The Government of the Czechoslovak Socialist Republic orders pursuant to § 13 (5) and § 14 (6) of Act No. 44 / 1988 Coll., on the Protection and Use of Mineral Wealth (Upper Law):

ČÁST PRVNÍ

CONDICATIONS
§ 1
General and special condition and their determination
(1) The general condition shall be established for the evaluation and calculation of the stocks of reserved mineral deposits and those non-reserved mineral deposits which are suitable for the needs and development of the national economy ("exclusive bearing") at the stage of the search and preliminary survey. The general condition shall be determined in accordance with current technical and economic conditions, taking into account the foreseeable conditions for the extraction of mineral material in the long term from domestic sources or abroad.
(2) The special condition shall be determined for the evaluation and calculation of stocks of the exclusive bearing or part thereof at the stage of the detailed and extractive survey as well as for the management of stocks of the exclusive bearing. If necessary, special condition may also be established for the evaluation and calculation of stocks of the exclusive bearing or part of it at the stage of the preliminary or search bearing survey. The special condition shall be determined for the bearing or part thereof according to the geological and mining conditions of the bearing and the technical possibilities for conquest, treatment and processing of the mineral in accordance with the current technical and economic conditions of extraction of the mineral material from indigenous sources or abroad. Special condition must ensure rational use of the exclusive bearing.
§ 2
Conditioning indicators
(1) For the inclusion of stocks of the exclusive bearing or part of it (body, floor, block) into stocks of balance sheet or non-balance sheet (Section 6), the following parameters of condition shall be used according to the type of mineral and the nature of the bearing:
(a) the minimum quantity of balance sheet stocks and, for deposits of liquid and gaseous minerals, the minimum inflows per well;
(b) the minimum average content of the commercial components and the maximum average content of the harmful components;
(c) the minimum content of the commercial components and the maximum content of the harmful components in the marginal sample which may still be included in the balance sheet or non-balance sheet stock gauge;
(d) the minimum average content of the commercial components and the maximum average content of the harmful components in the peripheral part, which may be included in the balance sheet or non-balance sheet stock outlay;
(e) the requirements for chemical-technological and, where appropriate, physical mechanical properties of the mineral;
(f) the minimum strength of the bearing (layer, fold or vein), or in relation to its inclination,
(g) the maximum depth of the deposit of the bearing in deep-sea conquest or the maximum hiding ratio in surface conquest;
(h) the maximum power of deaf rock inserts or inserts not complying with condition indicators which are still included in the balance sheet stock gauge.
(2) In addition to the conditioning indicators referred to in paragraph 1, additional conditioning indicators necessary to assess the suitability of the stocks of the exclusive bearing or part of it for use shall be used, where appropriate, to determine how the individual indicators are recalculated.
(3) Mineral quality indicators and, where appropriate, their technological characteristics may also be established by reference to technical standards.
§ 3
Processing of conditioning design
(1) The preparation of the draft general condition is ensured by the central authority of the State administration responsible for determining the general condition of the organisation.
(2) Processing of the design of special condition is provided by the administrator or permanent user of the exclusive bearing. If the management of the exclusive bearing is an organization performing its survey, it processes the design in conjunction with the organisation that will use the exclusive bearing.
(3) The administrator or, where applicable, the permanent user of the exclusive bearing, shall process the design of the new special condition of the exclusive bearing or part thereof if the mining, processing or economic conditions of its use change, in particular as a result of new knowledge on bearing development, changes in production costs, prices or cost limits.
(4) The cost limits set binding maximum production costs where the extraction of mineral materials from domestic bearings is still nationwide economically effective.
(5) Proposals of condition must be technically and economically justified. They shall be processed in variants as required.

GENERAL CLASSIFICATION OF EXERCISE ITEMS
§ 4
Stocks of the exclusive bearing
(1) The stocks of the exclusive bearing (hereinafter referred to as "stocks") are the determined and verified amounts of minerals of the bearing or part of it, regardless of the losses in conquest.
(2) Undetected and unverified minerals, the existence of which are only expected to exist, are prognous sources. The classification of forecasting resources is regulated by a separate regulation.1)
§ 5
Stock categories
(1) According to the degree of examination of the exclusive bearing or part of it and the knowledge of its storage conditions, the quality and technological properties of minerals and mining conditions shall be classified as categories A, B, C1 and C2 under the conditions set out in the Annex to this Regulation.

