of 12 June 1973
on experimental verification under construction
The Federal Ministry of Technical and Investment Development, in agreement with the participating central authorities, provides, pursuant to Section 53 of Act No. 133 / 1970 Coll., on the competence of federal ministries:
INTRODUCTORY AND GENERAL PROVISIONS
Purpose, content and scope of the Order
(1) This Decree lays down the rules, procedure and formalities for experimental verification under construction and the scope and procedure of the institutions and organisations in applying it and implementing it in cases where the costs and additional costs associated with experimental verification are covered by State budgets. 1)
(2) The provisions of the Decree do not apply to verifications which form an essential part or a separate stage of the science and technology development task, 2) and are therefore carried out outside the field of investment construction.
Basic concepts and basic provisions
Experimental verification under construction
Experimental verification under construction (the "building experiment ') is a verification of the results of the development of science and technology and of the quality, function and efficiency of the building parts (3) or of their components on experimental constructions which cannot be carried out other than in the implementation or use of these structures.
Experimental construction
(1) Experimental construction is the building on which the building experiment is carried out.
(2) Experimental construction must comply with all the rules applicable to investment construction. Such provisions may be derogated only if necessary for the purpose pursued by the construction experiment and if, at the same time, the authorities, authorised to authorise exemptions from the relevant regulations, allow this, after consultation and determination of the extent of the necessary tests and measures necessary to ensure the safety of human life and health, the safety of work and technical equipment and the protection of things.
(3) Experimental constructions are not covered by the rules on construction deadlines 4) and the provisions of Section 11 of Decree No. 162 / 1970 Coll., on certain measures in residential construction do not apply to the construction experiment.
Subject of the construction experiment
(1) The subject of the construction experiment may be:
(a) construction structures, their elements and systems, technical installations, their elements and systems, and construction materials for which technical, economic and utility characteristics, performance and functions, reliability and durability, implementation methods, etc.;
(b) construction parts of buildings for which special-purpose functions are verified.
(2) The subject of a building experiment cannot be:
(a) construction structures, their elements and systems, technical installations, their elements and systems and construction materials which are normally produced or which are normally carried out or which can be sufficiently verified by the laboratory during construction;
(b) construction parts of buildings whose purpose functions may be sufficiently demonstrated by a project solution.
(3) A building experiment shall not be carried out on residential buildings whose investors are cooperatives or citizens.
Types of construction experiments
(1) The following types of building experiments are recognised for the purpose of the experimental verification plan, according to the documentation for the construction experiment, corresponding to the degree of knowledge of the different subjects of the experiment and the time stage of the preparation of mass production or construction in which the construction experiment is to be carried out:
(a) research, if any, on the verification of the results of science and technology before the introduction of mass production or construction;
(b) testing, when it comes to verifying the quality of construction parts when mass production is introduced,
(c) prototype, when it comes to specifying and supplementing data, in particular technical, economic and organisational data in the implementation of mass construction.
(2) The obligations set out in Section 8 (4) of this Decree are linked to the research experiment.
Purpose of construction experiments
The results of the building experiments are based mainly on:
- the development, specification or modification of relevant technical regulators, in particular technical standards, resulting typing tools, 5) technical standards (standards) of buildings, or other regulations in the area of production, implementation and maintenance of buildings,
- decision to introduce mass production and construction,
- determination of the development of a material production base for construction and progressive directions in construction development.
Carriers of construction experiments
(1) The construction experiment is managed by the central administration responsible for the sector and, where appropriate, with the agreement of the Regional National Committee (hereinafter referred to as the "owner of the construction experiment").
(2) The carriers of construction experiments are the authorities
(a) supplier, where the objects referred to in Article 4 (1) (a) are primarily to be verified;
(b) investment if the objects referred to in Article 4 (1) (b) are primarily to be verified.
(3) The wearer of the building experiment decides to carry it out if all other conditions prescribed for them are given.
