of 31 March 1949
on the internal organisation of the Prague People's Administration.
The Government of the Czechoslovak Republic orders pursuant to § 15, § 19, § 1 and § 24, § 1 of the Act of 24 March 1949, No 76 Coll., on the organisation of administration in the capital of Prague (hereinafter referred to as "the Act"):

Oddíl 1.

Central National Committee.
§ 1.
Plenary session.
(1) The Central National Committee is reserved in plenary
(a) approve, within the framework of the single economic plan, the plan for the economic development and construction of the capital of Prague;
(b) a resolution on the budget and the accounts of its management;
(c) issue, on the basis of statutory provisions, general legislation on the imposition of benefits, fees, allowances and similar transactions;
(d) to vote from among their members of the Mayor, its Deputy and the referees of the Central National Committee and their alternates, to call them off and to establish and abolish the commissions of the Central National Committee;
(e) to establish and abolish municipal undertakings and their boards and to appoint and withdraw their members;
(f) to be quashed at the Rules of Procedure for the Plenary Session of the Central National Committee as well as for the Circular National Committees and their Choir Executive Parts;
(g) voters of honest citizens,
(h) discuss territorial changes;
(ch) decide on matters reserved for specific provisions of the decision of the Plenary Session.
(2) The Plenary Session of the Central National Committee must be presented for consideration
(a) matters of a political nature;
(b) matters of exceptional economic importance.
(3) The Plenary Session of the Central National Committee controls the implementation of the plan for the economic development and construction of the capital city of Prague, ensures that the administration of the city is consistent and controls the activities of its executive and district national committees. These executive and district national committees are therefore obliged to report on their activities to the plenary session. The Plenary Session provides them with specific guidelines and initiatives under the directives and guidelines of the higher institutions.
(4) The Plenary Session may decide on any matter falling within the competence of the Central National Committee.
§ 2.
Council of the Central National Committee.
(1) The Council is reserved in the College
(a) prepare the matters to be discussed in the plenary session of the Central National Committee;
(b) to lay down general rules on the management of municipal assets;
(c) to decide whether to dispose of or otherwise burden municipal property;
(d) authorise, under the budget, expenditure in excess of CZK 500,000 per case;
(e) to be quashed in legal proceedings involving an amount of more than CZK 500,000 or a matter (law) whose general value exceeds that amount;
(f) to make general arrangements for the employment and pay rights of the employees of the capital city of Prague and to systemise the posts of staff of the Central National Committee or of undertakings, institutes and establishments owned by the municipality of Prague or managed by the Prague authorities of the People's Administration;
(h) appoint municipal staff on the 5th and higher scales and appoint contract staff with salaries similar to those of the 5th and higher scales;
(ch) establish and withdraw managers of municipal undertakings;
(i) to decide, in disputes, on jurisdiction between the referents and the commissions of the Central National Committee and between the different Circular National Committees;
(j) review, pursuant to Article 10 (5) of the Act, the decisions of the commissions and referees of the Central National Committee and their authorised staff;
k) Decide on naming squares, streets and public spaces,
(l) decide on matters reserved for specific provisions of the Council's decision.
(2) Even in cases not covered by the provisions of paragraph 1, the Board of Directors shall decide on the matters of property law and on the personal matters of the staff member, where the approval of its decision is required by a superior body. However, in such matters, it may entrust decisions to the Commission or to the Mayor or individual referees.
(3) In the absence of any of the cases referred to in paragraph 1 or 2, the Board shall take a decision in principle by means of referees; it may, however, instruct the Commission to decide on its behalf, to the extent it provides for it. The Council shall be entitled to decide in the College and on any matter on which it is for the national committee to decide otherwise.
(4) The Council is to be referred for consideration on matters of particular political importance.
(5) The Council implements the resolution of the Plenary Session of the Central National Committee, unless another of its components has been delegated to implement it, discussing and harmonising the work plans of the referees, checking the activities of the referees and their referees and the activities of the Central National Committee's commissions and the activities of the District National Committees, regularly discussing reports on their activities and giving them binding guidance.
§ 3.
The primary.
