Decret of the President of the Republic
of 19 September 1945
on the interim regulation of the judiciary in the Czech and Moravian-Silesian countries.
On the proposal of the Government,
Territorial organisation of the judiciary.
§ 1.
(1) The territorial organisation of ordinary courts and public action offices in the Czech and Moravian-Silesian countries is resumed in the order and state in which it was in accordance with the regulations in force at the time.
(2) Pending further adaptation of the territorial organisation, a derogation from the provisions of paragraph 1 is provided for:
In Moravská Ostrava, the district court for Moravian Ostrava-West is left with the circuit of the former district court in Moravian Ostrava and the district court for Moravian Ostrava-East with the circuit of the former district court in Silesia Ostrava.
Circuits of the district courts in Great Bíteš, Bystřice nad Pernštejn, New Town in Moravia and the City of Žďář are left in the district of the county court in Brno.
The district court district of Náměště nad Záslavou is transferred to the district court district of Brno.

(4) The circumference of the District Court, the jurisdiction of which has been delegated to the District Court in accordance with the provisions of paragraph 3 from the District Court of another Regional Court, is to be added to that period to the District Court of that Regional Court.
(5) The amendments to be made under this Decree in the organisation of the collection courts apply mutatis mutandis to the organisation of the competent authorities of the public action.
(6) The organisation of courts, resulting from the provisions of paragraphs 1 to 4, is clear from the Annex to this Decree.
§ 2.
All ordinary courts shall be subject to the period from the date on which the decree becomes effective until 31 December 1947 for the period of their new organisation under Article 99 of the Constitutional Charter.
§ 3.
(1) If exceptional circumstances so require, the Minister of Justice may, for a transitional period, by order in the Collection of Laws and Regulations, take measures derogating from the provisions of Paragraph 1, with the exception of changes in the districts and offices of the courts. It may in particular:
1. transfer of the jurisdiction of certain regional or regional courts to other courts of the same kind, or renew the activities of courts whose jurisdiction has been transferred to another court,
2. postpone the day when some courts begin their activities.
(2) The measures taken pursuant to the preceding paragraph of the parties to the assembly courts shall apply mutatis mutandis to the public authorities.
§ 4.
Unification of regulations on organisation and management in civil matters legal.
In the border territories of the Czech and Moravian-Silesian countries, the provisions which apply to the dress and jurisdiction of the courts currently operating in the other territories of the designated countries as well as the rules on proceedings before those courts are extended.
The liquidation of the former German judiciary in civil matters legal.
§ 5.
(1) Civil matters of law, which have been brought before the former German courts as first-stool courts, are further led by the court which would have jurisdiction over the case if it had been brought into effect by that decree; in so doing, as regards local jurisdiction, account shall be taken of the grounds underlying the local jurisdiction of the German court.
(2) Paragraph 412 (2) of the Civil Code shall apply to the continuation of civil matters in dispute.
§ 6.
In order to hear an appeal pending the decision of the former German court, the court of appeal shall be the competent court of the judgment which would have been called upon to deal with it if, in the first chair, the court having jurisdiction under Article 5 had decided.
§ 7.
The decisions of the former German courts, which, on the date on which the decree takes effect, were not yet in legal force and against which no appeal had been brought by that date, may be relied upon only in accordance with the provisions laid down in Section 4.
§ 8.
(1) The files in civil matters relating to Sections 5 to 7 shall be handed over by the judicial authority which has kept them in custody to the court now competent.
(2) The provisions of the preceding paragraph apply mutatis mutandis to the surrender of file material relating to finished civil matters.
The liquidation of the former German judiciary in criminal matters.
§ 9.
(1) In criminal matters which have been initiated or debated in the former German courts or prosecutors in the territory of the Czech and Moravian-Silesian countries, all acts which are in force at the time of the entry into force of this decree are called upon by the court which would have jurisdiction under that law to negotiate a criminal offence which was the subject of criminal proceedings.
(2) However, if he was the subject of proceedings for an act which is not criminal under the law referred to in paragraph 1, the Court of Appeal of the First Chamber shall have jurisdiction.
§ 10.
