DECLARATION
of 23 February 2017
on the establishment of the structure and format of notifications under the conflict of interest law
According to Article 12 (6) of Act No. 159 / 2006 Coll., on Conflict of Interest, as amended by Act No. 14 / 2017 Coll.:
Subject matter
This decree sets out the structure and format for the submission of notifications of activities, assets and revenue and liabilities under Sections 9 to 11 of the Act on Conflict of Interest.
Format of notification
The notification referred to in § 1 shall be made on an electronic form in HTML or PDF format available on the Ministry of Justice website.
Structure of notifications
(1) In the notification referred to in Article 1, the public office shall specify:
(a) the name and, where appropriate, the name and surname;
(b) the date and place of birth;
(c) the legal person or its body or the organisational body in which he acts as a public official;
(d) the function of the public office; and
(e) the period for which the notification is made.
(2) In the notification of activities under Section 9 of the Conflict of Interest Act, the public office shall also indicate:
(a) the object, method and place of business or other self-employment;
(b) the company or name, identification number and registered office of the legal person of which it is a member or member;
(c) the company or name, identification number and registered office of the legal person in which it is a member of the statutory body, a member of the management, supervisory or supervisory body;
(d) the type of authority of the legal entity referred to in point (c) of which it is a member;
(e) the name or name, the identification number and the registered office of the person in respect of whom he is engaged in another activity in a professional or similar relationship or in a service relationship, if not the relationship or relationship in which he acts as a public official;
(f) whether it operates radio or television broadcasting or issues periodical printing; and
(g) a trading firm or a name, identification number and registered office of a legal person operating radio or television or issuing periodical printing, if his partner, member or controlling person.
(3) In the property notification provided for in Article 10 (1) (a) of the Act on Conflict of Interest, the public office shall also indicate:
(a) identification of the immovable item; the immovable property registered in the real estate register shall be identified by the name of the cadastral territory and the number of the property deed on which the immovable property is registered, kept by the relevant cadastral office;
(b) the type and issuer of the security, the book-entry security or the right associated with it;
(c) a trading firm or name, identification number and registered office of the trading corporation in which it has a holding not represented by a security or a book-entry security;
(d) the size of the share held in a commercial corporation not represented by a security or a book-entry security; and
(e) the type, price and method of acquisition of another item of movable property determined by type, the price of which is customary at the place and time, in each case exceeds CZK 500,000.
(4) In the property notification provided for in Article 10 (1) (b) of the Act on Conflict of Interest, the public office shall also indicate:
(a) identification and details of the purchase price and how the immovable item is acquired; the immovable property registered in the cadastral shall be identified by means of the data entered on the property deed by the competent cadastral office;
(b) the type and issuer of the security, the book-entry security or the right associated with it;
(c) a trading firm or name, identification number and registered office of the trading corporation in which it has a holding not represented by a security or a book-entry security;
(d) the size of the holding in a commercial corporation not represented by a security or a book-entry security;
(e) the type, purchase price and method of acquisition of another movable item, determined by type, acquired during the calendar year, provided that the sum of the values of all other movable items, in which items whose price is less than CZK 50,000 are not included, exceeds CZK 500,000; and
(f) the date on which the property is acquired, if the public office has held several functions in the calendar year for which the notification is made pursuant to Article 12 (2) of the Act on Conflict of Interest.
(5) In the notification of commitments under Article 11 (1) of the Act on Conflict of Interest, the public office shall also indicate:
(a) the type and amount of outstanding commitment which, on the date preceding the date of commencement of office, exceeds CZK 100,000 in each case; and
(b) an indication of the person to whom he has an outstanding obligation under (a); the natural person shall be identified by the name and, where appropriate, by the name and surname and the legal person shall be identified by the business firm or name, the identification number of the person and the registered office.
(6) In the notification of revenue pursuant to Article 11 (2) (a) of the Act on Conflict of Interest, the public office shall also indicate:
(a) the type and amount of income or other assets obtained during the performance of their duties, if their aggregate amount exceeds CZK 100,000 in the calendar year; and
(b) the designation of the source of income or other property as referred to in (a); the natural person shall be identified by the name and, where appropriate, by the name and surname and the legal person shall be identified by the business firm or name, the identification number of the person and the registered office.
(7) In the notification of commitments under Paragraph 11 (2) (b) of the Act on Conflict of Interest, the public office shall also indicate:
(a) the type and amount of outstanding commitments, where their aggregate amount exceeds CZK 100 000 on 31 December of the calendar year for which the notification is submitted or at the date of termination of office; and
(b) an indication of the person in respect of whom the public office has outstanding obligations under (a); the natural person shall be identified by the name and, where appropriate, by the name and surname and the legal person shall be identified by the business firm or name, the identification number of the person and the registered office.
Efficacy
This Regulation shall enter into force on 1 September 2017.
