GOVERNMENT REGULATION

amending Government Regulation No 79 / 2007 Coll., on the conditions for implementing agri-environment measures, as amended
The Government mandates pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll. and Act No. 291 / 2009 Coll., to implement § 2c (2) (b) of this Act, and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll.:
Amendment of Government Decree No. 79 / 2007 Coll., as amended
Government Regulation No. 79 / 2007 Coll., on the conditions for the implementation of agri-environmental measures, as amended by Government Regulation No. 114 / 2008 Coll., Government Regulation No. 45 / 2009 Coll., Government Regulation No. 83 / 2009 Coll. and Government Regulation No. 480 / 2009 Coll., are amended as follows:
1. in Article 4 (2), point (g) is deleted;
Point (h) shall be renumbered as point (g).
2. in Article 4 (2) (g), the words "and culture" shall be inserted after the words "areas used."
3. In Article 4 (7), the words "and (g) shall not apply 'shall be replaced by the words" not'.
4. In Article 5 (5) (d), the words "or § 3p 'shall be inserted after the words" 3h'.
5. Paragraph 7 (9) reads as follows:
"(9) In the application for a subsidy for the calendar year concerned, the applicant shall indicate, for each soil block or part thereof with the agricultural culture of orchards, whether it applies for a subsidy for the culture of orchards referred to in Article 13 (1) (f) or Article 13 (1) (g). ';
6. In Paragraph 9 (10), the comma at the end of point (g) is replaced by a dot and point (h) is deleted.
7. In Paragraph 9 (12), the comma at the end of point (e) is replaced by a dot and point (f) is deleted.
8. In Article 9 (14), point (e) is replaced by the dot and point (f) is deleted.
9. In Paragraph 9 (17), the comma at the end of point (h) is replaced by a dot and point (i) is deleted.
10. in Article 13 (1) (c), the words "fruit orchards" shall be deleted;
11. In Article 13, at the end of paragraph 1, the dot is replaced by a comma and the following points (f) and (g) are added:
"(f) EUR 849 / ha, if the cultivation of fruit orchards in the organic farming system referred to in Article 7 is carried out under the intensive fruit scheme and consists of at least 200 pieces of fruit trees listed in Annex 17 to this Regulation per hectare or at least 800 pieces of fruit shrubs listed in Annex 17 to this Regulation per hectare during the period from the date of application for the grant until 31 December of the calendar year,
(g) EUR 510 / ha for growing fruit orchards in the organic farming system referred to in Article 7 which are not referred to in point (f). ';
12. in Article 14 (2), point (b) is deleted;
Points (c) to (j) shall be renumbered (b) to (i).
13. in Article 15, point (c) is deleted;
Points (d) to (s) shall be renumbered (c) to (r).
14. in Article 15 (c), point 4 is deleted;
15. the following Annex 17 is added:
"Annex No. 17 to Government Decree No. 79 / 2007 Coll.

Transitional provision
The procedure for applications submitted pursuant to Government Regulation No 79 / 2007 Coll., as effective until the date of entry into force of this Regulation by a Government which has not been definitively terminated before the date of entry into force of this Government Regulation, shall be completed in accordance with the existing legislation.
Amendment of Decree No. 45 / 2009 Coll.
In Article II of Government Regulation No 45 / 2009 Coll., amending Government Regulation No 79 / 2007 Coll., on the conditions for the implementation of agri-environmental measures, as amended by Government Regulation No 114 / 2008 Coll., point 2 is deleted and the designation of point 1 is deleted.
EFFECTIVE
This Regulation shall enter into force on 1 April 2010.
