DECLARATION
of 4 May 2018
amending Decree No 231 / 2016 Coll., on the collection, preparation and testing methods of food and tobacco control samples
The Ministry of Agriculture provides, pursuant to Article 18 (1) (m) of Act No. 110 / 1997 Coll., on Food and Tobacco Products, and amending and supplementing certain related acts, as amended by Act No. 139 / 2014 Coll. and Act No. 180 / 2016 Coll.:
Decree No 231 / 2016 Coll., on the collection, preparation and testing methods of reference samples of foodstuffs and tobacco products, is amended as follows:
1. In Article 2, at the end of point (j), the dot is replaced by a comma and the following point (k) is added:
"(k) sampling by swab from places or equipment used in the manufacture or marketing of foodstuffs."
2. in Paragraph 4 (1) (d), the word "or" shall be deleted;
3. In Article 4, at the end of paragraph 1, the dot is replaced by "or 'and the following point (f) is added:
"(f) smear."
4. in Article 6 (2) (b):
"(b) the identification of the person checked and the person from whom the sample was taken, if different from the person checked, if known;"
5. In Article 6 (2), at the end of the text in point (c), the words "if not indicated, other marking of the sample replacing the name which is provided for in the collection shall be added."
6. In Article 6 (2), at the end of the text of point (d), the words "if indicated 'are added.
7. In Article 6 (2) (f) (7), the words "and the signature of the person checked or, where applicable, his representative, 'are deleted.
8. In Article 6, the following paragraph 3 is added:
"(3) The inspection authority shall correct the incorrectness of the sampling record in the form of a supplement to the sampling record. In addition to the sampling record, the purpose of the sampling indicated in the record may also be changed if this is necessary for the protection of the consumer and if the change does not result in the subject-matter being exceeded. '
Efficacy
This decree shall take effect on the 15th day following its publication.
