on the surrender and making available of results of geological work
The Czech Geological Authority provides in agreement with the participating central authorities pursuant to § 7 (6) and § 12 (4) of the Act of the Czech National Council No. 62 / 1988 Coll., on Geological Works and on the Czech Geological Office, and § 35 (5) of Act No. 44 (1988) Coll., on the Protection and Use of Mineral Wealth (Upper Act):

§ 7
Submission of results of geological work
(1) The organisation is obliged to submit to the Geofund without charge the results of geological work, including other written and graphic materials of geological focus processed in its activities (hereinafter referred to as "documentation"),
(a) final reports and partial final reports on the outcome of geological work;
(b) approved calculations of stocks of exclusive deposits (9) and groundwater stocks;
(c) the results of the search and survey of the non-exclusive mineral bearing, unless it has been decided that it is suitable for the needs and development of the national economy;
(d) geological profiles of wells, pits, shafts, stacks and other works which have been caught by pre-quaternary formations, in addition to documentation of exploration of exclusive bearings in their conquest space;
(e) the results of mineralogical, petrological, paleontological, chemical, geotechnology, physical mechanical and technological analyses and tests of minerals, rocks, earth and groundwater, if they document facts relevant to the knowledge of the geological structure of the territory under examination or from a scientific point of view;
(f) pilot load test reports, 10)
(g) geologically oriented diplomas, candidates, doctoral and similar work;
(h) geological reports from study and work trips abroad.
(2) The obligation to submit the documentation referred to in paragraph 1 (b) to (f) does not apply to the documentation included in the dossier referred to in paragraph 1 (a).
(3) The organisation is obliged to surrender, free of charge, to the Geofund on request within two months, material documentary material obtained in the course of geological work (drilling cores and other samples), which documents the facts relevant to the knowledge of the geological construction of the area under examination or which is of scientific significance and has already been fully used to address the geological task.
§ 8
Documents, receipt and storage
(1) The documentation submitted by the Geofund must be legible and produced by a technique ensuring its durability and the possibility of reproduction. The parts of the documentation processed by the Geofund using computer and micrographic technology are submitted by the organisation in the format specified by the Czech Geological Authority in agreement with the central authority whose competence is the organisation submitting the documentation.
(2) The organisation shall submit the Geofund documentation within two months of its completion and, if approved, 11) within two months of its approval.
(3) The Geofund will examine the submitted documentation in the light of the requirements and completeness of the Annexes. The organisation shall, at the request of the GeoFund, remove or supplement the deficiencies identified in the submitted documentation within a specified period.
(4) The Geofund keeps the submitted documentation and material document material safely, accessible and clearly so that it can be used in the processing of the concepts and plans of geological work, in their design, implementation and evaluation as well as for other purposes.
§ 9
Accessing documentation and material material
The Geofund shall make the documents stored and, where appropriate, the material of the document available, enabling the authorised candidates (Section 12) to consult it, study it, make extracts and copies of it, and carry out search and reprogramming for them on request and process the required information.

§ 12
Authorised candidates
(1) Authorised candidates under Articles 9 and 11 (3) of this Order are:
(a) public authorities, courts and economic arbitrage;
(b) organisations authorised to carry out geological work;
(c) scientific institutions, schools, museums and similar socialist organisations in the context of carrying out their scientific, educational and cultural tasks;
(d) other socialist organisations to perform their tasks and to protect their rights and the rights of protected interests;
(e) citizens for the protection and exercise of their rights and the rights of protected interests or for the study and scientific work;
(f) the organisation and persons to whom the Czech Geological Office has given its consent to the disclosure of documentation, material document material or register of old mining works.
(2) The staff of the institutions and organisations referred to in points (a) to (d) of paragraph 1 shall be shown by written authorisation specifying the subject under examination. Written authorisation shall not be required from the staff of the institutions who consult the dossier or, where appropriate, require the provision of supporting documents and information in accordance with specific rules. 14)
(3) Citizens who require disclosure of documentation to protect or exercise their rights and the rights of protected interests must demonstrate this need; for the purposes of study and scientific work, citizens demonstrate their need by recommending a school or a scientific institution.
§ 13
Disclosure and study conditions
The conditions for the making available and study of documentation, material material and register of old mining works are governed by the special Geofund rules approved by the Czech Geological Office.
§ 14
Repeal
It shall be repealed:
1. the Order of the Central Geological Office No. 123 / 1961 Coll., on the Registration of Geological Works and on the Collection and Registration of Their Results,
2. § 78 of the Order of the Central Mining Office and the Central Geological Office No. 1000 / 1962 on the management and addition of geological documentation (reg. in amount 42 / 1962 Coll.).
§ 15
Efficacy
This Decree shall take effect on 1 April 1989.
