DECLARATION

Ministry of Environment

of 22 March 2000

declaring the Mazák National Nature Reserve and laying down its protection zone and closer protection conditions and amending Decree No. 395 / 1992 Coll., implementing certain provisions of Act No. 114 / 1992 Coll., on Nature and Landscape Protection, and Decree of the Ministry of Culture of the Czech Socialist Republic No. 14.200 / 88-SÚOP of 29 November 1988 (Reg. in amount 49 / 1988 Coll.)

The Ministry of the Environment provides pursuant to § 79 (3) (b) with regard to § 28 (1) and § 37 (1) of Act No. 114 / 1992 Coll., on Nature Conservation and Landscape Protection:

Čl. I

Announcement of the National Nature Reserve Mazák

§ 1

(1) The Mazák National Nature Reserve ("the National Nature Reserve") is declared in Beskydy.

(2) The object of protection is natural and nature close to forest communities on the western slope of Lysá hora, characterized by natural processes of continuous development of indigenous forest stocks and the occurrence of endangered species linked to this unique environment.

§ 2

Definition of the national nature reserve

(1) The national nature reserve is situated in Frýdek-Místek district in Staré Hamry 2 on parts of land parcels No 424 / 10, 424 / 11, 424 / 12, 424 / 13, 424 / 14, 424 / 15, 424 / 17, 424 / 18, 1009 / 5, 3145 / 1 and 3146. The total area of the national nature reserve is 92,9082 ha.

(2) The graphical representation of the territory of the national nature reserve is contained in Annexes 1 and 2 to the Decree.

(3) The map base in which the territory of the national nature reserve is inscribed is, in addition to the register in the central list of nature protection1) deposited at the Ministry of the Environment, the Beskydy County Council, the Frýdek-Místek District Office, the Ostrava Municipal Office, the Malenovice Municipal Office and the Staré Hamry Municipal Office.

§ 3

Closer protection conditions

Following the essential protections2), as a closer protection condition, it is provided that only with the consent of the competent nature protection3) can:

(a) to make changes to the type of land and to the manner in which it is used, unless this results from a care plan (4) for a national nature reservation;

(b) carry out mining, education or cultivation work in forests where the forest owner operates without an approved forest economic plan;

(c) use for afforestation planting material not derived from seed obtained from the territory of the national natural reserve;

(d) repair and maintenance of existing roads, roads and pavements;

(e) carry out geological work linked to the intervention into the territory;

(f) free feeding of animals and setting up hunting facilities;

(g) organise mass public events, in particular sports and tourism.

§ 4

Protection zone

The protection zone, 5) which serves to secure the national nature reserve from interference from the surrounding area, has a width of 50 m along the border of the national nature reserve, with the exception of the parcels at the top of the Lysá hora, land parcels No 891 / 2 and 891 / 7 in the cadastral area of Malenovice, construction lots No 1003 and land parcels No 2483 / 2, 2483 / 5, 2483 / 10, 2483 / 15 in the cadastral area Beautiful under the Lysa hora, construction lots No 771 and land parcels No 437 / 3 in the cadastral territory of Old Hamry 1.

§ 5

Repeal provisions

The Decree of the Ministry of Culture No 18.986 / 55 of 4 June 1956 (Reg. in the amount of 87 / 1956 Ú. l.), which established the State Nature Reserve Mazák, is hereby repealed.

§ 6

The decree of the Ministry of Culture of the Czech Socialist Republic No 14.200 / 88-SÚOP of 29 November 1988 on the declaration of certain territories in the Czech Socialist Republic as protected (reg. in the amount of 49 / 1988 Coll.) is amended as follows:

§ 7

In Annex No. V to Decree No. 395 / 1992 Coll., implementing certain provisions of the Czech National Council Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended, the following row is deleted: "Mazák FM Staré Hamry 2 + Income MK No. 18.986 / 55 (4.6.1956) '.

§ 8

This decree shall take effect on the day of its publication.
