DECLARATION
Ministry of Agriculture
of 18 March 1996
on forest economic planning
According to Articles 25 (5) and 27 (7) of Act No. 289 / 1995 Coll., on Forests, and amending and supplementing certain laws (Forest Act), the Ministry of Agriculture provides:
_
Breakdown of forest land
(1) For the purposes of processing the forest economic curriculum (hereinafter referred to as "the curriculum ') and to derive binding provisions for forest economic plans (hereinafter referred to as" plans') and the curriculum, forest land [Paragraph 3 (1) (a) of the Forest Act] shall be subdivided into:
(a) grassland consisting of land with forest trees and productive holins, forest passages and unpaved forest paths up to a width of 5 m, temporary forest landfills and other temporary facilities serving forestry and hunting, provided that their area does not exceed 0,04 ha; productive shaving means forest land for the purposes of this decree, on which the forest area has been removed by renewal or random extraction, provided that the conditions for afforestation are appropriate; the productive shaving is also a forest-free land intended for afforestation,
(b) forest-free forests, which consist in particular of forest-penetrating areas and unpaved forest roads not included in the grassland, temporary forest landfills, forest nurseries on forest land, seedlings, areas above or under the power lines, game-picker areas and other temporary facilities serving the forestry economy and hunting, provided that they normally occupy an area of more than 0,04 ha, and land on which forest crops have been temporarily removed pursuant to a decision of the State Forest Administration Body pursuant to Article 13 (1) of the Forest Law.
(2) A set of forest land and other land, (1) for which a single plan is being drawn up, is referred to as a forest economic unit (the whole) for the purposes of this decree.
Forest Management PLANS
Forms of the plan
The plan shall include the following elements:
(a) the text part,
(b) the economic book;
(c) forest maps.
Text Part
The text section contains:
(a) general data, in particular forest owner identification, basic data on plan processors, validity and continuity of previous plans, administrative administrative competence of the whole and indicative map;
(b) an assessment of the natural circumstances, in particular affiliation to natural forest areas, and an overview of the sets of forest types and their representation; data from forest development plans (Section 23 of the Forest Act) are used for this;
(c) an assessment of the state of the forest and the current management;
(d) data based on the regional forest development plan, in particular an overview of the declared forest categories and restrictions resulting therefrom;
(e) the definition of the economic objectives of the forest owner and the establishment of an economic plan for the period of validity of the plan;
(f) the economic framework directive for the represented economic files, based on the economic intention of the forest owner, the basic economic recommendations according to the economic files, the framework definition of the economic files and the regional forest development plans; the framework directives contain basic economic recommendations, data on the start of recovery, recommended methods of recovery and education, and the duration of the provision of cultures,
(g) the amount and justification of the binding provisions of the plan;
(h) the final tables of the summary data of the plan in the structure of the data set out in Annex 1 to this Decree;
(i) a technical report with details of the methodology procedure for the design of the plan, unless the procedure results directly from the Forest Act or this Decree;
(j) Annexes which make up copies of protocols, decisions (e.g. on the categorisation of forests) and minutes of negotiations relating to the drawing up of the plan.
Economic book
(1) The Economic Paper contains:
(a) data on forest status;
(b) a proposal for economic measures;
(c) a flat table; and
(d) data from individual inventory areas when a forest status survey is carried out on the inventory area.
(2) Forest status data shall be collected and reported for the lowest spatial distribution unit of the forest (grassland, grassland group, even),
(a) each crop has at least one crop group,
(b) each group has at least one equivalent; and
(c) the data shall be reported collectively for economic groups when a forest status survey is carried out on the inventory area.
