Decree amending Decree No. 100 / 2018 Coll., on the technical competence and periodic technical examinations of military vehicles

DECLARATION
of 7 April 2022
amending Decree No. 100 / 2018 Coll., on the technical competence and periodic roadworthiness tests of military vehicles
The Ministry of Defence provides for the Act No. 219 / 1999 Coll., on the Armed Forces of the Czech Republic, as amended by Act No. 546 / 2005 Coll. and Act No. 46 / 2016 Coll.:
Čl. I
Decree No. 100 / 2018 Coll., on the technical competence and periodic roadworthiness tests of military vehicles, is amended as follows:
1. In Article 2 (h), the words "dissectable 'are deleted.
2. In Article 2, at the end of point (n), the dot is replaced by a comma and the following points (o) and (p) are added:
"(o) an off-road military vehicle of a military vehicle having specific technical characteristics enabling its use outside normal roads;
(p) by checking the technical condition of a military vehicle, its systems, components and separate technical units and their environmental performance in order to detect or eliminate the defects set out in Section 26. ';
3. The heading of Part Two shall read: "SPECIES AND CATEGORIES OF MILITARY VEHICLES AND OF MILITARY INSTALLATIONS."

„§ 5
The categories of military combat vehicles shall be subdivided into the following specific categories:
(a) military combat vehicles on a belt chassis with a weapon assembly to conduct combat activity (category VBV-PBP);
(b) military combat vehicles on a belt chassis with a special purpose superstructure which does not serve to conduct combat activity directly (category VBV-PSP);
(c) military combat vehicles on wheeled chassis with a weapon assembly to conduct combat activity (category VBV-KBP); and
(d) military combat vehicles on wheeled chassis with a special purpose superstructure which does not serve to conduct combat activity directly (category VBV-KSP). ';
5. In Article 6, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The field military vehicle of category VM or VN shall be marked with the letter" G "after the letter and the figure identifying the category of military vehicle. ';
6. In Article 7, at the end of point (d), the dot is replaced by a comma and the following point (e) is added:
"(e) a military trailer on a wheeled or belt chassis which serves to carry out rescue work or special tasks within the armed forces (VZV-VO category)."
7. In Article 7, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) An off-road military vehicle of category KZP or SKP shall be marked with the letter" G "after the letter identifying the category of military vehicle. ';
8. The following Section 8a is inserted after Section 8:
„§ 8a
Types of military bodies
Military superstructures are divided into:
(a) a fixed military superstructure (VNP) which is manufactured separately from a military vehicle and is assembled with a military vehicle in primary production or in multi-stage production;
(b) military replacement replacement (VVV), which is a separate technical unit with a basic military vehicle, as the carrier of the swap bodies, in a detachable connection. "
9. Paragraph 11 (5), including footnote 9, reads:
"(5) When type-approval of a type of military vehicle is granted, the military police shall determine whether the military vehicle will be equipped with a table bearing the military registration plate or the military registration plate will be marked otherwise; If the Military Police provide that a military vehicle shall not be equipped with a plate bearing a military registration plate, they shall at the same time determine the method of its other marking. The table with the military registration plate shall be placed on the military vehicle in a similar manner to the registration plate on the road vehicle (9). If the design of a military vehicle does not permit such a location of a military registration plate, the Military Police shall, when approved by the type of military vehicle, determine its other location on a military vehicle. The other location of the military registration plate shall be entered in the technical licence of the military vehicle.
9) Articles 32 and 33 of Decree No 343 / 2014 Coll., on Vehicle Registration, as amended. '
10. The heading of Section 13 reads: "Approval of the technical competence of a type of military vehicle conversion."
11. In Paragraph 14, the sentence "This provision shall not apply to the installation of a military superstructure in exchange shall be added at the end of paragraph 2. ';
12. in Paragraph 25 (4), the word "mass" shall be inserted after the words "vehicles for."
13. Paragraph 26, including the title and footnote 10, reads as follows:
„§ 26
Presumption of technical incompetence of a military vehicle
(1) Technically ineligible is a military vehicle which shows defects which threaten road safety; a technically ineligible military vehicle may only be used in road traffic for emergency milking under the Road Traffic Act.
(2) The obstacle to road safety referred to in paragraph 1 is:
(a) damage to glass of glazing, periscopes or projections from a military vehicle which reduces the driver's vision to such an extent that the safety of the driving of a military vehicle or the method of attachment or condition of damage to the glazing is immediately jeopardised by the persons being transported;
(b) if wear of the belt movement system exceeds the permissible limit specified by the manufacturer; or
(c) a dangerous defect in accordance with the legislation governing the carrying out of roadworthiness checks (10).
(3) The military police are entitled to prohibit the technically unfit military vehicle referred to in paragraphs 1 and 2 from operating on the road and to retain for it a certificate of the technical licence issued by the armed forces.
10) Annex No 1 to Decree No. 82 / 2012 Coll., on the carrying out of checks on the technical condition of vehicles and combinations in use on the road (Ordinance on technical roadside checks), as amended. '
14. in Article 27 (e), "4" is replaced by "3."
15. Paragraph 28, including the title and footnote 11 to 13, reads as follows:
„§ 28
Performing periodic roadworthiness tests
(1) Regular technical inspections of military vehicles shall be carried out within the scope of selected inspection operations, within the deadlines laid down for road vehicles by other legislation11) at ministerial or technical inspection facilities (12).
(2) The conduct of periodic roadworthiness tests for military vehicles shall cover military security vehicles and military vehicles equipped with a special blue warning light.
(3) When carrying out the periodic roadworthiness tests of military vehicles referred to in paragraph 2, inspection operations related to emission measurement shall not be carried out nor shall vehicle presence documentation (13) be provided at the technical inspection station.
(4) For military vehicles for which there is no obligation to undergo periodic roadworthiness tests pursuant to paragraph 2, the Ministry shall provide for the provision of roadworthiness tests.
11) Paragraph 40 of Act No. 56 / 2001 Coll., on the Terms and Conditions of the Operation of Vehicles on the Road and on the Amendment to Act No. 168 / 1999 Coll., on the Insurance of Liability for Vehicle Operation and on the Amendment to Certain Related Acts (Act on the Insurance of Vehicle Liability), as amended by Act No. 307 / 1999 Coll.
12) Article 54 of Act No. 56 / 2001 Coll., on the Terms and Conditions of Operation of Vehicles on the Road and on the Amendment to Act No. 168 / 1999 Coll., on Insurance of Liability for Vehicle Operation and on the Amendment to Certain Related Acts (Act on Insurance of Vehicle Liability), as amended by Act No. 307 / 1999 Coll.
13) Articles 2 and 12 (1) (a) of Decree No. 211 / 2018 Coll., on vehicle roadworthiness tests, as amended by Decree No. 303 / 2020 Coll. '.
Čl. II
Transitional provision
Military vehicles of categories VM, VN, KZP and GMP which have specific technical characteristics enabling their use outside normal roads and have been introduced into the armed forces before the date of entry into force of this Decree shall be considered as off-road military vehicles as from the date of entry into force of this Decree.
Čl. III
Efficacy
This Decree shall take effect on 1 July 2022.