The files in criminal matters, initiated or discussed with the former German courts or prosecutors, shall be sent without delay by the Office which shall keep them in custody, in the absence of files in criminal matters referred to in Article 13 of this Decree, to the State Registry of the Choir Court of I stools, competent pursuant to Article 9 or in the district of which the district court competent pursuant to that provision lies.
§ 11.
Criminal cases which have not yet been brought to an end shall be examined by the prosecutor under the law in force at the time of the entry into force of this Decree. If he does not find sufficient reason to bring criminal proceedings against a person, he shall postpone the files, otherwise he shall either file a motion for a preliminary search or an investigation or file a indictment file (proposal) or propose a penalty by the district court.
§ 12.
He shall examine the criminal cases with due regard to the provisions of Articles 9 to 11 of the Constitutional Decree of the President of the Republic of 3 August 1944 on the restoration of legal order. If it finds that the conditions for the procedure under these provisions are laid down, it shall send the files to the competent court (Article 9) with a proposal corresponding to that; in other cases, forward them to the court for another legal measure. He'll keep the files of the former German prosecutors with him.
§ 13.
(1) In criminal matters brought before a private action and not yet terminally completed, the action which is also the subject of a private action under the law in force at the time of the entry into force of this decree shall be sent by the Office of the files in its possession to the competent court (§ 9), which shall bring proceedings in accordance with the principles applicable to proceedings in the first storehouse.
(2) An application for criminal prosecution shall be deemed to have been lodged in due time if it was lodged before a former German court within a time limit laid down by the law in force at the time of the entry into force of this Decree.
§ 14.
(1) The German criminal records will be taken over by the Prosecutor's Office in whose district the former German office where the criminal record was kept has its registered office.
(2) This Public Prosecutor will circulate reports on the sentence imposed there by the prosecutors which are the Office of the Criminal Register pursuant to Section 14 of the Government Order of 14 July 1922, No. 198 Coll., on the registration of criminal offenders and data collection for the purposes of criminal statistics.
(3) The prosecutors responsible as the office of the criminal record shall draw up, on the basis of the criminal record reports received, the criminal records with which they will be dealt with under the law on the deposit of criminal certificates (Section 16 of the Government Regulation referred to in the preceding paragraph). The census criminal certificates shall not be drawn up and copies of the criminal certificates shall not be sent to the places referred to in Section 4 of that Government Regulation.
(4) However, the provisions of paragraph 3 shall not apply to the reports on the sentence imposed for an act which is not criminal under Czechoslovak law (Article 9 (2) of the Constitutional Decree of the President of the Republic of 3 August 1944 on the restoration of legal order) and to the reports on the sentence which is entered in the criminal record on the basis of reports received earlier.
Transitional and final provisions.
§ 15.
Where procedural acts have been carried out in the course of the judicial procedure before or before that decree, in the exercise of that decree, by the courts which, according to that decree, have yet to take effect, they shall be treated as if they had been carried out under that decree.
§ 16.
Paragraph 5, 6 and 8 shall apply mutatis mutandis to civil matters brought before courts other than the former German courts, where the change in the perimeter affects the grounds for establishing former local jurisdiction.
§ 17.
In order to simplify and facilitate the office agenda in the courts with delegated jurisdiction (§ 1 (3)), the Minister of Justice may take the necessary measures in the administrative path.
§ 18.
(1) Any provisions contrary to the provisions of this Decree cease to apply.
(2) The following shall be deleted:
1. Sections 13 to 17 and 19 of the Order of the Minister of Justice of 26 August 1944, No 183 Coll., on simplification in civil justice; in cases dismissed under paragraphs 13 to 17, the court shall, by its own authority, order the proceeding to continue or invite the party (s) to make any application;
2. § 2, § 1 and § 3 of the Order of the Minister of Justice of 2 September 1944, No 194 Coll., on the simplification of judicial organisation; the seat of the Chambers of the Supreme Court shall be governed by the provisions in force on 29 September 1938.
§ 19.
This decree takes effect on the seventh day following its publication and is valid in the Czech and Moravian-Silesian countries; to be carried out by the Minister for Justice.
