GOVERNMENT REGULATION
of 30 March 1994
on the salary ratios of staff of the armed forces, security bodies and services, customs authorities, fire protection officers and staff of certain other organisations (Staff Regulations)
The Government hereby orders, pursuant to Articles 21 (1) and 23 (b) to (g) of Act No. 143 / 1992 Coll., on the salary and remuneration of on-call time in the budget and in certain other organisations and bodies, as amended by Act No. 40 / 1994 Coll. ("the Act '):
Scope
(1) This Regulation provides for the staff referred to in paragraph 2:
(a) the catalogue of works and the qualification assumptions, the way in which they are classified, the scale of the rates and the way in which they are determined;
(b) conditions for the provision, amount and maturity of additional salaries;
(c) additional management fees;
(d) the conditions for the granting and the amount of the special premium and the conditions for the granting of the personal premium and its maximum amount; and
(e) the conditions for granting remuneration.
(2) An employee under this Regulation shall mean an occupational soldier, a member of the service (hereinafter referred to as "member"), an employee and a civil servant, where he is classified in:
(a) the armed forces of the Czech Republic;
(b) Ministry of Defence,
(c) The police of the Czech Republic,
(d) Prison services;
(e) the Ministry of Justice, if it is a civil servant who is continuously overseeing the execution of the detention and imprisonment;
(f) Security Information Service,
(g) Fire department of the Czech Republic,
h) Ministry of the Interior, if it is an employee assigned to the General Directorate of the Fire Department of the Czech Republic and in educational, technical and purpose facilities of the Fire Department of the Czech Republic,
(i) the customs authority;
(j) the Office for Foreign Relations and Information; and
(k) an organisational component of the State or in a contributory organisation in which the pay relationship is governed by law, as an employee, if the founder of that branch of the State or of a contributory organisation is the Ministry of Defence.
(3) For the purposes of this Regulation, a lead employee shall mean a staff member who is entitled to impose on subordinate staff duties, organise, manage and control their activities and issue orders, orders and binding instructions for that purpose.
Qualification assumptions and requirements
(1) The qualification requirement required for the performance of work in each grade is set out in the catalogue of work set out in Annex 1 to this Regulation (hereinafter referred to as "the catalogue").
(2) The employer may lay down, by means of an internal salary regulation (hereinafter referred to as the "internal regulation"):
(a) the requirement of the focus or field of education needed for the performance of certain work, provided that the qualification requirement of the focus or field of education does not provide for a catalogue or special regulation for the performance of the same work, 3)
(b) other requirements for the proper performance of certain works, unless they provide for additional qualifications for the performance of the same work, other than the focus or field of education, catalogue or special regulations, 3)
(c) the rules governing the classification in the grade of staff members who do not meet the requirements for the proper performance of their duties
1. the requirements laid down by the employer under point (b);
2. the qualification requirements laid down in a specific regulation, (3) unless otherwise specified in this specific regulation.
Allocation of staff members to grade
(1) The employer shall assign the staff member in accordance with Article 4 (1) of the Act to the grade in which the most demanding work is included in the catalogue, the performance of which the employer requires on the staff. If this work is not included in the catalogue, the employer shall include the staff member in the grade in which examples of work comparable to it in terms of complexity, accountability and psychological and physical complexity are included; the comparison is based on the general characteristics of the grade in the law.
(2) The employer shall place the staff member in the grade referred to in paragraph 1, provided that he fulfils both the conditions and requirements necessary for the proper performance of his duties in that grade; the achievement of a higher education than that required shall not be taken into account. Save as otherwise provided in the Special Regulation (3), an employer may exceptionally include a staff member who does not meet the necessary training,
(a) to the first to third grade;
(b) to the fourth and higher grades, but not more than four years, unless otherwise specified.
(3) (4) staff members may, for a period of more than four years, be classified in the appropriate grade for which they do not have the necessary training, provided that:
(a) a long-term activity in the relevant field has demonstrated its ability to perform the required work and is over 45 years of age; or
(b) he has commenced, at the time during which he has exceptionally been classified in the grade referred to in paragraph 2 (b), or before such exceptional classification, a study which he complements with the necessary training, and has properly continued his studies; or
(c) is in the fourth grade and has achieved secondary or secondary vocational education (hereinafter referred to as "secondary vocational education"); or
(d) it shall be classified in the seventh grade at most if, for the proper performance of the required work, the employer fulfils the conditions laid down in a specific regulation or the requirement of learning in the field laid down in Article 3 (2) (a).
