Law on the establishment of a fund to mitigate damage caused by exceptional drought in 1947 in the field of agriculture and nutrition

setting up a fund to mitigate the damage caused by exceptional drought in 1947 in the field of agriculture and nutrition.
The Constitutional National Assembly of the Czechoslovak Republic decided on this law:
§ 1.
In the Ministry of Finance, a fund is set up to mitigate the damage caused by exceptional drought in 1947 in the field of agriculture and nutrition (in the next "Fund '). It is managed by the Minister of Finance. The fund shall be kept accounting separately from the other state economy. His financial statements containing special accounts for Czech countries and special accounts for Slovakia shall be annexed to the State's final account.
§ 2.
Revenue accruing to the Fund
(a) pursuant to the Act of 31 October 1947, No 185 Coll., on an exceptional one-off levy and on an exceptional levy on excessive gains in property, provided that the proceeds of benefits do not flow into the Monetary Liquidation Fund;
(b) pursuant to the Act of 31 October 1947, No 200 Coll., on the subject tax of the necessary needs (luxury tax),
(c) other measures laid down by specific provisions.
§ 3.
(1) The following shall be paid from the Fund:
1. exceptional charges
(a) for the purchase of the following crop products from the 1947 harvest: cereals (including certified seed), leguminous vegetables, oil seeds (including seeds), maize (including seed), potatoes (including recognised seed), late vegetables, dried leaves of root peppers, sugar beet and green chicory;
(b) the buying-in prices for beef and pigmeat and milk and rustic butter delivered during the 1947 / 48 marketing year;
(c) to cover the costs of reducing consumer prices for piglets and pig meat intended for direct consumption in a raw or smoked state;
2. transport costs associated with the exceptional transport of bulk feedingstuffs by expensive or motor vehicles;
3. expenditure relating to exceptional measures to eradicate potato mandrel;
4. the differences between the prices of imported seeds and seed of potato, bread grain, fodder, oilseeds (raw materials for the production of edible fats), vegetables and potatoes from the 1947 harvest, meat, fat and slaughter cattle and their domestic prices;
5. aid to farmers who, for exceptional drought, could not carry out any crop on the prescribed contingent, or did not carry out only a small amount, up to the sum of CZK 500,000,000 under the guidelines laid down by the Government;
6. Partial compensation of up to 12,000.000 CZK to those farmers who either could not carry any maize at all for the prescribed contingent or had carried out only a small quantity in relation to deliveries in normal years;
7. commitments under the guarantee provided by the Minister for Finance for loans to farmers for the loss and damage of the sale of beef and veal and for losses and losses incurred by agricultural cooperatives in the purchase, transfer and sale of piglets and pigs to farmers for credit. Compliance with these obligations shall be carried out according to the content of the guarantee documents;
8. losses of up to 30,000.000 CZK incurred by death, disease and animal injury, either during the transfer or for other reasons caused by drought, unless such losses are covered by insurance.
(2) The Government shall, by way of a resolution, determine the amount of the extraordinary premium to be paid to the purchase prices of plant and animal products and other transactions referred to in paragraph 1, as well as the conditions under which all such transactions are to be granted and shall adjust the way in which they are to be granted. The detailed directive shall be issued by the competent member of the Government, or by the authority entrusted to it, as appropriate.
(3) Where farmers are supplied with crops on the basis of their own supply of crops for which an exceptional purchase price surcharge has been paid, the competent minister may, if within the limits of his or her competence, decide, in agreement with the participating members of the government, that the delivery will take place only if the farmer returns the exceptional premium in full or in part. The authorities carrying out the supply of the crops referred to in the preceding sentence shall collect the relevant amounts of exceptional surpluses returned and carry them out to the Fund.
§ 4.
The Government may provide that exceptional surcharges are also granted for the purchase of prices for plant and animal products other than those referred to in § 3, par. 1, No 1.
§ 5.
(1) The Minister of Finance may provide the Fund with cash advances from the Treasury, provided that the funds necessary for the performance of its tasks set out in Article 3 are provided by credit operations.
(2) The funds provided under paragraph 1 shall be returned by the Fund to the Treasury with appropriate interest.
§ 6.
(1) Fulfilment from the Fund must be requested by the end of 1948, with the exception of the transactions referred to in § 3 (1), (1), (1), (2) and (6) which must be requested no later than the end of July 1948.
(2) On completion of the Fund's operations, the balance of the Fund shall be transferred to the Treasury.
§ 7.
This law shall take effect on the date of its publication, but where measures corresponding to its provisions have been taken before its effectiveness, those measures shall be deemed to be effective under it; It shall be implemented by finance, agriculture and nutrition ministers in agreement with the participating members of the Government.
