of transport and production;
(d) carry out the tasks arising from the implementation of the balance sheet and sales gesture, in particular compiling national balance sheets of technical gas needs and resources, organising, methodically managing and disposing of technical gases from all sources within the territory of the Czechoslovak Republic;
(e) propose guidelines for the technical development of the production, transport and storage of technical gases, coordinate such developments to ensure the maximum efficiency of investments in the production, transport and storage of technical gases; to this end, submit to the competent authorities and organisations draft standards, characterisation and safety regulations for the production, transport and storage facilities of the sector and participate in their implementation;
(f) apply to manufacturers compliance with the quality requirements for the supply of technical gases, for the supply of gases used for health and similar purposes and for their health.
§ 3
(1) The relations of other organisations producing technical gases (hereinafter referred to as "other producers") with the national undertaking Technogas in the execution of the purchase and disposal of technical gases are regulated by contracts.
(2) Other producers are obliged to:
(a) cooperate with the national undertaking Technogas to fulfil the tasks arising from the provisions of Section 2 of this Order; In particular, they shall be obliged to provide him with the necessary evidence of the production of technical gases and to inform him of the intended construction of new or cancellation of existing production facilities and production facilities for technical gases;
(b) discuss proposals for the development of the technical gas sector with the National Institute of Technology, in particular proposals for the construction of new capacities, proposals for the production of technical gases intended for the supply of the national economy, as well as any changes that may arise for any reason and which could have an impact on the continuous supply of technical gases;
(c) conclude contracts for the supply of technical gases intended for the supply of the national economy with the national undertaking Technogas, or deliver them according to its instructions and on its behalf to consumers and to the stores of the national undertaking Technogas; *)
(d) to contribute 10% of the wholesale price of the technical gases they supply to the national steel bottle maintenance undertaking. * *)
§ 4
When purchasing and disposing of technical gases, the national undertaking Technogas shall:
(a) negotiate with other producers technical gas supply contracts or, where appropriate, capacity contracts; to negotiate such contracts in particular in connection with the construction of new production or the extension of existing production;
(b) to order other manufacturers to supply technical gases directly to consumers or to warehouses of the national undertaking Technogas.
§ 5
The following shall be regarded as technical gases under this Decree: Technical oxygen, Medical oxygen, Liquid oxygen, Liquid acetylene dissolved technical (dissous gas), Compressed air, Liquid air, Technical nitrogen, Oxygen free, Carbon dioxide liquid, Carbon dioxide solid (dry ice), Mixture of Oxygen and Carbon Oxygen and Technical Hydrogen.
§ 6
The provisions of Sections 2 (d), 3 (1) and 2 (c) and 4 shall not apply to technical gases intended for the self-consumption of producers; Articles 3 (1) and 2 (c) and (d) and 4 shall not apply to technical gases intended for export.
§ 7
The Ministry of Chemical Industry authorises the National Technology Company to authorise exemptions from the provisions of Section 3 of this Decree in its field of competence in justified cases.
§ 8
The Decree of the Ministry of Chemical Industry No 143 / 1958 of the Ú. l on the arrangements for the supply and collection of certain technical gases is repealed.
§ 9
This Decree shall take effect from 1 July 1960.

*) The conditions for the supply and collection of technical gases for the supply of the national economy are regulated under the basic conditions of supply of the Ministry of Chemical Industry in Decree No. 171 / 1958 Ú. l. The transport of technical gases in steel cylinders is reserved within the meaning of § 1 (2) and § 2 (3) of the Ordinance of the Ministry of Transport No. 206 / 1954 Ú. l. to Czechoslovak Automotive Transport.
* *) The method of management of steel cylinders for technical gases is regulated in the Decree of the Ministry of Chemical Industry No. 54 / 1959 Ú. l.
