on the organisation of machinery and tractor stations.
The Government of the Czechoslovak Republic, with the agreement of the President of the Republic pursuant to § 42 (1) of Act No. 241 / 1948 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the Five-Year Plan):
§ 1.
In order to better and more effectively assist machinery and tractor stations in the transition of the village to socialism, to make more economical use of agricultural machinery and to increase the production capacity of agriculture, their new organisation is being adapted.
§ 2.
(1) Individual national undertakings (hereinafter referred to as "undertakings") shall be established from the various machinery and tractor stations and from other separate balance sheets of the production and sales units of the national holding of the Centre for Agriculture Mechanisation on 1 January 1952. The Minister for Agriculture shall determine in agreement with the Minister for Finance the extent of the initial assets of the undertakings. The provisions on national industrial undertakings shall apply mutatis mutandis to undertakings, unless otherwise provided for in this Regulation.
(2) The Organisational Regulations (statutes) of undertakings shall be issued by the Ministry of Agriculture by an order in an official certificate.
(3) The company is designated according to the nature of the business, for example "Machinery and tractor station in.........., national enterprise."
§ 3.
The director is the head of the business. The Director shall be appointed and dismissed by the Minister for Agriculture after hearing the Regional National Committee.
§ 4.
The Regional National Committees shall monitor and control the activities of enterprises, assist them in the performance of their tasks, alert them in good time to any defects and deficiencies and help them to overcome them.
§ 5.
(1) In the agricultural reports of the Regional National Committees, a department for the mechanisation of agriculture is set up to manage, plan and control the operation of machinery and tractor stations. The Head of Department shall be appointed by the Regional National Committee. The head of the department shall be subordinate to undertakings in the district. The Head shall direct their activities as directed by the Ministry of Agriculture and the Regional National Committee.
(2) The head of the holding shall be subordinate and personally responsible to the head of the Agriculture Mechanisation Unit of the Regional National Committee's agricultural report.
(3) The Ministry of Agriculture may subject an undertaking, given the nature of its business, directly to the main administration of machinery and tractor stations (§ 6).
§ 6.
(1) The undertakings are subordinate to the management and supervision of the State carried out by the Ministry of Agriculture. The main management of machinery and tractor stations as the production department of the Ministry of Agriculture and the regional administration of machinery and tractor stations as the production department of agriculture shall be established for the performance of this activity, in particular for the national management, planning and control of undertakings.
(2) The main (regional) administration carries out its activities in principle through the Regional National Committee.
§ 7.
(1) The Ministry of Agriculture or, under its authority, the Regional National Committee may allocate the assets or liabilities entrusted to the administration of an undertaking and include them in another undertaking. The Minister for Agriculture may include other national assets in the enterprise. If such property falls within the competence of another minister, it shall be incorporated into an agreement with that minister.
(2) The Minister for Agriculture may remove or transfer from the holding assets or liabilities in his own field of activity or in agreement with the Minister responsible to take measures in his own field of activity.
(3) The measure referred to in paragraphs 1 and 2 shall not be necessary where undertakings have agreed between themselves or with other national undertakings on the transfer of the assets they manage of the smaller values which are intended for permanent use. Such an agreement has the effects of disintegration after inclusion. The amount of the value applicable to transfers under this paragraph shall be determined by the Minister for Agriculture in agreement with the Minister for Finance and the other Ministers involved.
§ 8.
(1) The Minister for Agriculture may, in agreement with the Minister for Finance, set up other undertakings from national assets; If such property falls within the competence of another minister, such measures shall also be made in agreement with that minister.
(2) The Minister for Agriculture may cancel the undertaking in agreement with the Minister for Finance. In that case, it shall determine how the assets of the undertaking cancelled are to be dealt with.
§ 9.
Measures taken in conformity with the provisions of this Regulation before its effect shall be deemed to have been taken under this Regulation as from the date of the measure.
§ 10.
(1) On 1 October 1951, the national undertaking shall enter into liquidation at the Centre for the Mechanisation of Agriculture. The object of such liquidation shall be assets and liabilities which shall not be incorporated into the initial assets of individual undertakings and which shall be determined by the Minister for Agriculture in agreement with the Minister for Finance. Disposal shall be carried out by a liquidator appointed by the Minister for Agriculture. Liquidation surpluses or deficits will be transferred to the National Economy Fund with the approval of the Minister for Agriculture in agreement with the Minister for Finance. The liquidator shall carry out the liquidation with the assistance of the staff designated by the Minister for Agriculture in agreement with the Minister for Finance; the period until which liquidation is to take place shall be fixed accordingly. On completion of the liquidation, the liquidator shall propose the deletion of the national enterprise of the Department for Agriculture Mechanisation in the Company Register.
(2) On 1 October 1951, the main administration takes over the responsibilities of the former Central Directorate and the powers of the Regional Inspectorate are taken over by the Regional National Committees (Agriculture Mechanisation Division), unless the Minister for Agriculture has taken other measures. The functions of the Director-General (Regional Director) and the Central Directorate (Regional Directorate) and Regional Inspectorate (Regional Inspectorate) are hereby repealed.
(3) Until the establishment of the undertakings, the existing undertaking shall be managed in such a way as to ensure proper operation; In doing so, all components will be managed by the current national enterprise by the end of 1951 under the draft financial and production plan for 1951. The costs of the main administration and department for agricultural mechanisation in the agricultural report of the Regional National Committees will be reimbursed from the state budget.
§ 11.
The provisions of Act No. 27 / 1949 Coll., on Agriculture Mechanisation, are hereby repealed if they contravene this Regulation; In particular, Sections 2, 3, 4, 7 and 8, Sections 9 (1), (2), (4) and (5) and Sections 10 to 14, 16 and 17 are deleted.
§ 12.
This Regulation shall enter into force on 1 October 1951; they shall be carried out by the Minister for Agriculture in agreement with the participating members of the Government.
