State Commission on the Development and Coordination of Science and Technology
of 15 October 1963
on compulsory testing and control of electrical products, materials and aids
The State Commission on the Development and Coordination of Science and Technology provides pursuant to Section 8 of Act No. 17 / 1962 Coll., on the establishment of the State Commission on the Development and Coordination of Science and Technology:
Preliminary provisions
The increasing importance of electrical products for increasing the technical level of production and the growth of the standard of living of the population places ever higher demands on their technical level, economy, versatile reliability, durability and efficiency, and in particular ensuring the safety of persons and property. These requirements shall also be consistent with the method of testing and checking electrical products.
Testing and approval of products
(1) Electrotechnical products, materials and aids listed in Annex 1 (hereinafter referred to as "products") may be manufactured and put into circulation in series only if approved by the Electronic Testing Institute (hereinafter referred to as "Institute") in terms of safety, durability, reliability, effectiveness and economy; The Institute shall also ascertain whether the products comply with the technical standards.
(2) For the approved product, the Institute shall assign the control mark "ESČ '(ELECTROTECHNICAL STANDARD OF CZECH ENGLISH) and, where appropriate, the specific control mark referred to in Annex 2 (the control mark). The manufacturer is obliged to mark the approved products with the assigned control mark; they must not put the products into circulation without that marking.
(3) The provisions of paragraphs 1 and 2 also apply to products from the verification series. The quantity of products for the verification series shall be determined by the manufacturer after consultation with the Institute.
Applications for product approval
(1) The application for product approval is submitted by the manufacturer's institute. The application shall specify:
(a) precise labelling and description of the product (type, nominal values, technical data, etc.);
(b) Czechoslovak state and other technical standards (industry, sector and technical standards), *) to which the product is intended to comply;
(c) the name of the manufacturer's undertaking and plant in which the product will be manufactured;
(d) the authority superior to the manufacturer,
(e) the authority empowered to approve the introduction of the product into production.
(2) The manufacturer shall attach to the application for product approval technical documentation (drawings and drawings, technical conditions, description, operating instructions, etc.), according to which it is possible to assess the safety, durability, reliability, efficiency and efficiency of the product, as well as the report or test report of the product carried out by the test plant and, if not in the plant, the certificate of the technical inspection manager that the product has complied with the results of the tests, or, where appropriate, the main customers' opinion on the results of the tests.
(3) If the manufacturer submits to the test a product which failed the previous test shall indicate the modifications made.
(4) The manufacturer shall, at the same time as the application, send samples of the products to the Institute in the number specified by the technical standard, otherwise the number specified by the Institute. The samples shall be marked in such a way as to avoid confusion. The manufacturer shall not be compensated for samples of products.
(5) The Institute shall be entitled to require the manufacturer to provide proof of the performance of tests in fields not covered by the Institute if such tests are necessary to assess the overall quality of the products.
Approval of the product and allocation of the control mark
(1) The Institute shall test and, where appropriate, test samples of the product in another organisation within the time limit agreed with the manufacturer and inform the manufacturer of the result of the test.
(2) For the product the samples of which have been tested, the Institute shall issue a certificate of conformity to the manufacturer.
(3) If it is not possible to ensure that the product complies with the technical standards, the Institute may only approve the product if it complies with safety and has been granted an exemption from the obligations of the technical standards. *) In this case, the Institute shall assign a specific control mark to the product; the model is set out in Annex 2.
Obligations of the manufacturer
(1) The manufacturer shall:
(a) deliver to the Institute on request the product as a documentary sample;
(b) send to the Institute at least three copies of the instructions, prospectuses, price lists, stickers, labels, etc., in respect of products;
(c) notify the Institute in advance
1. prepare a change in product design,
2. temporary or permanent cessation of production of the product,
3. re-introduction of product production after temporary cessation;
4. transfer of production of the product to another plant within the undertaking.
(2) The approval of the Institute shall be required for the manufacture of the product in the modified version, where such a change may affect the aspects referred to in Paragraph 2 (1) under which the product has been approved. In this case the manufacturer is obliged to send samples of the product to the Institute in the modified version.
(3) Where production is transferred to another plant of the same undertaking, the plant shall send the product to the Institute for examination.
