DECLARATION
Ministry of Industry and Trade
of 30 March 1998
amending and supplementing Decree No. 245 / 1995 of the Ministry of Industry and Trade Coll., laying down rules for heating and supply of hot water including the breakdown of costs for buildings and between final consumers
The Ministry of Industry and Trade provides, in accordance with § 45 (6), with regard to § 32 (6) of Act No 222 / 1994 Coll., on the terms and conditions of business and on the performance of state administration in energy sectors and on the State Energy Inspection:
Čl. I
Decree of the Ministry of Industry and Trade No. 245 / 1995 Coll., laying down rules for heating and supply of hot water, including the breakdown of costs of objects and between final consumers, is amended as follows:
1. In Article 2, the following paragraphs 7 and 8 are inserted after paragraph 6:
"(7) The permissible values of the specific heat consumption indicators to ensure the indoor temperature referred to in paragraph 5 are set out in Annex 3 to this Decree.
(8) The minimum efficiency of heat production is set out in Annex 5 to this Decree. "
Paragraph 7 shall become paragraph 9.
2. the following paragraph 4 is added to Article 3:
"(4) The permissible values of the specific heat consumption indicators needed to prepare the hot water collected by the consumer are set out in Annex 3 to this Decree. '
3. the following paragraph 3 is added:
"(3) The heating regulation referred to in paragraph 2 shall be carried out in order to ensure room temperature in accordance with Article 2 (5) without exceeding the permissible values of the specific heat consumption indicators referred to in Article 2 (7). ';
4. Article 6 (1) reads as follows:
"(1) The heat costs for heating and other uses shall include the charges charged in accordance with the applicable price regulations, (1) which have been incurred in the unit of account for the annual settlement period, (2) which shall begin on 1 January or 1 June or 1 July or 1 September. ';
5. Article 6 (4) reads as follows:
"(4) The consumption component shall be distributed to the consumer in proportion to the heat meter or indicator data using a calculation method which allows the consumption component to be accounted for according to the achieved average internal temperature of each room with the heating body of the apartment or non-housing space in the unit of account. ';
6. Article 6 (5) reads as follows:
"(5) The essential component shall be divided between consumers in proportion to their countable floor area (hereinafter referred to as" floor area ') of the flat or non-residential space. The floor area shall be the area of the rooms other than the ships and balconies (even in glass) multiplied by the coefficients set out in Annex 1 to this Decree. If apartments and non-residential spaces have different ceilings or ceilings bevelled, the floor area of their rooms shall be determined by conversion in proportion to their height to the uniform ceiling height of all rooms in the unit of account.';
7. Paragraph 6 (9) reads as follows:
"(9) If the data are not subtracted by the installation of heat meters or indicators, the consumption component per m2 of the area of the room shall be determined by 30% to 50% higher than the average value of the consumption component recorded in the rooms by measuring or indicating. ';
8. Article 7 (6) reads as follows:
"(6) In the unit of account where water meters are not installed for consumers, the consumption component of the hot water supply costs shall be divided according to the average number of persons living in the housing in the accounting period; in non-residential areas, the average number of persons shall be determined by expert judgement according to the way in which hot commercial water is used. ';
9. Paragraph 8 shall be added to paragraph 5:
"(5) If the water-meters data referred to in paragraph 4 are known only for certain units of account, the consumption component of the costs that falls on the set of units of account with known measurement data and the set of units of account without known measurement data shall be calculated in accordance with Annex 4 to this Decree. The consumption component of the set of units of account with known measurement data shall then be divided into individual units of account in accordance with paragraph 4 and the consumption component of the set of units of account where the measurement data are not known shall be divided into individual units of account by floor area. ';
(10) Paragraph 9 shall be added to paragraph 3:
"(3) The basic cost component shall be allocated to flats and non-residential premises not connected to the internal central heating plant of the unit of account. Consumers who have withdrawn from the internal distribution of hot utility water in the unit of account shall be charged the basic component of heat costs for the preparation of hot utility water. '