Organisations responsible for the construction experiment
(1) The organisation responsible for the construction experiment (the "responsible organisation") is:
(a) the supply organisation or, where appropriate, its superior central article body (Directorate-General), if it is a building experiment under Paragraph 4 (1) (a);
(b) the investor organisation or, where appropriate, its superior body of the secondary article of the proceedings, if it is a building experiment pursuant to Article 4 (1) (b).
(2) The organisation responsible for the construction experiment is determined by the owner of the building experiment (Section 7).
(3) In addition to the activities mentioned in the various provisions of this decree, the responsible organisation shall ensure analysis, reimbursement and registration of invoices for costs and additional costs incurred by the construction experiment. The responsible organisation shall carry out other activities as determined by the owner of the building experiment in agreement with the relevant Ministry of Finance.
(4) In the case of a research building experiment referred to in Article 5 (1) (a), research and development organisations shall, in respect of the objects they deal with, carry out for the responsible organisation all the activities prescribed by this decree, if the responsible organisation so requests.
BASIC CONDITIONS FOR CONSTRUCTION EXPERIENTS
Planning of construction experiments
(1) Construction experiments are carried out according to the experimental verification plan under construction following the tasks of development of science and technology in line with the development of investment construction needs and within the framework of state and economic investment plans.
(2) The methodology for drawing up the experimental verification plan under construction is laid down by the Federal Ministry of Technical and Investment Development in agreement with the Ministry of Construction and Technology of the Czech Socialist Republic and the Ministry of Construction and Technology of the Slovak Socialist Republic in accordance with the Individual Guidelines for the Development of State and Economic Plans.
Experimental task
The concept and purpose of the experimental task
(1) The experimental task defines and justifies the requirements for the preparation and execution of a building experiment, determines the experimental construction, the duration of the experiment and the expected results of the building experiment.
(2) The experimental task is generally carried out at the same time as the project task.
Preparation of the experimental task
(1) An experimental study is usually the starting basis for the processing of the experimental task, which justifies the purpose of the building experiment.
(2) The development of the design of the experimental task is provided by the authority (organisation) which requires or proposes the execution of the construction experiment. Only a qualified authority (organisation) may be the processor of an experimental task.
(3) The design of the experimental task is a basis for verifying the necessity, technical reality and effectiveness of the building experiment.
(4) The design of the experimental task must be agreed with the investor (or user) on whose construction the construction experiment is to be carried out before approval. On the basis of the design of the experimental task, the possibility of securing supplies for the construction experiment must also be agreed with the suppliers.
Content of the experimental task
The experimental task always includes:
(a) the name and place of the experimental building (§ 3);
(b) the name and address of the responsible organisation (Section 8);
(c) the definition of the subjects of the building experiment (Section 4), the additional costs associated with the building experiment and the cost of its evaluation; each subject of the building experiment shall be indicated at all times
- follow-up to scientific and technological development tasks,
- justification for the need for a building experiment,
- determination of technical, economic and utility characteristics, performance and functions, reliability and durability, methods of implementation, etc., to be verified,
- the use of the results of the construction experiment (Section 6),
- the scope of the unit of measurement with the analysis of additional costs associated with the construction experiment and the analysis of the cost of its evaluation,
- the period for experimental use of the experimental building;
(d) an overview of the basic planning data for each phase of the construction experiment (Section 14);
(e) evidence of the results of the discussions referred to in Articles 3 (2) and 11 (4).
Approval of the experimental task
(1) The experimental task is approved by the owner of the building experiment (Section 7).
(2) The holder of a building experiment may delegate the approval of the experimental task to the authority of the central management section with the agreement of:
- the Federal Ministry for Technical and Investment Development, if the Federal Central Authority is the bearer,
- Ministry of Construction and Technology of the Czech Socialist Republic or Ministry of Construction and Technology of the Slovak Socialist Republic, if it is the carrier of the central body of the Czech Socialist Republic or Slovak Socialist Republic.
(3) The power of approval cannot be delegated to the responsible organisation (§ 8).
(4) The authority authorised to approve the project task (6) approves or rejects the project task of the experimental construction with the participation of the responsible organisation.
(5) The approved project task and the approved experimental task are the basis for drawing up the project documentation for the experimental construction. The approved experimental task is the main basis for the inclusion of the building experiment in the design of the experimental verification plan under construction.