(4) Where production is being transferred to another undertaking, the new manufacturer shall, before the start of the production, again apply for product approval and provide proof that the conditions for maintaining the quality of the products are given.
Specific provisions on imported products
(1) Products subject to compulsory control may be imported from and into circulation in the country only if the Institute has approved their sample in terms of safety, durability, reliability, effectiveness and economy and complies with the technical standards or recommendations of international standardisation organisations adopted by the Standardisation and Measurement Authority.
(2) In serious cases, the Institute is only entitled to approve imported products on the basis of a safety test.
Applications for approval of imported products
(1) An application for approval of a product is submitted to the Institute by a domestic wholesaler or, where appropriate, by a foreign trade organisation where the product is imported without prior consultation with a wholesaler.
(2) The wholesaler or, where applicable, the foreign trade organisation shall indicate in the application:
(a) precise labelling and description of the product (type, nominal values, technical data, etc.);
(b) the Czechoslovak state and other technical standards to which the imported product is to comply, where appropriate, the indication that the product has already been tried and complied with under national rules, or that the product has been tested elsewhere and has an assigned control mark under international agreements under which the Institute has been entrusted with testing and approval;
(c) the organisation of foreign trade importing the product;
(d) the designation of the foreign manufacturer.
(3) The application for the approval of the imported product must be accompanied by technical documentation (drawings and pictures, technical conditions, description, operating instructions, etc.), showing in particular the particulars referred to in paragraph 2 (b), and produce samples of the products.
Approval of imported products
(1) If the sample complies with the test, the Institute shall approve it and inform the applicant accordingly.
(2) The Foreign Trade Organisation is responsible for the compliance of imported products with an approved product sample.
Control
(1) The Institute is entitled to carry out random checks on manufacturers and in trade organisations and to check whether the products correspond to those approved by the Institute.
(2) Manufacturers and trade organisations are obliged to allow the staff of the Institute to carry out random checks. in particular, they shall be obliged to allow them access to production and other establishments, to submit to them the documentation required and to provide the necessary explanations.
(3) The Institute is required to submit to the superior body of the manufacturer or business organisation, on request, protocols, entries and records of the conduct of the inspection test.
Withdrawal of products for inspection
(1) The Institute is entitled to take from producers and in commercial organisations the products required to carry out the checks to the extent necessary. The Institute may entrust a technical inspection worker to take samples for the production control test.
(2) Manufacturers and trade organisations are required to submit to the Institute the products collected for inspection free of charge.
(3) Products collected from a trading organisation are obliged to replace the producer, in the case of imports by a wholesaler.
(4) The Institute shall keep a record of the products taken for testing.
(5) He shall not be responsible for the damage to the products in the tests of the Institute and shall return them in the state in which they are in after the tests if he does not need them as evidence.
Test result
(1) The result of the inspection test shall be communicated by the Institute to the manufacturer or to the commercial organisation. If it finds that a gross defect has been checked, it shall also inform the manufacturer's superior authority.
(2) The manufacturer shall remove the defects identified by the inspection test immediately or within a time limit to be specified by the Institute.
Withdrawal of the control mark
The Institute shall withdraw the control mark if the products do not correspond to the approved sample, if they threaten the safety of persons or property, or if they would cause serious economic losses in their further production.
Delegation of organisations to carry out control tests
The Institute shall be entitled to entrust the production undertakings, establishments or other organisations duly equipped for this purpose and in agreement with them.
Provisions common, transitional and final
(1) Products which have not previously been subject to compulsory testing must notify the Institute within one month. The Institute shall set the time limit by which the manufacturer is required to submit the product for testing.
(2) The manufacturer may continue to manufacture until the test result has been notified. If the product fails to pass the test, the manufacturer shall remove the defects within the time limit specified by the Institute.
The examination of the product shall be carried out by the Institute, or by the organisation responsible for the examination, and shall be subject to compensation at rates set by the State Commission for the Development and Coordination of Science and Technology in an agreement with the State Planning Commission and the Ministry of Finance.
The Institute publishes lists of products for which control marks have been assigned in the Reports of the Electronic Testing Institute.
Decree No 78 / 1955 of the Ú. l., on compulsory testing and control of electrical products, materials and aids, is hereby repealed.
This Decree shall take effect on 13 November 1963.