(1) The primary shall represent the Central National Committee and the City of Prague as a union of the People's Administration externally and shall chair the plenary sessions and meetings of the Board of the Central National Committee.
(2) At a time when the Board of the Central National Committee does not sit, the Mayor may take urgent measures, which would otherwise require a resolution of the Board, but must request additional approval at the next meeting of the Board.
(3) The primary may also take urgent measures in the field of competence of the commissions of the Central National Committee, but he shall be obliged to inform the Board of the Central National Committee and the relevant commission at their next meeting.
(4) If the Central National Committee's representative fails to take the necessary measures in time to properly arrange the work of his report, the Mayor shall take these measures in his place and shall notify the Board of the Central National Committee at its next meeting.
(5) The Prime Minister shall consolidate the activities of the various referees of the Central National Committee and shall monitor the implementation of the directives of the superior bodies and of the directives at which the plenary session of the Central National Committee has been decided.
(6) If the Mayor considers that the resolution of the Plenary Session or the Board of the Central National Committee is out of their competence or that it is contrary to the regulations or that it is contrary to the directives and instructions of the superior bodies, he shall cease to execute the resolution and notify the central office and the Ministry of Interior of the matter; if the case is not decided by the Minister responsible for the matter, the order may not be enforced. For the same reasons, the Mayor is obliged to suspend the execution of a decision or measure by a Member or a resolution of the Central National Committee's commission and to notify the Board, which shall then decide whether and if the decision (measure, resolution) which has been terminated may be enforced.
(7) The Chief of Staff shall be the Chief of Staff of all the staff of the Central National Committee and shall assign and translate them and delegate them to official functions.
§ 4.
Deputy Mayor.
The Deputy Mayor shall represent the Mayor in their order and shall carry out the tasks assigned to him by the Mayor in his field of competence.
§ 5.
References to the Central National Committee.
(1) The experts of the Central National Committee shall decide and take action on behalf of the Board in respect of the activities of their reports on all matters which are not reserved for the Board or which are not assigned to the Mayor or the commissions of the Central National Committee; the extent of the decision-making power of the referees in the matters referred to in Article 2 (2) shall be adjusted by the Board of the Central National Committee.
(2) Deputy Members represent the referees in the cases provided for in Section 12 (3) of the Act and assist them otherwise in the management of the reports.
(3) The experts are the chairman of the committees set up in the field of their reports; The Vice-Presidents of these commissions shall be their deputy.
§ 6.
The reports of the Central National Committee.
(1) A Presidium report and the following additional reports are hereby established with the Central National Committee:
1. the General Home Affairs Report,
2. planning report,
3. safety report,
4. a paper for education, science and art,
5th Labour and Social Welfare Report,
6. health report,
7. financial report,
8. economic report,
9th agricultural report,
10. report for internal trade and nutrition,
11. Technical report,
12th report for information, education and physical education,
13th byte report.
(2) The head of the presidial report is the mayor. The Presidium report shall provide the work to be carried out on the tasks assigned to the primary, shall deal with the matters of the members of the Central National Committee and its constituents and the members of the District National Committees and their constituents, arising from their duties and the responsibility for their performance, as well as with matters of honorary citizenship. The priority of the PSI is the central secretary.
(3) For the scope of the activities of the Central National Committee's reports, derogations resulting from the establishment of a pressidium report and the division of tasks in the fields of education, science, art, information, education and physical education, and work and social care, in particular housing care, shall apply mutatis mutandis to the extent of the activities of the reports of the Regional National Committees.
(4) The Council may divide the General Home Affairs Report into two groups and delegate the leadership of one of these groups to the Deputy Secretary-General, who then has the status of Secretary.
(5) For each report (group), the Council will determine the priority of the report (group) among the staff assigned to this report. Its provisions require the confirmation of the Minister of the Interior in agreement with the ministers in question. Other seconded staff shall be subordinate to the preferred report (groups).