(e) is in the eighth grade and has achieved complete secondary education or full secondary vocational education (hereinafter referred to as "full secondary education");
(f) is in ninth grade and has achieved higher vocational education; or
(g) is classified in the 10th grade and has achieved university education in the Bachelor's study programme; or
(h) satisfy the conditions of professional and pedagogical competence laid down in the special regulation9) or the qualification conditions for the performance of the duties laid down in the specific regulation. 9a)
Allocation of the staff member
(1) The employer shall classify the staff member in the grade concerned, depending on the calculation of the period applicable to that classification (hereinafter referred to as "the period of deductible practice"). The employer shall include a period of
(a) experience in the field of the required work achieved after completion of the training provided for in the catalogue or requested by the employer pursuant to Article 4 (3) (d), or after reaching the professional competence laid down in the special legislation, (9) or after reaching the qualification conditions for the performance of the duties provided for in the special legislature9a), or after completion of the secondary vocational training of a staff member in the fourth grade, or of a full secondary education for a staff member in the eighth grade or higher vocational training for a staff member in the ninth grade, or of a higher education in the Bachelor higher education in the Bachelor higher education programme for a staff in the tenth grade;
(b) experience in the field of required work achieved before the completion of the education set out in the catalogue or requested by the employer [Paragraph 4 (3) (d)] in the range of four fifths;
(c) other practice, depending on the extent of its use, for the successful performance of the required work, but not more than two thirds;
(d) the exercise of military basic (substitute) service and civil service to the extent provided for by the special law for the exercise of military basic (substitute) service;
(e) maternity leave, other maternity leave or parental leave or permanent childcare to the extent corresponding to the length of maternity leave and other maternity leave or parental leave valid at the time of such care under a special legislation, (5) but not more than a total of six years; those periods shall not be counted if the staff member or staff member was simultaneously preparing for a profession in a daily study10) or in a preschool, 10a); and
(f) personal care of a long-term severely disabled minor child or children who have required exceptional care, provided that they have not been placed in an institution for such children, but up to a maximum of six years, including the period counted under (e).
(2) For the purposes of this Regulation, labour shall be the work for which knowledge of the same or similar focus is required as that of the work required.
(3) From the period of deductible practice referred to in paragraph 1, the employer shall deduct, unless otherwise specified, from the staff member
(a) a fourth to seventh grade which has not achieved complete secondary education, a period of two years, or a period of four years, provided that it has achieved only basic education, with the exception of a staff member classified in that class under Paragraph 4 (3) (d);
(b) the eighth grade, which has achieved only full secondary education, a period of two years, or only secondary vocational education, a period of four years, or a period of six years, provided that it has achieved only basic education;
(c) the ninth grade, which has achieved only higher vocational education, a period of one year or a full secondary education, a period of three years or only a secondary vocational education, a period of five years or a period of seven years, provided that it has achieved only basic education,
(d) a tenth and higher grade which has achieved only a university education in a Bachelor's study programme, a period of two years, or only a higher vocational education, a period of three years, or a full secondary education, a period of five years, or only a secondary vocational education, a period of seven years, or a period of nine years if it has achieved only basic education.
(4) For the purposes of the step-up of a staff member, the period of work required in the grade to which the staff member is classified shall be fully included in the deductible practice.
Salary fare
(1) The staff members are responsible for the salary rate laid down for the grade and grade to which they are assigned. The fees are set out in Annex 2, which is part of this Regulation.
(2) An occupational soldier, a member of the Police of the Czech Republic, a member of the Prison Service, a member of the Security Information Service of the Czech Republic, a member of the Fire Rescue Corps of the Czech Republic, a member of the customs authorities and a civil servant referred to in § 1 (2), to whom § 73 (2) to (4) of the Labour Code imposes a greater extent of basic duties and restrictions than other staff members, is subject to the salary tariff referred to in paragraph 1, plus 25% of the salary of the highest grade in which the staff is assigned; This amount shall be rounded up to the whole ten crowns.
