on the adjustment of financial planning and financial management of national enterprises and other State Socialist sector organisations
The National Assembly of the Czechoslovak Republic decided on the following Act:
Financial management
Empowerment
(1) The Director-General of the State Bank of Czechoslovakia is hereby authorised to further adjust the financial management, in particular the contributions to and allocations from the State budget, the financial resources generated by the undertakings and their use, the payment of losses, the financing of basic funds and its own resources, the financing of other tasks and the granting of loans, as well as to lay down the principles for analysing and approving the results of the financial management of the undertakings and the authorities of their superiors.
(2) Furthermore, the Director-General of the Czechoslovak State Bank is empowered to regulate payment and settlement transactions, cash transactions, invoicing and payment, checks carried out by monetary institutions, in particular checks on the use of wage funds and the consequences of breaches of financial discipline; it may also determine to what extent the provisions on invoicing and payment and the penalties applicable to infringements of those rules apply to organisations other than undertakings (Section 2 (2)) and to the population.
(3) The Director-General of the State Bank of Czechoslovakia is hereby authorised, on the basis of the provisions laid down in paragraphs 1 and 2 of the Directives, to regulate in more detail the financing of the basic funds and their control, credit, payment and settlement, treasury operations and the control of the drawing-up of wage funds.
(4) By way of derogation, the Director-General of the Czechoslovak State Bank may adjust the financial management of undertakings managed by national committees as necessary.
Common provisions
(1) The Ministry's financial management results and their annual accounts are approved by the Minister for Finance. The Minister of Finance may, for serious reasons, refuse to approve the results and statements. If the Minister of Finance refuses to approve them, the Minister responsible shall submit them to the Government for consideration.
(2) The Minister of Finance shall report to the Government on the financial management of the ministries.
Final provisions
Until the relevant implementing provisions are adopted, the existing rules shall apply unless they are contrary to this law.
(1) All provisions governing matters covered by this law shall be deleted; in particular, Act No. 106 / 1951 Coll., on the Financing of National and Municipal Enterprises, with the exception of the provisions of § 14 (2), first and second sentences, and Government Decree No. 107 / 1951 Coll., implementing Act No. 106 / 1951 Coll.
(2) The provisions of Act No. 119 / 1948 Coll., on the State Organisation of Foreign Trade and International Shipbuilding, Government Decree No. 13 / 1952 Coll., on the Management of Communications, Paragraph 6 of Act No. 104 / 1950 Coll., on the Financing of National and Municipal Enterprises, and Act No. 23 / 1957 Coll., on Workers' Enterprise Funds are not affected.
This Law shall take effect from 1 January 1959; it shall be carried out by all members of the Government.