CONTRIBUTION OF THE BUILDING EXPERIMENT
The construction experiment takes place in three stages:
(a) preparatory, which includes the development, assessment and approval of project documentation for experimental construction;
b) implementation which depends on the implementation of the building experiment in the framework of the implementation of the experimental building and, as a rule, also in the experimental use of the experimental building; and
(c) the final evaluation of the construction experiment.
Project documentation of experimental construction
The concept of project documentation for experimental construction
The project documentation of the experimental building is a project documentation drawn up according to the applicable regulations (7), the solution of which also includes a solution of the building experiment according to the provisions of this decree.
Processing of project documentation for experimental construction
(1) The documentation for the processing of project documentation for experimental constructions is provided and transmitted by organisations responsible for the applicable regulations (7). The documentation for the construction experiment (project materials and design for testing and measurement) is provided and transmitted to the general designer by the responsible organisation (§ 8).
(2) The project documentation of the experimental building will be processed into depth at the stage of the comprehensive project solution for the construction experiment
- expressing the continuity of the subject of the construction experiment on other parts of the construction,
- enabling a full technical specification of works and supplies for the implementation of the construction experiment,
- meet other requirements as determined by the experimental task.
Content of the comprehensive project solution of experimental construction
(1) The overall project solution for the construction experiment includes in particular:
- a clear description of the subjects of the building experiment (Section 4),
- detailed drawings of the subjects of the building experiment, their contacts, connections, etc.,
- detailed technical descriptions of the subjects of the construction experiment,
- technological procedures for carrying out the subjects of the building experiment,
- the scope of measurement, testing and recording of technical and economic data for the subjects of the building experiment,
- evidence of compliance with the formalities laid down in the second sentence of Section 3 (2) of this Order,
- documents from suppliers of supplies and works which are the subject of a building experiment, indicating their volume, time limits and prices.
(2) The budgetary documentation of the comprehensive project solution contains a statement of the budget headings affected by the cost-sharing experiment for each of these items:
- the budgetary costs of building experiment subjects, determined in accordance with the rules on the valuation of construction and assembly works,
- the budgetary costs of the structures and works which are replaced by the subject of the construction experiment, determined in accordance with the rules on the valuation of construction and assembly works,
- the difference in these costs in terms of additional costs associated with the implementation of the construction as experimental.
(3) The budgetary costs of the subjects of the construction experiment determined in accordance with the preceding paragraph will be discussed as the budget price under Section 39 of Decree No. 107 / 1966 Coll.
Assessment and approval of a comprehensive project solution for experimental construction
(1) The responsible organisation shall assess the project documentation at the stage of the overall project solution in terms of the construction experiment, draw up and transmit the assessment report
- to the investor who attaches it to the project documentation at the stage of the comprehensive project solution of the experimental building for its approval,
- the holder of the construction experiment (§ 7) together with the decision to approve the project documentation at the stage of the comprehensive project solution of the experimental construction.
(2) The protocol on the assessment of project documentation at the stage of the comprehensive project solution of the experimental building in terms of the construction experiment contains in particular:
(a) assessment
- how the requirements laid down in the experimental task have been complied with, in particular from the aspects referred to in Section 6,
- any deviations from the experimental task,
- solutions of individual subjects of the building experiment in terms of technical, economic, functional and aesthetic,
- the adequacy of additional costs for the implementation of the construction as experimental,
- the suitability of the application of building experiment subjects,
- the completeness and correctness of the technological procedures for carrying out the construction experiment and methods of testing, measurement and evaluation;
b) an overview of the extra costs of the building experiment in the implementation and experimental use of the experimental building and the cost of the evaluation of the building experiment as well as an overview of the dates of the individual phases of the building experiment and their main parts (§ 14).
(3) Project documentation of the experimental construction at the stage of the comprehensive project solution is assessed and approved by the authorities and organisations entitled to do so (8), based on the assessment of the building experiment. From the point of view of the construction experiment, the responsible organisation shall participate in this assessment and approval.
