THE LAW
of 22 January 2004
amending Act No. 147 / 1996 Coll., on Phytosanitary Care and Amendments to Certain Related Acts, as amended
Parliament has decided on this law of the Czech Republic:
In Article 19 of Act No. 147 / 1996 Coll., on Phytosanitary Care and Amendments to Certain Related Acts, as amended by Act No. 314 / 2001 Coll., the following paragraph 5 is inserted after paragraph 4, including footnotes No 9a) and 9b):
"(5) The assessment of a preparation containing a genetically modified organism or genetic product (9a) in terms of risks to the environment under specific legislation (9b) shall be carried out and delivered by the Ministry of the Environment. If this opinion is not positive, the product may not be authorised. The Ministry of the Environment shall be entitled to request, where necessary, data for its opinion under a specific legislation. 9b)
9a) § 2 (e) and (f) of Act No. 78 / 2004 Coll., on the treatment of genetically modified organisms and genetic products.
9b) § 5 of Act No. 78 / 2004 Coll. '.
Paragraphs 5 and 6 shall become paragraphs 6 and 7.
This Act shall take effect on the day of its publication.