(3) From the data on forest status,
(a) the crops shall indicate the natural forest area and forest category concerned; if these data are identical for several spatial distribution units of the forest, they may only be indicated for the highest common unit;
(b) the crop group shall indicate its area or area and the forest type and the linkage; in the case of forest status surveys on the inventory area, the census shall be indicated only when the same forest crops are concerned;
(c) the ethos shall indicate the subject-matter, the economic ensemble (hereinafter referred to as "the ensemble"), the age, the composition and the economic form; in the case of forest status surveys on the inventory area, the census and age of the year are given only when the same forest crops are concerned;
(d) the wood indicates its taxing quantities, which are represented, medium height, medium thickness, bonites, stocks and phenotypic classifications for crops recognised and genetically unsuitable; in the case of forest status surveys on the inventory area, only the representation and phenotypic classification shall be reported for wood, for areas recognised and genetically unsuitable;
(e)
1. area,
2. the inventory of the previous total stock (m3 b. k.) and hectares (m3 b. k. / ha),
3. inventory of the current total stock (m3 b. k.) and hectares (m3 b. k. / ha),
4. the average annual production for the inventory period according to forest economic records, total (m3 b. k. / year) and hectare (m3 b. k. / ha / year);
5. the average annual growth over the inventory period, total (m3 b. k. / year) and hectare (m3 b. k. / ha / year),
6. the representation of each species of wood,
7. inventoried stock of the present species (m3 b.),
8. inventory current in thick classes (m3 b. k.); and
9. Number of strains collapsing in thick classes.
(4) The plan of economic measures for the lowest spatial distribution units of the forest shall include:
(a) the amount and location of toll extractions in units with an area of economic and forest specific destination of less than 50 ha, in forest conservation, in forests nearby zones of national parks, national natural reserves, natural reserves, national natural monuments and natural monuments;
(b) the minimum proportion of meliorative and strengthening trees in the recovery of forest land for state forests;
(c) the area of urgent and repeated educational interventions in forests under the age of 40 for state forests.
(5) The recommended data of the economic measures plan for the lowest spatial distribution units of the forest include:
(a) the area and amount of the nurseries, the area of the prunes and the need for afforestation in the area and timber; for forests not referred to in paragraph 4 (a), also recommended above and the location of tolls;
(b) in the case of special purpose forests and forests, protective measures.
(6) The flat table consists of a list of the parcel numbers of all the parcels intended to fulfil the functions of the forest covered by the plan, indicating the area of the parcels, the area of the crops and the higher units, forests and other parcels marked with them. The data are broken down by cadastral territory and by forest category.
(7) The economic book may have an area to allow a clear indication of the economic measures taken.
Forestry maps
(1) The spatial distribution of the forest is part of the forest map.
(2) A binding starting map for the creation of forest maps is a cadastral map or a basic topographical map of the Czech Republic with a scale of 1: 5 000, displayed in the Coordinate System of the Single Trigonometric Network. Forestry maps are processed and displayed in the Geodetic Reference System of the Single Trigonometric Catastral Networks (S-JTSK) .5) When displaying the higher units of spatial distribution of the forest, which are separation, the panel (§ 6) works with geodetic accuracy 0,0004 × M [m], where M is the scale of the map. The map marks referred to in Annex 2 to this Decree shall be used for the production of forest maps. When displaying forest parts outside the situation, a general situation diagram is part of the forest map.
(3) Forestry maps are a map of contour, subsoil, typology, mining or mining technology, which is generally drawn up on a scale of 1: 10 000 or more (more detailed) and other dedicated forest maps such as organizational, transport, long-term forest protection measures, etc. The forest maps, which are the essentials of the plans, always show the scale of the map and the overview of map marks.
(4) The forest map shall be a compulsory part of the plan of 1: 10 000 or more (in more detail), including all differentiated units of the spatial distribution of the forest for which the forest status is determined.
(1) All grassland per whole must be included in the spatial distribution units of the forest; the forest-free land and other land [Paragraph 3 (1) (b) of the Forest Act] are identified in the plans by separate numerical lines.
(2) The spatial distribution units of the forest are designed to be
(a) facilitate forest orientation;
(b) allow for clear identification of forest parts in planning, economic, accounting and control activities.
(3) The units of the spatial distribution of the forest are: separation, workshop, crop, crop group and the same, the crop being the basic unit of this distribution, which must always be distinguished. In the case of forest status surveys on the inventory area, the crops are grouped into economic groups.
(4) The departments are the highest units of the spatial distribution of the forest, their purpose is to facilitate orientation in the forest. Their area shall normally not exceed 150 ha and shall be marked with Arabic numbers.
(5) The pieces are created on the basis of the similarity of natural and economic conditions with a view to gradually achieving a uniform method of management. The cut-off does not normally exceed 30 ha. The pieces are marked in capital letters.