„§ 10
(1) The costs of heating and the supply of hot commercial water to consumers shall be charged once a year, no later than three months after the end of the accounting period. "
(2) The accounts shall include:
(a) heat consumption for heating and heat consumption for hot water preparation in GJ, cold water consumption for hot water preparation in m3 per unit of account;
b) unit prices of heat for heating and hot water preparation in CZK / GJ and cold water for hot water preparation in CZK / m3, which are per unit of account,
(c) the total costs of the unit of account in CZK separately for heating, heat in hot commercial water and cold water in hot commercial water, which are accounted for among consumers, and the distribution of these costs into the essential and consumer components,
(d) the floor area (§ 6 (5)) of the unit of account and the floor area of the consumer's apartment or non-residential space in m2, the sum of the translated consumption patterns in the unit of account and in the consumer's apartment or non-residential space in the units of measurement and, where applicable, the average number of persons living in the unit of account and in the consumer's apartment in the unit of account,
e) share of the costs of the basic component, the consumption component and the total cost in CZK, which is to be paid to the consumer (users of the apartment or non-residential space) separately for heating service, heat supply in hot water and cold water in hot water including the method of calculation.
(3) Costs higher than those corresponding to the specific parameters set out in Annex 3 and the efficiency of heat production as set out in Annex 5 to this Decree shall be charged to the consumer in the unit of account when the excess is due to the regulation provided for in Section 4 of this Order.
(a) a longer heating period or a higher internal temperature than provided for in Article 2 of the Decree; or
(b) before 31 December 2000, prior to the validity of the Decree, a design and design solution for the system of heat supply and hot commercial water; or
(c) failure to comply with the agreement between the lessor and the lessee on the rational management of heat consumers and hot commercial water; or
(d) in the case of hot commercial water, by its unlimited provision at night. ';

If there is an uninsulated internal heat distribution line in the apartment room or non-residential space without heating body, these coefficients shall be increased by up to 0,25 points according to the formula
k = 5 × St / A, where St is the surface of the tube (in m2), A is the area of the room (in m2), k is the coefficient of increase. The sum of this coefficient and the coefficient referred to in paragraph (b) may not exceed 1,0.
Coefficient according to the table shall also be applied to rooms with similar usage. The coefficients for calculating the floor area of non-residential areas for the allocation of hot water costs shall be determined according to the nature of the collection in accordance with the relevant hygiene and operating rules. ';
13. Annexes 3, 4 and 5 are added as follows:

Measurements of heat consumption
Allowed values of specific heat consumption indicators
(a) for heating 1 m2 of deductible floor area of the unit of account:

– při vytápění z ostatních zdrojů tepla 0,8 GJ/m2 x rok
nebo 0,235 MJ/m2 x D0 x rok
(b) for the supply of hot commercial water to consumers per m3 of water taken in the unit of account:
– při přípravě v zúčtovací jednotce 0,3 GJ/m3
– při přípravě společně pro více zúčtovacích jednotek 0,4 GJ/m3
(c) aggregate - for heating and hot water:
– při zajišťování tepla z domovní kotelny na tuhá paliva do 1,25 GJ/m2 x rok
– při zajišťování tepla z jiných zdrojů do 1,05 GJ/m2 x rok
If the indicators referred to in points (a) and (b) are not complied with, compliance with the indicators referred to in point (c) shall be sufficient if both the heating service and the supply of hot commercial water are provided in the unit of account.
D0 is the number of denodegrees in the heating season determined by the relationship

Calculation of consumption components of the cost of supplying hot commercial water from its joint preparation for units of account
The consumption components of the costs attributable to the units of account where the consumption of hot commercial water is measured and where the consumption of hot commercial water is not measured shall be calculated according to the formulae:
Sm = Sc. K / K + 1
Sn = Sc- Sm
K = Mm / Mn
Mn = Mc-Mm,
where
Mc is the quantity supplied by the TUV measured in the joint preparation of the TUV by the commercial meter,
Mm is the amount of TUV collected by measuring consumption in units of account for the same period of time as Mc,
Mn is the quantity of TUV taken from the units of account where no measurement or consumption is unknown,
Sc, Sm, Sn are consumables corresponding to the quantity of Mc, Mm, Mn.

The above efficiency applies to individual boilers. The minimum efficiency of whole boilers may be up to 2% lower.
The tables shall be used where the owner of the heat source and the owner of the unit of account is the same legal or natural person and where the measurement of the amount of heat supplied from that heat source is not installed. ';

This decree shall take effect on the day of its publication.