(3) Staff members who, under the special legislation of a healthcare professional (10b) and who are engaged in the profession of employment in relation to a contributory organisation set up by the Ministry of Defence, are entitled to the salary fare referred to in paragraph 1, plus an amount equivalent to 17% of the salary rate of the highest grade in the grade to which the staff member is assigned; This amount shall be rounded up to the whole ten crowns.
Personal surcharge
(1) Employees who achieve very good work results or perform a higher level of work than other employees may provide a personal surcharge of up to 50% of the salary of the highest grade in the grade to which the employee is classified.
(2) Employees who are an excellent, generally recognised expert and who carry out work in the ninth to twelfth grades and who carry out intelligence tasks and are an excellent professional may provide a personal surcharge up to 100% of the salary of the highest grade in the grade to which the employee is classified.
(3) The employer shall decide to increase or reduce the staff member's personal allowance subject to compliance with the conditions laid down in paragraphs 1 and 2.
Management supplement
A lead employee who is the statutory body of the employer, the head of the organisational body of the State (hereinafter referred to as the "statutory body ') and the head of the employer's staff, (11) who is not subject to the management fee provided for in Article 5 (1) of the Act, shall be subject to the management fee set out in Annex 3 to this Regulation, depending on the degree of management and the complexity of the management work.
Special surcharge
(1) Employees who work in difficult and healthy working conditions provide an employer with a surcharge of the amount and under the conditions laid down in the special regulation. 6)
(2) Employees whose employer, in the course of two-shift, three-shift or continuous operations, has arranged working hours in such a way that they are working alternately on the morning, afternoon or night shift, a surcharge of CZK 100 to 500 per month is provided.
(3) The employees referred to in § 1 (2) (a) to (e) and (g), (i) and (k), which carry out activities related to the protection of the interests of the State in which their life or health may be endangered, or other serious risks, are granted an additional fee of between CZK 1000 and CZK 4000 per month in the I. group, CZK 500 to CZK 2000 per month in the II. group or CZK 100 to CZK 1000 per month in the II. group. The inclusion of such activities in the I., II. or III Group shall be determined by the Minister of Interior, the Minister of Defence, the Minister of Finance or the Minister of Justice, depending on the degree of risk in his field of competence.
(4) Staff performing the tasks of the intelligence services in which his life or health or other serious risks may be compromised shall be granted an additional fee of between CZK 100 and CZK 4000 per month.
(5) Staff performing the duties of an executive pilot are granted an additional fee of 500 CZK to 6000 CZK per month; the surcharge referred to in paragraph 3 is not for him.
(6) Staff of the armed forces and of the security corps posted within the United Nations' multinational forces or international police forces outside the territory of the Czech Republic shall be granted a surcharge of between USD 700 and USD 4000 per month, or equivalent, for the duration of their stay abroad, in accordance with paragraph 3 or 5. The conditions for determining the amount of the surcharge and the amount of the surcharge within this margin shall be determined by the Minister of Defence, the Minister of Justice or the Minister of the Interior, under the jurisdiction of the staff member.
(7) A medical worker, 12) whose performance is linked to an extraordinary burden of continuous direct care for persons in psychiatric and gerontological departments of the bed facilities, is provided with a surcharge of CZK 100 to CZK 500 per month.
(8) The staff of the sanitary service, which consistently performs and provides hygiene supervision outside the regular place of service, is provided with an extra charge of CZK 200 to CZK 800 per month.
(9) Employees - a member of the medical rescue group are offered an extra charge of 500 CZK to 2000 CZK per month.
(10) Employees who systematically provide health care in operating rooms, anesthesiologiccoruscitation departments, intensive care units and oncology are provided with a surcharge of CZK 200 to 1000 per month.
(11) The Master of Vocational Education, whose performance is linked to an extraordinary neuropsychological burden consisting of continuous supervision of pupils who are at increased risk of injury due to the use of machines, tools or instruments, which are used to acquire practical skills and habits in workshops and at the workplace of apprenticeship institutions in vocational training, and the pedagogical staff who carry out the work of a class teacher are provided with an additional fee of CZK 200 to CZK 800 per month.
(12) The amount of the premium within the limits set out in paragraphs 2, 4 to 5 and 7 to 11 shall be determined by the employer. The amount of the premium referred to in paragraph 3 shall be determined by the employer within the range set for the group to which the employee's activity is classified.
