of 1 November 1972
on the procedure for concluding contracts for economic cooperation with foreign countries
The Federal Assembly of the Czechoslovak Socialist Republic decided on this law:
(1) Economic cooperation with foreign countries may take place only under a contract governing economic cooperation (hereinafter referred to as the "Economic Cooperation Treaty"). This contract can only be concluded by Czechoslovak organisations after the granting of an authorisation under § 2 of this Act or on condition that the contract is not entered into until such an authorisation has been granted.
(2) The Economic Co-operation Treaty is invalid without authorisation under Section 2 of this Act.
(3) Economic cooperation for the purposes of this Act means cooperation with foreign legal and natural persons in production, including scientific and technological cooperation related to it, and including the specialisation of production programmes.
(1) Authorisation for the conclusion of an economic cooperation contract is granted by the Federal Central Authority of the Republic or by the Central Authority of the Republic which manages the Czechoslovak organisation to conclude the contract.
(2) In the case of cooperative organisations, the national cooperative association or the Central Board of Cooperatives shall be authorised by the management organisation to conclude the contract.
(3) The Governments of the Republic provide for a regulation which the central government of the Republic is responsible for authorising the conclusion of an economic cooperation agreement to the single agricultural cooperatives and organisations managed by the national committees.
(4) Authorisations for the conclusion of an economic cooperation agreement may be issued by the authorities responsible under paragraphs 1 to 3 only after the prior approval of the Federal Ministry of Foreign Trade, the Federal Ministry of Technical and Investment Development, the Federal Ministry of Finance and the Czechoslovak State Bank.
(5) When deciding on authorisation, the competent authority shall take into account the effectiveness of the proposed economic cooperation in terms of uniform state economic policy. Within its scope, it will take into account, in particular, the concept of the development of the industry or industry, the intended economic or technical results, as well as the consequences of the proposed cooperation in the field of economic relations with foreign countries, and the financial and international commitments by which the Czechoslovak Socialist Republic is bound.
The provisions of Act No 71 / 1967 Coll., on Administrative Procedure (Administrative Regulations) do not apply to the authorisation procedure provided for in Article 2; the authority responsible for issuing the authorisation referred to in Article 2 shall determine, in agreement with the Federal Ministry of Foreign Trade, the Federal Ministry of Technical and Investment Development, the Federal Ministry of Finance and the State Bank, the Czechoslovak way in which the application for authorisation is submitted.
The authorisation granted under § 2 does not entitle Czechoslovak organisations to foreign business activities and does not replace the authorisation required under Act No. 142 / 1970 Coll., on Foreign Exchange Economy.
The Government of the Czechoslovak Socialist Republic may determine in which individual cases no authorisation pursuant to § 2 is required to conclude an economic cooperation agreement.
The provisions of this law also apply to agreements abolishing economic cooperation agreements with foreign countries.
The Decree of the Minister for Foreign Trade of 14 August 1968 on the implementation of industrial cooperation with foreign companies, the issue of which was notified in the amount of 34 / 1968 Coll.
This Law shall take effect on 1 January 1973.