(6) Crops shall be defined as the interconnected areas of the forest, distinct from each other by species, age or spatial composition, forest category or requiring different management. In the case of syllables, these are parts of forest with different ownership. The size of the crops generally does not fall below 0.20 ha. Crops shall be marked in small letters.
(7) The crop groups are distinguished for parts of the crops where the boundaries change as a result of development, and for the small parts of the forest which are not differentiated as crops.
(8) The ethos are distinguished in terms of the vertical breakdown of crops and grassland groups, relevant for the determination of forest status and the economic measures plan.
(9) Economic groups pool crops with similar climatic and soil characteristics, possibly also functional focus and forest status, and are the basic unit for the detection and presentation of forest status and planning of economic measures in cases where forest status is detected on the inventory area. Economic groups shall be identified by Arab numbers, underlining.
(10) The parts of the forest with a size of 0,04 ha or more are distinguished as plantations or ethads.
(11) The boundaries of the cadastral areas shall be respected at the border level of the grassland or grassland groups when determining spatial distribution units.
(12) The boundaries of departments and sections are designed on clear lines in the field. Where there may be doubts as to the course of these boundaries, the processor of the plan shall clearly indicate their progress in the field at quarry points and, if necessary, between them.
Details of data contained in the forest status finding
The following data shall be used for the processing of the elements of the plans and syllables and for the derivation of their mandatory provisions:
(a) the area which means the figure of the size of the part of the forest determined by measurement; the area of the rotation can also be determined by estimation, given to the nearest hundredth of the ha,
(b) an area which means the figure of the size of the part of the forest established on the basis of the cadastral; for the purpose of this decree, the area may be replaced only where the difference between the established state and the cadastral figure exceeds the limit determined in accordance with the formula delta P = 5. (0,001 P + 0,5,) where P is the area in m2; the area shall be reported rounded to the nearest hundredth of a ha;
(c) the age of the crop, of the group or ethnicity, hereinafter referred to as "age," which means the number of the age of the crop. For artificial crops, age is calculated from the establishment of the crop, age of seedlings is not considered. For natural recovery crops, the age of the species shall be estimated. In the case of different crops, the medium age is reported as the area-weighted average of parts of different ages for the forest status unit,
(d) age step, which means a set of forest state survey units ("crop") falling within the same 10-year age interval. A distinction is made between the cane and the individual ages starting each first year in a given ten. The first age level includes crops from 1 to 10 years of age etc. If necessary, the ages may be subdivided further. However, a breakdown of age rates after 10 years and a maximum of 17 age degrees is used to summarise plan data. The oldest age level includes all crops of 161 years old and over,
(e) age class, meaning a set of crops falling within the same 20-year age interval. A distinction is made between the cane and the individual age classes beginning with the first year of the age of the crop in the 20. First age class includes crops from 1 to 20 years of age etc.,
(f) the census of the crop group, which is the sum of the census of the individual plants; for the purpose of this calculation, the census of the ethic shall be converted into the area of the crop group; by entanglement, the sum of the totals of the individual trees of the forest in the ethic, multiplied by 10 and rounded to the integer; the incorporation of timber means the proportion of the actual hectare and tabular stock, or the actual hectare and table round base of the relevant wood in question; the census value 10 corresponds to the full table stock or circular base of the taxing or growth tables approved by the Ministry of Agriculture (hereinafter referred to as the "taxing tables') listed in Annex 3 to this Decrees 7;
(g) the representation of the trees, which indicates the percentage of the census of each of the trees identified in the unit under investigation and the total census; in cases where the state of the forest is detected on the inventory area, the representation of the timber shall be determined as a percentage of the stocks of each wood within the economic group; the representation may also be established by estimates, in particular for forest crops which have not yet reached the registration limits of the husks; it is generally expressed in tens per cent or more; wood with a representation of less than the lower quantified limit shall be treated as conserved; the list of forest trees with their abbreviations is set out in Annex 4 to this Decree,
(h) the mean height of the grassland to be declared in whole metres for each wood represented in the unit under investigation;
(i) the mean calculated thickness shall be reported for each wood in the examined unit as the thickness of the middle crop strain measured at 1.3 m above the terrain of the strains in which the thickness is equal to or greater than 7 cm with bark, i.e. it shall be broken down;
(j) bonita is derived for wood from the medium height of the crop according to approved taxation tables;
(k) the crop stocks shall be reported to the nearest whole m3 in bark-free volume, the strains of which are equal to or greater than 7 cm in thickness with bark. It is generally detected for crops over 60 years of age by measurements, for crops younger than measurement or estimated using taxation tables,
(l) the coefficient to convert the volume of matter with bark into the volume of matter without bark shall be 0,90909 for coniferous wood and 0,86956 for foliage;
(m) the forest type of the grassland group which is considered to be the predominant forest type of the represented forest types in the grassland group.