Remuneration
The employer may grant the employee a remuneration
(a) for the successful performance of exceptional or particularly important tasks or for the achievement of an improved economic outcome of the contribution organisation;
(b) to assess his work benefits at the age of 50 and at the first termination of service or employment following the grant of an invalidity pension or the acquisition of an old-age pension.
Further salary
(1) Staff members shall be entitled to an additional salary in each half of the calendar year if they work for at least 65 days for one employer in the same service relationship or for one employer in the same employment relationship, unless such employment or employment ends in the first half of the year before 31 May or 30 June, if the staff member has worked for a specified number of days until June and in the second half before 30 November or 31 December, if the staff member has worked for a specified number of days until December. The performance of the service in service and the performance of the work in employment with the same employer shall not be counted. Compliance with the terms of the same employment relationship with one employer is not required if the change of employer is made and the transfer of rights and obligations from employment relationships by law. 13)
(2) The working day shall be the day on which the staff member:
(a) he has worked the bulk of his shift;
(b) has taken a holiday for half of its shift and more;
(c) have taken a replacement leave for overtime or a holiday work in the range of half of its shift and more;
(d) he was unable to perform work on the employer's part 14) in the range of half of his shift and more;
(e) he did not work because his usual working day was a holiday.
(3) The working day may only be counted for one reason referred to in paragraph 2.
(4) A staff member who is employed after a fixed weekly working period of 15) and whose employer has laid down weekly working hours unevenly, 16) shall be assessed as an employee who has worked five working days in the calendar week, even if his working hours are not allocated to all working days of the week. Paragraphs 2 (b) to (e) shall apply mutatis mutandis.
(5) The amount of the additional salary shall be the sum of the amounts of the salary tariff, the value surcharge, the management premium, the personal and special allowance, except for the surcharge referred to in Article 10 (6), to which the staff member was last entitled or who was last assigned to him by the employer, unless otherwise specified.
(6) The next salary shall be payable within the next day set for payment of the salary after entitlement to the next salary has been established. Before fulfilling the conditions for entitlement to the additional salary laid down in paragraphs 1, 2 and 4, the employer may provide up to two advances for the additional salary, provided that the staff member agrees to repay them in the event that he does not receive the additional salary or to repay the amount by which the advance granted exceeded the additional salary.
Special arrangements for the provision of salary to certain employees
(1) Employees included in the first to third grade (Section 4) may determine the salary tariff within the range of the salary tariffs set for the lowest to highest grade of the relevant grade, provided that the range of staff concerned by this method of determining the salary tariff and the rules for determining the salary tariff within the range of the lowest to highest grade of the relevant grade is agreed in a collective agreement or laid down in an internal regulation.
(2) Employees who are in the fourth and upper grades may determine the salary tariff by analogy in accordance with paragraph 1, provided that:
(a) carry out intelligence tasks or be seconded within the peacekeeping force unit to participate in peacekeeping operations abroad;
(b) performing artistic or educational work;
(c) is an athlete and coach; or
d) is a specialist in the Rapid Dependence Department of the Czech Police.
(3) The employer may, by means of an internal regulation, determine the range of staff engaged in artistic and technical work, to which he shall determine the salary fare by analogy in accordance with paragraph 1.
(4) Where the employer designates a salary fare for the staff member referred to in Article 6 (2) in accordance with paragraphs 1 to 3, he shall be entitled to the salary fare thus determined, plus an amount corresponding to 25% of the salary of the highest grade in the grade to which the staff member is assigned; This amount shall be rounded up to the whole ten crowns.
(5) An employee performing artistic or artistic teaching work, an athlete, a coach, a pilot (commander) of an aircraft, an air navigator, an on-board engineer or an on-board engineer, and an air traffic controller and a specialist of the Police Police of the Czech Republic may also be included in a grade for which he does not meet the qualification requirement or requirement (§ 3).
(6) A member in a fourth or higher grade for whom he does not meet the established qualification requirement may be kept in that grade by the employer, provided that he is qualified under the special legislation (18).