Balance sheet and non-balance sheet stocks
(1) According to the suitability for economic use, stocks are classified on the basis of balance sheet stocks and non-balance sheet stocks.
(2) Balance stocks are stocks that are currently available. They meet the current technical and economic conditions of use of the exclusive bearing.
(3) Non-balance sheet stocks are stocks which are currently unusable because they do not comply with the current technical and economic conditions of use, but are available in the future in view of the expected technical and economic developments or the expected change in the mining technical conditions of use of the exclusive bearing.
§ 7
Stocks free and tied
(1) According to the acceptability of conquest, conditional on conquest technology, safety of operation and established safety pillars, stocks are classified as free and bound stocks.
(2) Bound stocks are stocks in the protection pillars of surface and underground structures, installations and mining works, as well as in the pillars set out to ensure the safety of operation and the protection of protected interests. Other supplies are available.
§ 8
Eligibility of stocks of exclusive bearing for use
(1) The classification of stocks into categories, their breakdown into balance sheet and non-balance sheet stocks and stocks free and bound is a basis for assessing their eligibility for use.
(2) The required quantity of balance sheet stocks, the ratio of their categories and other conditions for the preparation of the exclusive bearing or part thereof for investment and other economic activities, according to the complexity of the exclusive bearing, its geological structure and the regularity of the distribution of its commercial and harmful components, or, where appropriate, to the development of the collector's rocks by a special regulation. 2)

ASSESSMENT, APPROVAL AND STATE EXPERTISATION OF THE CALCULATION OF THE BASIS OF EXEMPTIONS
§ 9
The stock calculation shall be submitted for assessment, approval and state expertise of the sole bearing manager and, in the case of an exclusive bearing submitted to the permanent use of its permanent user, unless the submission is reserved by the authorities under the responsibility of the administrator or permanent user.
§ 10
(1) The Commission for the Classification of Stocks of Mineral Resources ("the Commission") carries out a state expert on the accuracy of the calculation of stocks of the exclusive bearing in the following cases:
(a) in the case of a transfer of sole bearing management, where agreed upon by the authorities in whose jurisdiction the submitting and receiving organisations fall,
(b) for an examined exclusive bearing prepared for the investment construction of a mine or quarry, a plant or processing plant,
(c) in the case of an examined exclusive bearing serving as a base for determining the conquest space;
(d) where, as a result of new special conditions (Section 1 (2)) or new knowledge of the development of the exclusive bearing, the stock levels assessed by the Panel have changed substantially and the processing of the new calculation has been imposed on the administrator or, where appropriate, on the permanent user of the exclusive bearing, by the central authority under whose responsibility the AIFM or the permanent user belongs;
(e) in the case of a deposit of a dedicated mineral with an end-of-mining activity, if the stocks are not obtained;
(f) for an exclusive bearing designated by the relevant central planning body to assess the supporting documents for the security of national economic development plans.
(2) The Commission may request the opinion of the Central Geological Authority of the Republic or of the Central Authority under whose responsibility the stocks are to be used for the calculation of stocks submitted and, where appropriate, propose to it to examine the conditions.
§ 11
(1) The deadline for carrying out the State expert on the accuracy of the calculation of the stocks of the commissions is a maximum of six months after its submission (supplement).
(2) The deadline for submitting the opinion requested by the Commission pursuant to Article 10 (2) is 30 days after its request.

§ 12
This Regulation shall enter into force on 1 July 1988.