Detection of forest status on the inventory area
When determining forest status on the inventory area,
(a) reference inventory network means a network of inventory sites covering the whole territory of the Czech Republic managed by the Ministry of Agriculture;
(b) an inventory site (hereinafter referred to as the "site") means the place where forest status data are collected as part of the inventory implementation; the location is characterised by its position in the coordinate system of the single trigonometric network of the cadastral, the number and manner of spatial layout of the inventory areas,
(c) the inventory area shall mean the part of the territory where the inventory survey is conducted directly; the inventory area consists of its centre, fixed by coordinates relative to the location of the site, and at least one circular subsurface,
(d) a circular sub-surface (hereinafter referred to as "sub-surface") means a circular area, centred on the centre of the inventory area; each inventory area shall contain at least one sub-area for the registration of strains of shrouds,
(e) stratum means a well-defined portion of the inventory unit for which the optimal area density and number of sites are proposed as part of the inventory, while, in the case of a requirement for greater accuracy of the estimation of the target parameters for each economic group, these groups also constitute a selection stratum;
(f) shrapnel shall mean an element of the population of the strains having a calorific thickness of more than 7 cm with bark, the position of the strain being the same as that of the point on its centreline situated at a distance of 1,3 m from its point of intersection with the horizontal plane at the height of the stem, and
(g) standard error means the square root of the estimate of the variability of the point estimate calculated in accordance with Annex 6 to this Decree.
(1) The survey of forest status on the inventory area can be used for all economic ways. The survey of forest status on the inventory area shall be carried out by field examination on sites the positions of which are derived from the reference inventory network.
(2) Each site must contain at least one inventory area. The number of sites shall be chosen in such a way as to comply with the minimum quality requirements for forest status surveys set out in Section 7c, but shall not fall below 50 per unit.
(3) The Ministry of Agriculture and the territory of the national parks and their protection zones, the Ministry of the Environment, on request, will provide the forest owner with the location of the sites for its whole. The application shall contain:
(a) identification of the owner;
(b) identification of the whole,
(c) digital vector demarcation of the boundaries of the whole and its inventory part;
(d) the list and definitions of new strata as set out in Annex 6 to this Decree;
(e) the list of identifiers of existing strata proposed for cancellation; and
(f) a list of identifiers of existing strata, indicating the number of additional sites required.
(4) The positions of the inventory areas are permanently stabilised in the field in order to be able to re-identify individual trunks of collapses during the processing of the following plan on the inventory area.
(5) The re-survey of forest status on the inventory area may not be carried out at an interval of less than 5 years.
(6) The method of carrying out forest status surveys on the inventory area and the extent of the data collected on the inventory area is set out in Annex 6 to this Decree.
(1) The standard stock estimation error for the part of the whole on which the forest status has been collected on the inventory area shall not exceed 25 m3 b. k per hectare of grassland or shall not exceed 10% of the point stock estimate shall be broken down per hectare of grassland.
(2) The standard error in the estimate of the annual total amount of production must not exceed 1 m3 b. K. per hectare of perennial land, or not exceed 10% of the point estimate of the annual total amount of production per hectare of grassland.
(1) The state of the forest, as described by the inventories, is statistically evaluated for the economic group and the whole, or part thereof, on which the forest has been collected on the inventory area.
(2) The statistical evaluation of forest status shall be carried out in accordance with the procedure set out in Annex 6 to this Regulation.
(3) The forest status assessment includes a forest map showing the strata and centres of inventory areas and their unique identifiers allowing for assignment to the sites of the reference inventory network.
