On 8 July 1985, the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the German Democratic Republic on cooperation in the research, development and production of machinery for the construction of railway tracks, switches and rationalisation vehicles for transport was signed in Prague, as well as on their mutual supply. The Agreement entered into force on the date of signature of Article 15 thereof.

AGREEMENT
between the Government of the Czechoslovak Socialist Republic and the Government of the German Democratic Republic on cooperation in the research, development and production of machinery for the construction of railway tracks, switches and rationalisation vehicles in transport as well as on their mutual supply
the Government of the Czechoslovak Socialist Republic and the Government of the German Democratic Republic (hereinafter referred to as the "Contracting Parties'),
within the meaning of the principles of the Treaty of Friendship, Cooperation and Mutual Assistance between the Czechoslovak Socialist Republic and the German Democratic Republic of 3 October 1977,
in accordance with the principles of the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the German Democratic Republic on cooperation in the field of rail transport of 23 June 1972,
in accordance with the General Conditions for carrying out scientific and technological cooperation between the Czechoslovak Socialist Republic and the German Democratic Republic, adopted at the XXIV meeting of the Joint Committee on Economic and Scientific and Technical Cooperation between the Czechoslovak Socialist Republic and the German Democratic Republic on 17 February 1982,
building on the objectives of specialisation and cooperation to meet to the broadest extent the needs of the national economies of the Czechoslovak Socialist Republic and the German Democratic Republic with efficient railway construction machines and other railway construction technology and to benefit from mutually beneficial scientific and technical cooperation in this field,
they have agreed as follows:
The Contracting Parties shall ensure through their competent authorities and organisations:
1. the planned coordination of research, development, further development and production of modern machines for the construction and maintenance of rolling equipment and snow removal techniques;
2. the production of such machinery in volumes that satisfy, to the greatest extent possible, the needs of the Contracting Parties;
3. the implementation of agreed general repairs and replacement parts needed for the maintenance of such machines;
4. the unification of selected switches structures in order to extend the possibilities of mutual supply;
5. carrying out scientific and technological cooperation during the period of validity of this Agreement;
6. mutual supply of rationalisation means of own production of the transport department.
The Contracting Parties shall ensure, through their competent authorities and their organisations, the development and production of machinery and equipment for the construction and repair of rolling stock, snow removal techniques, as well as the unification of selected switches structures on the basis of mutually agreed technical conditions, with the aim of achieving the highest scientific and technical level.
The work provided for in this agreement is ensured by the Czechoslovak Socialist Republic
Federal Ministry of Transport,
by the German Democratic Republic
Department of Transport.
The Parties shall ensure, through their competent authorities, the acceptance of commitments under this Agreement in the Protocols on the Coordination of Prospective Plans as well as in the Agreements and Annual Protocols on the Exchange of Goods between the Czechoslovak Socialist Republic and the German Democratic Republic.
1. In order to carry out the tasks set out in Article 1 of this Agreement, the competent authorities and the organisations of the Contracting Parties shall ensure the specialised development, production and supply of powerful machinery and equipment for the construction and maintenance of rolling stock, as well as the snow removal techniques referred to in Annexes 1, 2 and 3 to this Agreement, including the supply of spare parts necessary for the operation of the delivered machinery and equipment, as well as commercial technical services.
2. Commercial technical services for delivered machines and equipment are provided according to the service contract.
The Contracting Parties shall, through their competent authorities and organisations, organise cooperation to extend the mutual supply of rationalisation equipment produced in the Transport Department on the basis of a long-term exchange agreement.
Joint scientific research, design and design work on the topics listed in Annex 3 to this Agreement shall be carried out in accordance with a work programme agreed between the competent authorities of the Contracting Parties within six months of the signature of this Agreement.
Cooperation on the work programme referred to in Annex 3 to this Agreement shall be carried out on the basis of contracts to be concluded between the organizations of the Parties authorised to conduct foreign trade.
All types of machines planned to be delivered to the other Party in the framework of cooperation shall either be before the start of series production (prototype as referred to in Annexes 1 and 2) or before the start of the operations of the other Party. The details shall be agreed between the relevant organisations of the Contracting Parties in specific economic contracts.
