GOVERNMENT REGULATION
of 25 August 2004
amending Government Regulation No 322 / 2002 Coll., laying down the conditions, amount and manner of contribution to the social consequences of the transformation of the Czech Railway State Organisation
The Government orders pursuant to § 36 (2) of Act No. 77 / 2002 Coll., on the public limited company České dráhy, state organization Railway Infrastructure Administration and amending Act No. 266 / 1994 Coll., on Railways, as amended, and Act No. 77 / 1997 Coll., on the State Company, as amended:
Decree of the Government No. 322 / 2002 Coll., laying down the conditions, the amount and the manner in which the contribution to addressing the social consequences of the transformation of the state organization ČD is to be provided is amended as follows:
1. In Paragraph 1 (2), the words "and connections' are deleted.
2. In Paragraph 2 (1), "31 December 2005 'is replaced by" 31 December 2008'.
3. In Article 2 (1), the words "notice by the employer or 'and the words" meeting these other conditions' are deleted.
4. In Paragraph 2 (1) at the end of point (b), the reference to footnote 2 is inserted after the word "consequences' and the comma is replaced by the words" and by the date of the age needed to qualify for an old-age pension (1) he is no longer than 5 years old, or '.
5. In Paragraph 2 (1), point (c) is added at the end of the text, "and up to the date of the age required for entitlement to an old-age pension (1), he is no more than 5 years short '.
6. In Article 2, the following paragraph 5 is added:
"(5) Staff members who, within a period of more than 5 years before the age required to qualify for an old-age pension (1), fulfil the other conditions referred to in paragraph 1 (b) or (c) shall be granted an allowance equal to sixty times one tenth of his average monthly earnings (4) but not more than 180 000 CZK."
7. In Article 3 (1), the words "and 5 'shall be inserted after the words" Paragraph 2 (1)'.
8. in Article 3 (2) and (3), "paragraphs 3 and 4 'are replaced by" paragraphs 3 and 4 or 5';
Entitlements for the grant of a contribution which arose before the date of entry into force of this Regulation shall remain unaffected.
This Regulation shall enter into force on the day of its publication.