(4) The approved project documentation at the stage of the overall project solution of the experimental building is outside its own purpose and purpose for which the construction is carried out as an experimental one, as well as a basis for checking invoices for additional costs associated with the implementation of the construction as an experimental one.
Implementation of experimental construction
Presumption of implementation of the construction experiment
In addition to fulfilling the other conditions laid down for the start of the construction, the inclusion of the construction experiment in the approved implementation plan of the experimental verification under construction is the basis for the start of the experimental construction.
Tasks of the responsible organisation in the implementation of the construction experiment
(1) When implementing the experimental construction, the responsible organisation (§ 8) for individual subjects of the building experiment (§ 4) ensures:
(a) the monitoring, measurement, testing and evaluation of their technical and utility characteristics, their contacts, connections and effects caused by the connection with other components of the construction;
(b) monitoring, evaluation and registration
- the consumption of materials, work, energy and the use of mechanisms,
- own costs,
- technological processes in production, transport, assembly and installation;
(c) testing and implementing the measures referred to in Article 3 (2);
(d) any modifications to the project or implementation documentation for changes in implementation.
(2) The responsible organisation shall keep a separate log of the construction experiment, in which it records all relevant data and findings in the implementation of the construction experiment.
(3) The responsible organisation shall draw up a protocol on the implementation of the building experiment within two months of the completion of the construction experiment and transmit it to the owner of the building experiment (Section 7).
Protocol on the implementation of the construction experiment
(1) The Protocol on the implementation of the construction experiment contains in particular:
(a) analysis and evaluation
- compliance with the requirements established by the approved project documentation for the construction experiment,
- data, findings and experience gained in the course of implementation [Sections 20 (1) (a) to (c)],
- the reasons for modifications of project or implementation documentation [Paragraph 20 (1) (d)];
(b) evaluation of the organisational and technical level of work and supplies of individual suppliers for the construction experiment;
c) assessment of the impact of the implementation of the construction experiment on the continuity of the implementation of the experimental construction;
(d) a certificate from the point of view of the construction experiment on the eligibility of the experimental building for experimental use and the conditions for such use;
(e) an overview of the expected additional costs of the building experiment in the experimental use of the experimental building and the cost of evaluating the building experiment, an overview of the dates of the individual phases of the building experiment and its main parts (§ 14) and a deadline for drawing up the protocol on experimental use (§ 24 (3)).
(2) The report on the implementation of the construction experiment shall be withdrawn where the responsible organisation has confirmed from the point of view of the construction experiment the competence of the experimental building for permanent operation (use), the part referred to in the preceding paragraph under (d) and the parts referred to in (e) which relate to the experimental use of the construction.
(3) The certificate referred to in paragraph 1 (d) or the certificate referred to in paragraph 2 shall be transmitted by the responsible organisation to the investor.
Experimental use of experimental building
The concept of experimental use of the building
Experimental use of the experimental building is preceded by permanent operation (use). It shall verify the performance of the subject of the building experiment in a manner appropriate to the continuous operation (use). In the event that the responsible organisation confirms the competence of the experimental building from the point of view of the building experiment for permanent operation (use) prior to the start of the experimental use, the experimental use shall cease.
Proposal for the introduction of experimental construction into experimental use and its content
(1) An investor proposes to introduce an experimental construction into the experimental use of an authority or organisation which is entitled to issue a permit to put the building into permanent operation (use) under the Specific Regulations (9).
(2) The proposal for the introduction of an experimental building into experimental use shall include, in addition to the requirements laid down in the specific regulations referred to in the previous paragraph, a certificate from the responsible organisation of the experimental building's competence for experimental use in terms of the building experiment [Paragraph 21 (1) (d)].
Tasks of the responsible organisation in the experimental use of the construction
(1) The responsible organisation shall ensure in particular:
(a) the monitoring, measurement, testing and evaluation of the characteristics and behaviour of the subject of the construction experiment and its effects on other components of the construction;
(b) additions to project or implementation documentation for modifications or exchanges of building experiment subjects.
(2) The data and findings on experimental use are noted by the responsible organisation in the log of the construction experiment (§ 20 (2)).