Deriving a binding provision of the maximum total mining amount
(1) The level of toll mining for the category of special purpose forests and forests (except in the cases referred to in paragraph 12 and forests where the state of the forest is detected on the inventory area), managed economically by undergrowth, landfill and holistic, is determined on the basis of the following indicators:
(a) the mining percentage;
(b) normal passing.
The value of the two indicators shall be expressed in m3 of shale without bark.
(2) For the calculation of the extractive indicators, an indication of washing, restoration of time and start of recovery from the framework management directives shall be used.
(3) The mining percentage for the 10-year period of the plan is fixed:
(a) for individual economic files or combined economic files with the same packaging and renewal period, the partial mining percentages shall be used in each age scale as set out in Annex 5 to this Decree;
(b) as an indicator of tolling for the economic file or the combined economic files and shall be calculated in accordance with the relationship No 1 set out in Annex 5 to this Decree;
(c) as an indicator of the level of toll mining according to the partial mining percentage for the plan and is the sum of toll mining calculated according to these percentages for all economic sets per whole. In the case of non-10-year plan validity, the toll mining indicator shall be converted into the plan period.
(4) The normal passage for the period of validity of the plan is determined from the total area of the grassland and from the average washing of the whole of the relationship No 2 listed in Annex 5 to this Decree.
(5) In the area of the special purpose forests and forests on an arranged unit of less than 50 ha, tolls shall be determined in accordance with the framework guidelines [§ 3 (f)] according to the needs and possibilities of the crops.
(6) In the case of a larger area than that referred to in paragraph 5, the level of tolling proposed by the plan shall not exceed a limit of ± 10% from the mining percentage indicator. It contains, outside of the extractions placed in the crops and the extractions not placed.
(7) In the case of an area of more than 500 hectares of forest, the amount of tolls proposed by the plan shall not exceed ± 20 per cent of the "normal pass' indicator. If, in compliance with the provisions of paragraph 6, this condition cannot be met, in the absence of tolls, the proposed mining at the upper limit will be the range for the sub-" mining percentage" indicator, with excess tolls at its lower limit.
(8) The amount of pre-tolling shall be determined as the sum of pre-tolling in individual crops.
(9) In the event that the amount of pre-toll extractions is not proposed on the crops when the plan is drawn up, it shall be derived for the whole of the acquired assets in the economic files from the stocks of individual trees, the probationary intensities (percent) and the average census in the ages. The probative intensities are set out in Annex 5 to this Decree.
(10) The production of pretoll determined in accordance with paragraphs 8 and 9 may be increased by an expected proportion of random, but not more than 20%.
(11) In forest protection, the amount of extraction shall be determined as the sum of the extractions placed on each crop to ensure that all their functions are continuously fulfilled.
(12) In the forests of the first zones of protected landscape areas, national natural reserves, natural reserves, national natural monuments and natural monuments, an approved care plan for these territories is crucial for determining the level of mining. Forests included in the natural zone of national parks are not included in the calculation of the mandatory provision of the maximum total amount of extractions, in forests included in the natural zone close to the mandatory provision of the maximum total amount of extractions is determined as the sum of the extractions located in each forest area.
(13) For economically selective forests, with the exception of forests where the state of the forest is detected on the inventory area, an indicator of the total amount of extractions (mining of tolls and pre-tolls is not distinguished) shall be established on the basis of the overall normal increment, on the basis of relation 3 and 4 set out in Annex 5 to this Decree. The total normal increase for the purposes of this decree is the total volume production of the logs of the forest concerned over a certain period. It is used to assess current wood production.
(14) For forests where forest status is detected on the inventory area, an indicator shall be established for the total amount of extractions, with no distinction being made between tolls and pre-tolls, using the total normal increment in accordance with Annex 6 to this Decree.
(15) The total maximum mining amount under the plan shall be determined as the sum of all the extractions established under the preceding paragraphs.
(16) When increasing the binding provision, the maximum total amount of extractions due to a change in the plan under Article 27d (1) of the Forest Act shall be determined separately by the amount of random and intentional mining. The increase in the mandatory provision of the maximum total amount of mining shall be determined as the sum of the amount of random and intentional mining.