(7) The employer who is a health care institution and provides health care covered by health insurance (7) may, with the prior consent of the founder, negotiate in the collective agreement a method for determining the wage rate for employees in the fourth to twelfth grade within the range of the salary rates set for the lowest to highest grade in the relevant grade.
Common, transitional and final provisions
The higher-grade salary tariff shall be charged to the staff member from the first day of the month in which he reached the prescribed period of deductible practice.
(1) In order to mitigate the consequences of the injustices caused by the labour acts carried out between 25 February 1948 and 1 January 1990, the employer may, by way of derogation from Paragraph 5 (1) (c), include in full the period of other practice, provided that the staff member was unable to practice in the field of the required work because of an invalid employment act. 8)
(2) In order to mitigate the consequences of decisions excluding pupils and students as a result of political persecution during the period from 25 February 1948 to 1 January 1990 from studies in secondary or higher education schools and universities, the employer may, by way of derogation from § 5 (1) (b) and (c), include in full the period of experience in the field of required work achieved before the completion of the education set out in the catalogue or requested by the employer and the period of other practice, provided that the staff member has duly completed the study rehabilitation (9).
(1) For civil servants of the Ministry of Interior who work in the security section, and for civil servants of the Police of the Czech Republic and the Prison Service, the Decree of the Government of the Czech Republic No 253 / 1992 Coll., on the pay ratios of employees of civil administrations, certain other institutions and municipalities, as amended by Decree of the Government of the Czech Republic No. 43 / 1993 Coll. and Decree of the Government No. 288 / 1993 Coll.
(2) For the staff of budgetary and contribution organisations referred to in § 1 (2) (g), Government Regulation No 251 / 1992 Coll., on the pay ratios of staff of budgetary and certain other organisations, as amended by Government Regulation No 288 / 1993 Coll.
(1) Salary under this Regulation shall be paid for the first time for April 1994.
(2) A further salary (Paragraph 12) will be paid for the first time in 1995 and only half the amount to which employees would otherwise have been entitled in that year.
They shall be deleted:
1. Ordinance of the Government of the Czech and Slovak Federal Republic No. 223 / 1992 Coll., implementing Act No. 143 / 1992 Coll., on the salary and remuneration of on-call duty in budgetary and in certain other organisations and bodies, as amended.
2. Ordinance of the Government of the Czech Republic No. 255 / 1992 Coll., on the pay ratios of members of the Czech Fire Protection Corps.
3. The head of the first and second parts of the First Decree of the Ministry of Interior of the Czech Republic of 11 August 1992 No. HČ- 515 / 2-92 on the formalities and reimbursement of expenses provided to members of the Police of the Czech Republic in connection with the performance of the service (published under No. 428 / 1992 Coll.).
4. Head of the First and Second Part of the Second Decree of the Ministry of Justice of the Czech Republic of 16 June 1992 on the formalities of members of the Czech Correctional Education Corps and reimbursement of expenses provided in connection with the performance of the service.
This Regulation shall enter into force on the day of its publication.

4.01. Implementation of the defined basic customs surveillance operations, such as checks on quantities and types of goods, external controls on means of transport, lodging of seals or accompanying means of transport.
4.02. Patrol activities in carrying out direct surveillance of movements of persons, goods and means of transport within the customs border zone, surveillance of customs premises and designated premises, directing movement of persons and means of transport within the customs territory.
5th Grade
5.01. Implementation of customs controls, such as identification and verification of the characteristics of goods, inspection of means of transport, baggage, consignments and documents, documents of goods and travel documents, including verification of authenticity, customs inspection at points of transfer of goods across national borders outside customs clearance, register keeping, registration and statistics and processing of initial customs documents.
5.02. Implementation of the control of values the import and export of which is regulated by the Foreign Exchange Act, to a specified extent.
5.03. Negotiation of customs and foreign exchange offences in block proceedings to a specified extent.

6th grade
6.01. Deciding on the release of non-commercial goods, imported and exported by travellers, in particular in consignments.

7.03. Ensuring the agenda for arrears of customs duties and its accessories, taxes and charges, costs of proceedings, warehousing and fines, including their recovery, the preparation of supporting documents for the execution order.

7.05. Self-execution of activities in the field of anti-theft, such as obtaining, collecting and documenting information on the transport of narcotic drugs and psychotropic substances and poisons, violation of customs legislation.
