DECLARATION
Ministry of Finance
of 30 January 1967
on the provision of work leave and on the economic security of workers when taking part in vocational training organised in the form of short-term boarding centres
The Ministry of Finance sets out in the agreement with the Central Council of Trade Unions pursuant to § 126 (3) of the Labour Code No. 65 / 1965 Coll., § 391 (2) of the Economic Code No. 109 / 1964 Coll. and § 20 (1) (a) of Act No. 8 / 1959 Coll., laying down basic rules on the State Budget and on the management of budgetary resources:
Scope
(1) This decree provides for the provision of work leave and economic security for workers in employment (hereinafter referred to as "workers') in participation in vocational training organised in the form of short-term training. *)
(2) For the purposes of this decree, professional training shall mean the addition of expertise in a narrow specialised field which cannot be achieved by studying at school, in business technical schools, in business institutions, in the post-graduate or in the postgraduate studies.
(3) Short-term boarding camp means a concentration not exceeding 3 months in a single sequence.
(4) This decree does not apply to training organised by social organisations. * *)
Employment and compensation
(1) Professional training organised in the form of short-term internships (hereinafter referred to as "boarding training"), which affects the normal working hours of the worker, may only be attended by a worker if he or she agrees to such training or participation by an organisation in employment.
(2) A staff member participating in boarding training in the interest of an organisation with whom he is in employment shall be granted leave of employment with a salary replacement equal to the average earnings. *)
(3) A worker who is engaged in boarding school training in his own interests shall be granted a leave of absence of compensation (Section 27 (2) of Decree-Law No 66 / 1965 Coll.).
Economic security of workers taking part in boarding training not exceeding 5 days
(1) An organisation in respect of which a worker is employed and in the interest of which he is involved in boarding training not exceeding 5 days, shall provide the worker, during the period of boarding training and his / her own journey (journey), to the place of boarding and reimbursement of travel expenses as in the course of travel, * *) unless the worker has been provided with economic security under paragraph 2.
(2) An organisation which is the organiser of a training course not exceeding 5 days may provide the worker with free food and accommodation and, where appropriate, cover travel expenses; However, the organisation may provide the diet free of charge only up to the amount of the diet provided under the rules on reimbursement of travel, removal and other expenses.
(3) Until the 5 days referred to in the preceding paragraphs, the dates of arrival at and departure from the place of boarding school shall not be taken into account when the days in which the boarding school was not started or completed.
Economic security of workers when taking part in boarding training exceeding 5 days
(1) An organisation in respect of which the worker is employed and in the interest of which he participates in boarding school training over 5 days shall provide the worker with reimbursement of travel expenses, as in the course of travel, for the duration of his journey to the place of boarding school. In boarding school training for more than 4 weeks, this organisation shall also provide the worker with compensation for one journey from the place of boarding school to his permanent residence and back; provide this compensation to married workers and, where justified, other workers for every 4 weeks for the duration of boarding school training.
(2) An organisation which is the organiser of a training course exceeding 5 days shall provide the worker with food and accommodation; This obligation shall not be held against a staff member who is resident in the place of boarding school and a staff member participating in boarding school only in his own interests. In the course of boarding for participants in boarding school training in public catering establishments, the cost of meals of one participant may not exceed, on average, the amount corresponding to the retail (sales) prices of each standard meal in the II. price group.
(3) A worker is obliged to pay 10, - Kčs per day for meals when taking part in boarding training over 5 days. On partial meals on the day of arrival at or departure from the place of boarding school, he is obliged to pay a proportion of this amount. They don't pay for accommodation.
(4) In exceptional cases, an organisation which is the organiser of a training course of more than 5 days, for serious reasons of health, family, etc., may provide the worker with an amount corresponding to the value of the diet provided after deduction of 10, - Kčs daily; However, this amount may not exceed the allowances due to another worker on business trips.
Cost of boarding training
(1) The costs of boarding school training not covered by the previous provisions shall be borne by the organisation which organises the boarding school training. However, this organisation may agree with organisations whose staff participate in boarding training, part of the reimbursement of those costs and costs referred to in Sections 3 and 4 of their resources.
(2) An organisation which is the organiser of a training course of more than 5 days is obliged to select from the staff participating in the training an amount of 10, - Kčs per day or, where appropriate, its proportion (§ 4 (3)). If the organiser of the training is an economic organisation, he shall use the amounts thus collected to cover part of the catering costs; in budgetary organisations, the amounts collected shall be charged as reimbursement of expenditure in favour of the relevant expenditure account.
General provisions
The provisions of this decree may also apply to the training of members of national committees and staff working for organisations on the basis of non-employment agreements.
An organisation which is the organiser of boarding school training or in the interests of which boarding school training takes place shall respect the principle of economy and ensure that the required result is achieved at the lowest cost. The training must be organised mainly in the facilities of the organisation which is the organiser of the training.
Transitional and final provisions
(1) They are repealed.
(a) Decree No. 133 / 1962 of the Ministry of Finance Coll., on the physical security of participants in training in short-term courses organised in the field of competence of individual central authorities and national committees;
(b) the Ministry of Finance Directive No 163 / 64.750 / 1962 on the rights of staff of state and economic authorities and members of national committees in the deliberations and instructions published in the Ministry of Finance Bulletin No 10 / 1962 and registered in the amount of 72 / 1962 Coll.;
(c) the Ministry of Finance Directive No 164 / 19.096 / 1964, on the limits of the catering costs of participants in training in public catering establishments published in the Ministry of Finance Bulletin No 5 / 1964.
(2) For boarding school training started before 1 March 1967, it shall be continued until its completion in accordance with the existing rules.
This Decree shall take effect on 1 March 1967.

*) The decree does not therefore apply, for example, to training for members of single agricultural cooperatives, to training for members of armed corps, to training for the performance of tasks in CO which are subject to specific regulations.