CONDITIONS FOR THE ARRANGEMENT OF CATEGORIES
I. Category A stocks
1. Category A shall be classified in stocks with:
1.1. Specially known storage and structurally tectonic conditions, the shape and dimensions of the exclusive bearing (its part), with the definition of deaf sections and sections not corresponding to the condition indicators, as well as the course and amplitude of disturbances affecting their achievement; for deposits of liquid and gaseous minerals, the nature of changes in the collector's properties of the productive horizon, saturation and permeability of collectors is also known;
1.2. Species and technological types of mineral materials are identified and spatial, and their mineralogical and petrographic composition, quality and technological properties are determined and detailed, with the distribution and definition of the commercial and harmful components which affect their use;
1.3. Techniques for their treatment, processing, or processing, ensuring the rational use of the mineral, as appropriate, have been verified in an operational manner;
1.4. The geological and bánktechnical (hydrogeological, engineering-geology etc.) factors affecting the conditions of conquest with detail enabling rational and safe conquest of the exclusive bearing; for bearings of liquid and gaseous minerals, the dependency of drilling productivity to change pressure is also verified.
2. Category of stocks A is defined for solid mineral deposits of wells, mine parts and unveiling, the results of which correspond to the condition indicators; For deposits of liquid and gaseous minerals, the wells showing industrial inflows are defined and extrapolated to the limits of their production distance, provided that the geological assumptions are confirmed by the results of geophysical work.
II. Category B stocks
1. Category B includes stocks with:
1.1. Details of the dimensions, basic particularities and variability of the shape, internal structure and storage conditions of the exclusive bearing (its parts) with a basic definition of the deaf sections and sections not corresponding to the condition indicators, as well as the course and amplitude of the failures affecting their accomplishment; for deposits of liquid and gaseous minerals, the nature of changes in the collector's properties of productive horizons and their saturation is also known;
1.2. Specify and define in the main features the types and technological types of mineral with the determination of their mineralogical and petrographic composition, quality and technological properties and the nature of the distribution of commercial and harmful components which affect their use;
1.3. Semi-operationally verified technological processes for their processing, processing or processing, where appropriate, to ensure the rational use of the mineral;
1.4. Known geological and mining (hydrogeological, engineering, geological etc.) factors affecting rational and safe conquest of the exclusive bearing.
2. For solid mineral deposits, the stock coverage of category B shall be defined by wells, mine parts and unveils, the results of which correspond to the condition indicators. The stock coverage of category B may exceptionally be extrapolated from these wells, mining works and unveiling, provided that the bearing is regularly developed up to a maximum of a third of their distance, provided that there are geological assumptions. The stock coverage of category B shall be defined for liquid and gaseous mineral bearings by wells with positive carotage measurement results, of which at least two wells exhibit industrial inflows and shall be extrapolated up to a maximum production distance from the wells where geological assumptions are made, in particular if the results of geophysical work are confirmed.
III. Stocks of category C1
1. Category C1 stocks for which are:
1.1. Known in the overall features of the shape and dimensions of the exclusive bearing (its parts), the basic character of storage conditions and internal structures, their variability and possible tectonic breaches; for bearings of liquid and gaseous minerals, the essential features of the range and quality of the productive horizon are also known;
1.2. Known types and technological types of mineral materials, the content of their commercial and harmful components with their mineralogical and petrographic characteristics and the general legality of their spatial distribution;
1.3. The model or laboratory test shall be characterised by their technological characteristics in such a way as to demonstrate their usability and economic importance;
1.4. Known in the basic features of geological and mining (hydrogeological, etc.) factors that make them conqueror.
2. For solid mineral deposits, the range of stocks of category C1 shall be defined by wells, mine parts and unveiling, the results of which correspond to the condition indicators, and shall be extrapolated from them up to a maximum of half of their distance, provided that geological assumptions are made, in particular if the results of geophysical or geochemical works are confirmed. In the case of bearings of liquid and gaseous minerals, the coverage of stocks of category C1 shall be defined by the projection of the bearing boundaries, provided that geological assumptions are made, in particular if the results of geophysical work are confirmed. On this area, carotage measurements shall be positive for drilling, one of which shall have an industrial inflow. If the stock gauge of category C1 is adjacent to the stock gauge of category B or A, there may not be an industrial presence well on this area.
IV. Stocks of category C2
1. In category C2, stocks of which are:
1.1. The shape and dimensions, storage conditions and internal construction of the exclusive bearing (s) are derived from geological or geophysical or geochemical data and are confirmed by isolated wells, mine parts and unveiling; for bearings of liquid and gaseous minerals, at least one well with positive pumping test results is demonstrated;
1.2. Specified quality, mineralogical and petrographic composition and technological properties based on laboratory test results or derived by analogy from similar bearings;
1.3. Determined by geological and mining (hydrogeological etc.) factors that make them conqueror from the research works performed (1.1.) or by analogy from similar bearings.
2. The stock coverage of category C2 shall be defined for solid, liquid and gaseous mineral deposits by the boundaries of favourable geological structures or rock complexes in accordance with the results of isolated drilling, mining works and unveiling, as well as geophysical and geochemical works. The stocks of category C2 shall also be extrapolated beyond the stock gauge of the higher categories, provided that there are geological assumptions.
3. Stocks of category C2 shall also be classified in more detail than those referred to in point 1 if, for a very complex geological construction and very uneven distribution of commercial and harmful components, the knowledge required for inclusion of stocks in category C1 has not been obtained.