Minimum range of educational interventions in forests up to 40 years of age
(1) The minimum range of educational interventions in forest areas up to 40 years of age (hereinafter referred to as the "minimum range of education") is the sum of areas up to 40 years of age in which urgent and repeated educational interventions were located during the outdoor survey in the preparation of the plan.
(2) In determining the minimum range of education, educational interventions which are urgent in order to increase the resistance of the crops and to modify their species composition (§ 31 (1) of the Forest Act) are considered urgent.
Minimum proportion of meliorative and strengthening trees in forest restoration
(1) The minimum proportion of meliorative and strengthening timber shall be fixed as a binding provision of the plan for all crops (grassland groups, ethnicity) over 60 years of age and under-size groups, provided that the plan places recovery or allows recovery there.
(2) When determining the minimum proportion of meliorative and strengthening timber, the provisions of the Specific Regulation9 are based on the provisions of the Specific Regulations (9), taking into account the type of vegetation, the current state of the crop group (ethage) and the stage of development of the renewal, account being taken of the representation of meliorative and strengthening timber in the already restored parts of the crop. The reason for reducing the minimum proportion of meliorative and strengthening trees in the recovery of the crop is not damage caused by animals or grazing in the forest.
(3) The minimum percentage of melliorative and strengthening timber is set out in the framework directives for the holes resulting from random extractions which, by their spread or size, exceed the cutting size recommended by the framework directives for the relevant economic group. Areas resulting from random extractions of less than 0,08 ha if they do not comply with the recovery system under the framework management directives shall not be considered when determining the minimum proportion of meliorative and strengthening timber.
(4) In order to assess the proposed minimum share of the meliorative and strengthening trees in each crop, the plan approval documentation shall include a list of the spatial distribution units of the forest in which the minimum proportion of meliorative and strengthening trees referred to in the specific regulations has not been achieved. 9)
FOREIGN ECONOMIC RESISTANCE
Ascending
(1) The processing of the syllables is commissioned locally by the competent authority of the State Administration of Forests (hereinafter referred to as the "contracting authority") for integrated territories (hereinafter referred to as the "adjustment circuits") so that the syllabus covers all forests for which the syllabus is being processed (Section 25 (1) of the Forest Act).
(2) The assembly circuit normally covers several cadastral territories. The boundary of the installation circuit respects the boundaries of the cadastral territories. In justified cases, this limit may be derogated from, but a well-identified line shall be used in the field to establish such a border and the boundaries of the land shall be respected.
(3) The intention to enter into the syllabus, including the definition of the setting-up circuit, shall be announced by the contracting authority in good time but at least 18 months before the beginning of its validity. It also sets a deadline for the application of forest owners' intentions and requirements.
(4) No later than 12 months before the beginning of the period of validity of the syllabus, processing of the syllabus shall be awarded to the processor of the syllabus. The assignment also includes the transmission of the underlying material to the processor of the syllabus.
(5) The background materials for processing the syllabus are:
(a) a cadastral map,
(b) an extract from the property register;
(c) identification of the parcels intended to fulfil the forest functions;
(d) a outline map or a plantations map;
(e) typology map,
(f) the economic book;
(g) a regional forest development plan.
Processing of syllables
(1) Forests in the territory of the setting-up district are divided into divisions, parts, crops, or different grassland groups and ethnicity. Paragraph 6 (1) to (12) of this Decree shall apply mutatis mutandis to the proposal for spatial forest distribution units.
(2) In the field, the identifiable forest land boundaries of each forest owner constitute at least the crop border.
(3) If the boundaries of the property of individual forest owners in the field are not identifiable, such assets can be combined within the so-called general crop. The property borders will be transferred to the forest map according to the cadastral map as the boundary of the crops. The description of the state of the forest and the proposal for economic measures for these crops will be derived as a general proportion of the assets of the aggregate crop.
(4) When drawing up the syllabus, the processor shall take into account the economic intentions and requirements of forest owners and other operators in due time, provided that they are affected by the processing of the syllabus and the proposed management in the forest.
(5) A field investigation is a necessary condition for the processing of syllables. A field survey for the processing of syllables may not be carried out by means of forest status surveys on the inventory area.
(6) The validity of the syllables and their amendments is always on 1 January of the calendar year.
(7) The processor shall forward the outline to the contracting authority no later than 30 June of the first year of its validity.