Oddíl 2.

District National Committees.
§ 7.
Performance.
(1) The Circular National Committees shall exercise their competence, manage the directives and guidelines of the Central National Committee, its executive bodies and the relevant central offices.
(2) The head of the Central National Committee and the central authorities shall, in their field of competence, supervise the fulfilment of their duties by the district national committees and their executive components.
§ 8.
Plenary meeting of the District National Committee.
(1) The Regional National Committee is reserved in plenary
(a) decide to participate in the development and construction plan of the capital city of Prague;
(b) elects from among its members the President, its Deputy Director and the referees of the District National Committee, recall and establish and cancel commissions.
(2) The Plenary Session of the Circular National Committee must be presented for consideration of matters of major political importance in the urban area.
(3) The Plenary Session of the Circular National Committee controls the activities of its executive bodies which are obliged to report on their activities. The Plenary Session provides them with specific guidelines and initiatives under the directives and guidelines of the higher institutions.
(4) The Plenary Session may decide on any matter falling within the competence of the Circular National Committee.
§ 9.
Council of the District National Committee.
(1) The members of the Board are the Chairman of the District National Committee, its Deputy and the referees of the District National Committee.
(2) The Council shall manage all activities of the National Circular Committee. It shall be responsible for the administration of all matters falling within the competence of the Circular National Committee, unless it is reserved for the Plenary Session or the Chair of the Circular National Committee.
(3) The Council is reserved in the College
(a) prepare the items to be discussed in the plenary session of the Circular National Committee;
(b) determine in more detail how the municipal assets, institutes, undertakings and establishments to which the administration has been entrusted to the Circular National Committee will be managed;
(c) determine, in accordance with the guidelines of the Central National Committee, details of the internal organisation of the District National Committee;
(d) decide on matters reserved for specific provisions of the Council's decision.
(4) The Council, in addition, shall decide in the College on the legal proceedings relating to the assets managed by the Circular National Committee, but may, in such matters, delegate the decision of the Commission or empower individual referees or chairman of the Circular National Committee.
(5) In the absence of any of the cases referred to in paragraph 3 or 4, the Board shall take a decision in principle by means of referees; it may, however, instruct the Commission to decide on its behalf to the extent it defines. The Council shall have the power to decide on any matter which is otherwise decided by the referees or commissions of the District National Committee.
(6) The Council is to be referred for consideration in matters of particular importance to the urban area.
(7) The Council may, at a time when the District National Committee does not sit, set up a committee of the District National Committee, but is obliged to request the next plenary session for additional approval.
(8) The Council is implementing the resolution of the plenary session of the Circular National Committee, unless another of its components has been delegated to it, discussing and harmonising the work plans of the reports, monitoring the activities of the referees and their reports and the work of the commissions, regularly discussing their activities and giving them binding guidance.
§ 10.
Chairman of the District National Committee.
(1) The President shall represent the District National Committee and, in its field of competence, Prague as a union of the People's Administration and shall chair the plenary sessions and meetings of the Council of the District National Committee.
(2) For the reasons set out in Article 3 (6), the President is obliged to suspend the implementation of the resolution of the plenary session or of the Council of the Circular National Committee and to notify the relevant national committee and the mayor of the matter to the relevant national committee representative; unless the matter is decided in substance by the Board of the Central National Committee, the resolution may not be enforced. For the same reasons, the President shall be obliged to suspend the execution of a decision or measure by a referee or resolution of a commission of the District National Committee and to notify the Board of the District National Committee, which shall then decide whether and if the decision (measure, resolution) which has been terminated may be executed.
(3) The President shall be without prejudice to the rights of the Mayor by the senior servants assigned to the National District Committee.
(4) Unless otherwise provided for in paragraphs 1 to 3, the powers of the President shall apply mutatis mutandis to the provisions of Sections 3, 2 to 5.
(5) The Chairman shall have one Deputy Director; may entrust it with certain tasks in its field of competence, either on a case-by-case basis or in general.
(6) The President shall be responsible for the performance of his duties as a Plenary Session and the Board of the Central National Committee, as well as the Plenary Session and the Board of the Circular National Committee under its authority. He is obliged to follow orders and instructions from the mayor and the Home Secretary.
§ 11.
Referent to the District National Committee.
(1) The experts shall decide and take action on behalf of the Board within the scope of their reports on all matters which are not reserved for the Board of the Circular National Committee or which do not belong to the Chair or the commissions of the Circular National Committee; the scope of the decision-making power of the referees in the matters referred to in Paragraph 9 (4) shall be adjusted by the Board of the Circular National Committee.
(2) The experts are, without prejudice to the rights of the President, the immediate executive officers of the staff designated to provide work in their report. They may, with the agreement of the Council of the District National Committee, authorise such staff to take decisions and take action under their orders.
(3) The experts are the chairmen of the commissions of the National Circuit Committee set up in the field of their report.
(4) If one of the referees is busy or unable to perform his duties temporarily for other reasons, he shall be represented by another. The Council of the Circular National Committee shall lay down the arrangements for the mutual representation of the referees.
(5) The Referent of the Circular National Committee is responsible for the performance of his duties as a Plenary Session and the Board of the Central National Committee, as well as the Plenary Session and the Board of the Circular National Committee under its authority. It shall follow the orders and instructions of the relevant national committee and the relevant central offices.
§ 12.
The reports of the District National Committee.
(1) The following reports shall be set up for each national district committee:
1. the General Home Affairs Report,
2. planning report,
3. safety report,
4. report for education, education and physical education,
5th Labour and Social Welfare Report,
6. health report,
7. financial report,
8. economic report,
9th byte report,
10. the report on internal trade, nutrition and agriculture,
11th technical report.
(2) The Head of the General Home Affairs Report is the Chairman of the National District Committee. The same officer may conduct several reports.
(3) For the scope of the activity of the reports, the derogations resulting from the division of tasks in the field of work and social care, in particular housing care, and the combination of tasks in the field of internal trade, nutrition and agriculture apply mutatis mutandis to the provisions determining the scope of the activities of the reports of the regional national committees.
(4) The primary of the seconded staff shall, after hearing the chairman of the national district committee for the field of one or several reports of the national district committee, determine the priorities of the reports. Other staff seconded shall be subordinate to the priority of the report. The prior approval of the Ministry of the Interior in an agreement with the Ministry of Finance is required to determine the priority of the financial report.
§ 13.
Commission of the District National Committee.
(1) The Commission of the District National Committee shall have an advisory function, unless the Board or specific provisions have been entrusted with decision-making powers.
(2) Without prejudice to the provisions relating to commissions, the establishment of which is prescribed by specific provisions.

Oddíl 3.

Provisions common and final.
§ 14.
Staff.
(1) The Central National Committee is a personal office of staff assigned to the Central National Committee under Article 21 of the Act by each central authority. The central office of such staff shall be the competent technical central office which shall take measures and decide on their personal matters after hearing the Central National Committee.
(2) These staff members, if they are designated (trained) for the specific tasks of each department (professional service staff), may be used for other tasks only with the approval of the competent central office.
§ 15.
Final provision.
This Regulation shall enter into force on 1 April 1949; they shall be carried out by the Home Secretary in agreement with the participating members of the Government.
