DECLARATION
Ministry of Education and Culture
of 13 July 1965
on the conservation of wildlife
The Ministry of Education and Culture, in agreement with the Ministry of Agriculture, Forestry and Water and the participating central authorities of the State Administration, provides, pursuant to Section 8 (2) of Act No. 40 / 1956 Coll., on State Protection of Nature:
The species of wild animals, which are part of our natural wealth, particularly those that occur rarely or are threatened by their being, are protected. Animals living and dead are protected at all stages of development (eggs, larvae, cocoons, adult animals), and their used mansions (both natural and artificial). The species of protected animals are included in the list annexed to this Decree.
(1) Protected animals are not allowed to kill, catch, deliberately disturb or otherwise interfere with their natural development or the environment and to be kept captive. It is not allowed to destroy, damage, collect or relocate their development stages or their used mansions (both natural and artificial).
(2) The provisions of paragraph 1 shall not apply where the professional breeding of bumble bees and ants is used to increase their status in the wild.
(3) The provisions of paragraph 1 shall not apply where intervention in the environment or the natural development of protected animals is evidently necessary as a result of the normal management of real estate or other property or for health reasons. However, if the species in the Annex are marked with an asterisk (*) or an isolated occurrence or exceptional implantation, the necessary intervention may only be carried out in accordance with the technical instructions of the District Authority of State Nature Protection; that authority shall also determine when the occurrence is isolated or exceptional implantation.
Those who take over a fallen protected animal, in an annex marked with an asterisk, shall be obliged to forward it without delay to the nearest museum or body of state conservation or local school; as regards birds and mammals marked with a cross, they shall report the finding to those authorities, but shall hand over the dead animal to the hunting operator where the dead animal was found.
An organisation or person keeping a protected animal which is not demonstrably from a properly authorised breed or catch shall notify the Regional Authority of the State Protection of Nature within 1 month of the date of application of this decree or from the date on which it has taken the protected animal into breeding, its species, approximate age and sex, as well as the origin and manner of its acquisition, and request confirmation of such notification.
Organisations and persons authorised to breed and process protected animals (including their parts and stages of development) or authorised to trade with them (zoos, taxiderwork, raw materials collection, catching, buying, selling or exporting live animals) are required to keep a registered record of the animals (part of them, stage of development), where they have received or acquired protected animals (parts of them) or to whom the animal (part of them) has been transferred.
(1) The authorisation provided for in Article 5 is issued by the Ministry of Education and Culture.
(2) The authorisation to export animals (their parts and stages of development) protected under this decree is granted by the Ministry of Education and Culture in agreement with the Ministry of Agriculture, Forestry and Water.
The authority of the State Protection of Nature may declare other species of animals which occur in a geographical area singularly or in small numbers. Where it is a vertebrate animal, it shall be given the same protection as those indicated in the Annex by an asterisk.
In interventions against pests and plant diseases, weeds and sanitary measures, it is necessary to ensure that non-affected animals are not threatened beyond what is necessary.
(1) Where the catching or killing of vertebrate animals is permitted, the means and equipment by which the animal can be caught or killed immediately shall be used. It is therefore prohibited to use, in particular, slingshots, air guns, casings, meshes, poisons, narcotic drugs and adhesives for this purpose.
(2) Only persons older than 18 years of age may perform deliberate vertebrate eradication.
(3) Catching birds and collecting eggs is permitted only to the extent provided for by the provisions in force. *)
State conservation authorities have the right to check compliance with this decree.
The provisions of this Decree, other than Section 8, shall not apply to species of animals which may be caught or killed under the regulations on fishing, hunting, pest control and sanitary regulations.
For animals declared to be animals under the hunting rules and for animals listed in the fisheries regulations, the Ministry of Agriculture, Forestry and Aquaculture, together with the Ministry of Education and Culture, may, where justified, authorise an exemption from the provisions of this Decree.
This decree applies only in Czech regions; shall take effect on 1 September 1965.
