THE LAW
of 5 February 2002
amending Act No. 200 / 1990 Coll., as amended, Act No. 90 / 1995 Coll., the Rules of Procedure of the Chamber of Deputies, as amended, and Act No. 107 / 1999 Coll., the Rules of Procedure of the Senate
Parliament has decided on this law of the Czech Republic:
Amendment to the Rules of Procedure of the Chamber of Deputies
Act No. 90 / 1995 Coll., on Rules of Procedure of the Chamber of Deputies, as amended by Act No. 47 / 2000 Coll. and Act No. 39 / 2001 Coll., is amended as follows:
1. in Article 13 (3) and (4), including footnote 4 (a):
"(3) Disciplinary proceedings shall also be brought against a Member who commits an offence and requests the authority responsible for dealing with the offence to discuss the infringement in disciplinary proceedings.
(4) The Mandate and Immunity Committee shall initiate disciplinary proceedings on the disciplinary offence referred to in paragraph 1 on a proposal from the President of the House or on its own initiative, on the disciplinary offence referred to in paragraph 2 on the basis of a proposal from the injured party and on the offence referred to in paragraph 3 on the basis of a referral by the competent authority under specific legislation. (4a)
4a) § 71 (d) of Act No. 200 / 1990 Coll., on Infringements, as amended. '
2. Paragraph 15 (2) reads as follows:
"(2) Members may be penalised for the offence referred to in Article 13 (3) by a penalty provided for in a specific legislature.6)."
Amendment to the Senate Rules of Procedure
Act No. 107 / 1999 Coll., on the Rules of Procedure of the Senate, is amended as follows:
(1) Paragraph 14 (3) and (4), including footnote 12a, read:
"(3) Disciplinary proceedings shall also be brought against a senator who commits an offence and requests the authority responsible for dealing with the infringement to discuss the infringement in disciplinary proceedings. 12)
(4) The Mandate and Immunity Committee shall initiate disciplinary proceedings on the disciplinary offence referred to in paragraph 1 on a proposal from the President of the Senate or on its own initiative, on the disciplinary offence referred to in paragraph 2 on a proposal from the injured party and on the offence referred to in paragraph 3 on the basis of a referral by the competent authority under specific legislation. 12a)
12a) § 71 (d) of Act No. 200 / 1990 Coll., on Infringements, as amended. '
2. Paragraph 16 (2) reads as follows:
"(2) A penalty may be imposed on the Senator for an offence pursuant to Paragraph 14 (3), which is laid down in a separate law. 14)."
TRANSITIONAL PROVISIONS
Negotiations which have the characteristics of an offence committed by Members or Senators before the date of entry into force of this Act shall be dealt with in accordance with existing legislation.
EFFECTIVE
This Act shall take effect on 1 April 2002.
