on the budgets of the national committees.
The National Assembly of the Czechoslovak Republic decided on the following Act:
The purpose of the law.
In order to ensure the further development of the local economy and culture and to increase the responsibility of national committees for the efficient and economical issue of funds and for the collection of state revenue, a system of separate budgets of national committees forming part of the State budget is hereby established.
Basic provisions.
(1) Each national committee shall manage according to its own budget.
(2) The budgets of the national committees shall be concentrated and shall provide the means to carry out the tasks of the national committees as local authorities and to carry out the tasks of their executive and administrative bodies and shall establish the mutual financial relations of the national committees with local industry and the local economy.
(3) The budgets of the national committees are part of the state budget.
Expenses.
(1) National Committees shall finance the expenditure needed to develop local industry and the municipal economy, education, health, other tasks and the maintenance of local authorities and their executive and administrative departments. In doing so, it shall follow the national economic development plan and the programme of its other activities.
(2) National committees are required to perform their tasks as efficiently and economically as possible.
Revenue.
(1) The budget revenue of the national committees shall be:
(a) contributions from local industry and municipal enterprises;
(b) taxes on which specific rules so provide and local charges;
(c) the proceeds of national assets managed by the national committee, except as otherwise provided in specific provisions;
(d) shares in State revenue;
(e) other revenue.
(2) The Government lays down by regulation the conditions for acceptance of donations and other contributions and for the organisation of collections by national committees.
(3) National committees shall ensure that they make full use of their income resources and that they acquire new appropriate income resources in their economic activities.
Relations between local industry and the municipal economy with the budgets of national committees.
(1) The budgets of the national committees shall determine, in accordance with the State's plan for the development of the national economy, part of the profits, surplus of own resources and other contributions from local and municipal enterprises, and the allocation of such undertakings to finance investments, to increase their own funds, to cover the costs and other tasks planned. Specific rules apply to such relations.
(2) National committees must ensure that they develop and expand their economic base; ensure that businesses in the local industry and the municipal economy, adequately providing the needs of the population and providing universal local services, develop a planned development of their economic activities, reduce their own costs and expose and use hidden reserves to a safe and reliable source of budgetary revenue of national committees.
Budget balance.
(1) The national committee's budget must be balanced.
(2) The budgetary act lays down the shares in national revenue for regional budgets each year, the Regional National Committees lay down the shares in regional budgets and the Regional National Committees determine the shares in local national committees' budgets.
(3) State income shares are shown to the national committees in proportion to the proportion of the revenue collected in their respective districts.
Building budgets.
(1) The budgets of the national committees are drawn up for the same budgetary period as the national budget.
(2) The composition of the budgets of the national committees is in line with the composition of the state budget.
(3) The Government lays down the principles for drawing up the budgets of the national committees, for balancing them and for their inclusion in the State budget.
(4) The Government lays down a regulation on how national committees discuss and decide on budgets.
Implementation of national committees' budgets.
(1) National Committees shall manage according to their budgets; in so doing, it shall be governed by the provisions of the budgetary act, the provisions laid down for its implementation and the specific provisions applicable to the management of each sector of their activity.
(2) A new task which is not remembered in the national committee's budget may only be imposed on the national committee by the Government or under its authority; In doing so, the government shall take measures to ensure this task.
(3) The Government will adjust the contribution of surplus management to the national committees.
(4) The Government will determine in which cases and how the national committee may manage non-budgetary appropriations.
(5) The Ministry of Finance will adapt the directives on the right of reference, the cash service, the payment service and the monitoring of the implementation of the budgets of the national committees.
Loans and guarantees.
(1) National committees cannot conclude loans.
(2) National committees may be guaranteed only for the liabilities of subordinate undertakings and only up to an amount commensurate with their income from economic activity. the details shall be adjusted by the Ministry of Finance. National committees may be guaranteed other commitments only under specific rules.
Accounting records.
National committees shall keep accounting records of their own management and shall manage, organise and control the accounting records of subordinate entities. The payment of shares in State revenue may be made subject to this obligation.
Supervision.
Supervision of the implementation of the budgets of national committees shall be carried out by national higher-level committees and by the Ministry of Finance, in their field of competence also by the competent central authorities.
Repeal clause.
Act No. 279 / 1949 Coll., on the Financial Management of National Committees, is hereby repealed. Government Decree No. 90 / 1950 Coll., on the Management of National Assets by National Committees, remains in force; the government may revoke them by decree.
Efficiency and execution.
This Act shall take effect on 1 January 1953; by the Minister for Finance and other members of the Government.
