DECLARATION
of 10 February 2005
amending Decree No 77 / 2003 Coll., laying down requirements for milk and milk products, frozen creams and edible fats and oils, as amended by Decree No 124 / 2004 Coll.
The Ministry of Agriculture provides pursuant to Article 18 (1) (a) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related laws, as amended by Act No. 306 / 2000 Coll. and Act No. 316 / 2004 Coll.:
Decree No. 77 / 2003 Coll., laying down requirements for milk and milk products, frozen creams and edible fats and oils, as amended by Decree No. 124 / 2004 Coll., is amended as follows:
1. In Paragraph 3 (1), "43 'is replaced by" 44'.
2. In Article 3, the following paragraph 44 is added:
"(44) The term" Czech cream butter "refers only to butter intended for trade within the framework of the common organisation of the market in milk and milk products8c) and meets the requirements laid down in the European Community Regulation 8d).
8c) Commission Regulation (EC) No 2771 / 1999 of 16 December 1999 laying down detailed rules for the application of Council Regulation (EC) No 1255 / 1999 as regards intervention on the market in butter and cream, as amended. COMMISSION REGULATION (EEC) No 2191 / 81 of 31 July 1981 on the granting of aid for the purchase of butter by non-profit making institutions and organisations, as amended.
8d) Council Regulation (EC) No 1255 / 1999 of 17 May 1999 on the common organisation of the market in milk and milk products, as amended. '
Transitional provision
The designation "Czech table butter 'for butter intended for trade within the framework of the common organisation of the market in milk and milk products may be used for a maximum period of 12 months after the entry into force of this decree.
Efficacy
This decree takes effect on the date on which the regulation of the European Communities takes effect, by which the name "Czech cream butter 'will be included in the directly applicable regulation of the European Community1).