1. The mutual supply of machinery, equipment and accessories, as well as the required performance, shall be carried out on the basis of contracts concluded between the relevant organizations of the Contracting Parties authorised to operate abroad.
2. The prices of products and performance intended for mutual supply under this Agreement shall be agreed between the organisations entitled to foreign trade activities on the basis of principles and price-setting methodology, as well as the recommendations of the RVHP bodies, including the Price Type Article and the bilateral conventions, which are valid within the relevant delivery period. The commitments of the relevant organizations of the Contracting Parties authorised to engage in foreign trade activities in the field of supplies and performance shall enter into force after the conclusion of the price contracts.
3. For products that are at such a stage of development that it is not possible to establish foreign trade prices before the signature of this Agreement, foreign trade prices of an organisation authorised to operate abroad shall be determined one year before the start of the series production.
1. The results of the scientific and technical work and of the work to improve the technology achieved in cooperation under this Agreement without the participation of the experts of the competent authorities and organisations of the other Contracting Party and without the use of their scientific and technical data are, as well as the inventions and acquired knowledge of production and experience (know-how), owned by the Party whose experts have achieved these results. The other Contracting Party may obtain the right to benefit from these results, inventions and production knowledge and experience under conditions agreed by the competent authorities and organisations of the Contracting Parties.
2. The scientific and technical results and the "know-how" generated by the participation of both Parties or using the scientific and technical data of the other Party shall be joint results.
3. The granting of licences for the use of joint inventions, as well as the production knowledge and experience acquired during the period of cooperation and technical and other data to a third party may take place only by mutual agreement of the competent authorities and organisations of the Contracting Parties.
4. The cooperation in the field of legal protection of scientific and technical results achieved in the course of the work envisaged by this Agreement shall take place under the Treaty on the legal protection of inventions, industrial and commercial models and trade marks in the course of economic and scientific and technological cooperation of 12 April 1973.
5. The competent organisations of the Contracting Parties shall ensure the legal integrity of the products supplied or the results of scientific and technical work submitted as regards third-party rights in the territory of the other Contracting Party.
The competent authorities and the organisations of the Contracting Parties shall ensure the necessary secrecy of the research and development work carried out under this Agreement, as well as the materials and documentation submitted to each other. The results of research, development and construction work carried out under this Agreement, as well as their partial results, may be published only on the basis of mutual agreement between the competent authorities and the organisations of the Contracting Parties.
The export of products supplied under this Agreement and the surrender of joint scientific and technological cooperation results to a third party may take place only with the written consent of the competent authority of the other Party.
1. The competent organisations of the Contracting Parties shall enter into specific conventions for general repairs of exported machinery, which shall be updated annually.
2. The relevant Contracting Parties' organisations shall exchange against payment of scientific and technical results and experience gained in the maintenance of track construction machinery as well as their structural groups and parts in the rationalisation of repair operations.
3. The competent authorities and the organisations of the Contracting Parties shall ensure cooperation in the production and regeneration of imported spare parts and exchange experience gained.
The competent authorities of the Contracting Parties shall ensure cooperation between organisations to unify selected switches structures in order to extend the possibilities of mutual supply.
1. This Agreement shall enter into force on the date of its signature and shall be concluded for a period expiring on 31 December 1990. It shall be renewed for a further period of five years, unless one of the Contracting Parties denies it in writing no later than two years before the expiry of the period of validity.
2. When this Agreement is extended, the competent authorities of the Contracting Parties shall agree on a programme of scientific and technological cooperation, a list, volumes and deadlines for the reciprocal supply of machinery, design nodes and components for the following period no later than 12 months before the start of the new period of validity of the Agreement.
3. This Agreement may be amended and supplemented by written agreement of the Parties.
4. Annexes 1, 2 and 3 are an integral part of this Agreement.
This agreement was drawn up on 8 July 1985 in Prague in two copies, each in Slovak and German languages, the two texts being equally authentic.

The Party of the German Democratic Republic shall specialise in:
Multi-spindle turning machines and compaction machines between sleepers as auxiliary and normal vehicles with special mode of operation,
medium and small sleepers,
mean track measurement technique;
Gravel delivery system.
