DECLARATION
Ministry of Foreign Trade
of 27 July 1962
on the customs exemption of articles imported for the use of persons and bodies enjoying privileges and immunities in the Czechoslovak Socialist Republic
The Ministry of Foreign Trade provides in agreement with the Ministry of Foreign Affairs and Finance pursuant to § 38 and 54 of Customs Act No. 36 / 1953 Coll.:
(1) Articles imported for the heads of diplomatic representative offices operating in the Czechoslovak Socialist Republic (Ambassador, Ambassador, Chargés d'Affaires) and for other diplomatic persons assigned to those offices (Councils, Secretaries, Attaché, Military, Commercial and Other Allowances and Secretaries-Archives), and for the heads of effective consular offices of foreign States operating in the Czechoslovak Socialist Republic and their representatives (Consumers General, Consul, Vice-Consul), provided that they are consular officials of the profession and are not Czechoslovak citizens, shall be exempt from customs duties and replacement tax on turnover, provided that they are used for their own needs or for members of their families residing in their household.
(2) General customs provisions apply to the customs exemption of travel goods, removal of uppers and articles made redundant without the customs inspection of the persons referred to in paragraph 1. *)
(1) Articles imported for diplomatic and efficient consular offices in the Czechoslovak Socialist Republic are exempt from customs duties and replacement tax on turnover, provided that they are used for official use by these authorities.
(2) The customs exemption provided for in paragraph 1 shall also apply to the facilities of newly established diplomatic and effective consular offices and imported building and other material intended for the repair of the buildings in which they are located.
Under the conditions set out in Sections 1 and 2, articles imported for international organisations operating in the Czechoslovak Socialist Republic and their members and workers shall be exempt from customs duties and replacement sales tax if they enjoy privileges and immunities under special contracts.
If the conditions under which the customs exemption of items imported for persons, authorities and bodies enjoying privileges and immunities in the Czechoslovak Socialist Republic are not fulfilled, such articles shall be stuffed on a flat-rate basis. *)
(1) The customs procedure and inspection of the imported goods shall be carried out on an oral basis, supported by a confirmation by the addressee, where appropriate, of the head office or organisation for which the consignment is intended to be used for the purpose of the addressee's or members of his family residing with him in the common household, or for official use, as the case may be.
(2) Only a person entitled to a customs exemption may issue a certificate in order to obtain an exemption under Paragraph 1 (1).
In the absence of reciprocity in whole or in part, the customs exemption provided for in this Order may be excluded or reasonably limited to that State.
(1) Customs exemption under this Order shall be decided by the customs office nearest the place of residence or the seat of the authority to which the customs exemption is granted.
(2) Customs duties may be refused where articles are imported in quantities manifestly disproportionate to the own needs of the persons referred to in Article 1 or the official need referred to in Article 2.
Decree No 168 / 1954 of the Minister for Foreign Trade No l. (193 / 1954 Ú. v.) on the customs exemption of articles imported for the needs of persons and bodies enjoying privileges and immunities in the Czechoslovak Republic is hereby repealed.
This Decree shall take effect on 1 September 1962.
