DECLARATION
of 25 March 2024
amending Decree No. 401 / 2010 Coll., on the content requirements of the Transmission System Operation Rules, the Distribution System Operation Rules, the Transmission System Operator Order, the Distribution System Operator Order, the Order of the Gas Storage Operator and the Market Operator Terms and Conditions, as amended by Decree No. 330 / 2017 Coll.
Pursuant to Section 98a (2) (b) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll., Act No. 211 / 2011 Coll. and Act No. 469 / 2023 Coll.:
Regulation No 401 / 2010 Coll., on the content requirements of the Transmission System Operation Rules, the Distribution System Operation Rules, the Order of the Transmission System Operator, the Order of the Distribution System Operator, the Order of the Gas Storage Operator and the Commercial Conditions of the Market Operator, as amended by Decree No 330 / 2017 Coll., is amended as follows:
1. in Paragraph 2 (1) (b), the following point 4 is added:
"4. the methods and conditions for the provision of balancing services by transmission system operators to power generators through the distribution system; ';
2. In Article 3, at the end of point (r), the dot is replaced by a comma and the following point (s) is added:
"(s) rules on access to the transmission system operator's information system.";
3. in Article 4 (1) (a), point 2 shall be deleted;
Point 3 is renumbered point 2.
4. In Article 4, at the end of paragraph 1, the dot is replaced by a comma and the following point (k) is added:
"(k) the manner and extent of the provision of information on the distribution system operated, including the technical specification and description of the grid input points.";
5. In Article 4 (2), "(a) to (d), (g), (h) and (j) 'is replaced by" (a) to (d), (g), (h), (j) and (k)';
6. In Article 5 (d), ", daily or new 'is replaced by" or daily';
7. in Article 5, point (e) is deleted;
Points (f) to (i) shall be renumbered as points (e) to (h).
8. in Article 5 (e), the word "format" is replaced by "method of administration."
9. in § 5 (h):
"(h) particulars relating to the establishment and management of a status account."
10. in Article 5, at the end of point (h), the dot is replaced by a comma and the following point (i) is added:
"(i) rules for reducing storage capacity with interruptible performance.";
11. in Article 6 (c), the words "or the licence holder" shall be inserted after the words "the electricity market."
12. in Article 6 (d), the following point 6 is added:
"6. registration of market participants and licensees to ensure access to the central system of the market operator; ';
13. in Paragraph 6 (f) of the introductory part of the provision, the words "acceptance and provision" are replaced by the words "acceptance, provision and making available."
14. in Article 6 (f) (2), the words "admission," or "shall be replaced by a comma and the words" data centre "shall be inserted after the words" data centre. "
15. in Article 6 (f) (3), the word "consumption" is replaced by the words "deliveries and purchases."
16. in Article 6 (f), the following points 13 to 16 are added:
"13. Procedure for providing and making available measured and evaluated electricity supply and consumption data, taking into account shared electricity;
14. procedure for providing and making available information on the allocation of the electricity supplier, the clearing entity and the distribution system operator to the transfer points assigned to the sharing group;
15. the procedure for providing and making available information on technical data registered by the market operator to the data centre transfer points;
16. the procedure for fulfilling the obligations of a market participant to ensure transparency and to avoid market abuse and manipulation in accordance with the directly applicable European Union regulation governing the integrity and transparency of the wholesale energy market (4); ';

17. in § 6 (h) and § 7 (h), the words "or demand" shall be deleted.
18. in Paragraph 6 (h), the following point 6 is added:
'6. Procedures for the accounting and invoicing of prices for the registration, provision and notification of trade data to a participant in the short-term market, ';
19. in Article 6 (i):
"(i) procedures for accounting for electricity support;"
20. in Article 7 (d), the following point 5 is added:
"5. the registration of market participants and licence holders to ensure access to the central system of the market operator;"
21. in Article 7 (e), the following point 6 is added:
'6. the procedure for determining the amount of financial collateral by clearing payments and liabilities in connection with the settlement of derogations in an emergency, ';
22. in Article 7 (f), the word "acceptance" shall be replaced by "acceptance" and the following point 9 shall be inserted after point 8:
'9. the procedure for fulfilling the obligations of market participants to ensure transparency and to avoid market abuse and manipulation in accordance with the directly applicable European Union regulation governing the integrity and transparency of the wholesale energy market (4), '.
23. in Article 7 (h), the following point 7 is added:
"7. procedures for the accounting and invoicing of prices for the registration, provision and notification of trade data to a participant in the short-term market, ';
24. in Article 7, at the end of point (i), the dot is replaced by a comma and the following points (j) and (k) are added:
"(j) procedures for accounting for biomethane aid;
(k) procedures to ensure participation in the provision and acceptance of international assistance in gas crisis situations, including the procedure for the submission and acceptance of tenders or requests and the financial settlement of gas supplies and withdrawals. ';
25. the following Section 7a is inserted after Section 7, including the title:
Content elements Order of data centre
The Order of the Data Center is the content
(a) details of:
1. identification of the data centre, including a list of important addresses and communication links with the data centre;
2. the internet address through which the data centre publishes information under another legislation in a way that allows remote access;
(b) details concerning the data centre information system, which are:
1. setting the conditions for access to the data centre information system;
2. way of accessing the data centre information system,
3. identification of means of communication and message formats for communication through the data centre information system;
4. the procedure of the data centre in case of malfunctioning of the data centre information system,
5. procedure to ensure market participants' access to the data centre information system;
6. the procedure for planned exclusions and outages of the data centre information system,
7. way of dealing with complaints ensuring access to the data centre information system,
(c) particulars relating to the provision and disclosure of data and information which are:
1. the procedure for providing and making available measured and evaluated electricity supply and demand data at transfer points assigned to the sharing group;
2. the procedure for providing and making available measured and evaluated electricity supply and consumption data, taking into account electricity sharing;
3. the procedure for providing information on the allocation of shared electricity to transfer points assigned to the sharing group and summary information on the allocation of shared electricity;
4. the procedure for providing information on the progress of electricity generation and the technical parameters of the electricity generation plant from which electricity is shared;
5. way of dealing with data claims provided and made available by the data centre,
(d) particulars relating to the receipt of data and information:
1. the procedure for receiving measured and evaluated electricity supply and consumption data at transfer points assigned to the sharing group;
2. the procedure for receiving information on the allocation of the electricity supplier, the clearing entity and the distribution system operator to the transfer points assigned to the sharing group;
3. the procedure for entering the replacement valid values and the method for indicating them in the event of failure of the measuring device or inaccessibility of measurements;
4. means of checking and correcting data received by the data centre;
5. way of dealing with data claims received and provided by the data centre,
(e) requirements relating to electricity sharing
1. the method of entering, registering and evaluating the requirements for the registration of the sharing group and assigning transfer points registration numbers to the sharing group, including the way in which electricity market participants are informed when registering and assigning;
2. the method of entering, registering and evaluating the requirements for the registration of allocation keys, including the way in which electricity market participants are informed when registering;
3. the means of monitoring and informing electricity market participants, taking into account shared electricity;
4. how to deal with complaints about the registration of the sharing group, assigning transfer points to the sharing group, registering allocation keys and taking into account the sharing of electricity;
(f) particulars relating to payment and invoicing conditions which are:
1. means of clearing and settlement of prices for the activities of the data centre and other payments;
2. dates for invoicing payments for data centre activities and other payments;
3. a way of dealing with a claim to bill payments for data centre activities and other payments. "
Efficacy
This Decree shall take effect on the day following that of its publication.
