Decree of the Government of the Slovak Socialist Republic establishing the Rules of Procedure of the Slovak Commission for Scientific Aspects

establishing the rules of organisation and procedure of the Slovak Commission for Scientific Aspects
The Government of the Slovak Socialist Republic orders pursuant to Article 144 (2) of the Constitutional Act No. 143 / 1968 Coll., on the Czechoslovak Federation, and § 13 (3) of Act No. 53 / 1964 Coll., on the award of scientific degrees and on the State Commission for Scientific Aspects:
§ 1
Position of the Slovak Commission for Scientific Aspects
The Slovak Commission for Scientific Aspects ("the Commission ') is the central body of the state administration of the Slovak Socialist Republic, *) called on to address questions concerning the award of scientific degrees.
§ 2
Tasks of the Commission
The Commission shall carry out the following main tasks:
(a) coordinate and manage the activities of the bodies involved in the award of scientific evaluations, taking particular care to ensure the complexity and consistency of the assessment of the award of scientific evaluations;
(b) on the basis of the monitoring of the activities of these bodies and the evaluation of the experience gained, ensure improvement of the way in which scientific degrees are awarded;
(c) ensure that the relevant legislation is maintained by continuous monitoring and supervision and, where justified and on its own initiative, announces the decision of the body which is in conflict with it;
(d) in an agreement with the Ministry of Education of the Slovak Socialist Republic, the Slovak Academy of Sciences, the Ministry of Construction and Technology of the Slovak Socialist Republic and the participating central bodies, issue detailed regulations for the implementation of Act No. 53 / 1964 Coll., on the award of scientific degrees and on the State Commission for Scientific Positions;
e) working closely with the Ministry of Education of the Slovak Socialist Republic, the Slovak Academy of Sciences and the Ministry of Construction and Technology of the Slovak Socialist Republic;
(f) in order to maintain the fundamental compliance of the conditions and procedures for the award of scientific degrees, in particular in the development of detailed rules and the establishment of the principles of its management activities, it shall cooperate closely with the Czech Scientific Commission.
§ 3
The Commission's work plan
The Commission shall develop its activities on the basis of an annual activity plan, which its President shall notify to the Government.
The competence of the Commission and the manner in which it is carried out
§ 4
The competence of the Commission, its decision-making powers and its relationship with the authorities involved in the award of scientific degrees is defined by Law No 53 / 1964 Coll. and by the regulations issued by it.
§ 5
(1) The presidium or plenary shall, as a general rule, be decided on the basis of a report submitted by a member of the commission, by means of preparation, justification and presentation of the proposal in the presidium or in the plenary of the commission, by the chairman or scientific secretary.
(2) Before the decision, the Commission shall seek the opinion of the body which has decided, in the event of objections to the award of the rank and dissertant. It may also request an opinion from the Ministry of Education or the Bureau of the Slovak Academy of Sciences.
(3) The Board shall, as a general rule, decide on the appeal or objections within four months of their receipt; where it is not possible for the complexity of the case or for other serious reasons to maintain that period, it shall inform the participants thereof, stating the reasons for the delay and notifying the period within which it decides.
§ 6
Costs of the commission
(1) The reimbursement of costs related to the activities of the Commission, its members and its secretariat is provided in the budget of the Ministry of Education of the Slovak Socialist Republic; The budget of the Commission shall constitute a specific component of the budget of this Ministry. The Ministry of Education of the Slovak Socialist Republic allocates to the Commission the necessary number of staff, working space and means of material.
(2) Members of the Commission are entitled to reimbursement of travel costs under the applicable rules.
(3) Members of the Commission or external experts are entitled to remuneration for their professional activities.
Functionaries
§ 7
The President, Vice-Presidents, Scientific Secretaries and Members of the Commission shall be appointed and removed by the Government of the Slovak Socialist Republic from the scientists of the Slovak Academy of Sciences, teachers of universities and scientists of other scientific research institutes. Proposals for appointment are submitted to the Government by the Minister of Education of the Slovak Socialist Republic in agreement with the President of the Slovak Academy of Sciences and the Minister of Construction and Technology of the Slovak Socialist Republic.
§ 8
(1) The President shall represent the commission externally and shall be responsible for its activities. It shall deal with the ministers and heads of other central government bodies on matters falling within the competence of the Commission. It shall manage the work of the Commission, convene plenary and presidium meetings and conduct their deliberations.
(2) The Vice-Presidents shall participate in the management of the work of the Commission as directed by the President.
(3) The Scientific Secretary prepares material for plenary and pressidium meetings, ensures that the Commission's tasks are carried out and proposes the necessary measures. It shall manage the work of the Secretariat and shall be responsible for its activities to the President.
§ 9
Plenum
(1) The Committee shall be composed of the President, Vice-Presidents, Scientific Secretary and other members of the Commission.
(2) The Board shall act and decide on essential and general matters falling within the competence of the Commission and on the rules issued by the Commission.
(3) Plenum acts and decides on those matters which fall otherwise within the scope of the presidium which it has reserved itself or which are reserved for plenary by the President or the presidium.
(4) In particular:
(a) identify groups of sciences, sciences and disciplines in which defence may be held and award the scientific rank of candidate of science and doctor of science;
(b) determine the principles governing the setting-up of defence commissions and determine the authorities authorised to set up such commissions for each group of sciences, science and disciplines;
(c) determine the bodies of the Slovak Academy of Sciences and universities entitled to decide on the award of scientific degrees to the candidate of science and doctor of science in each group of sciences, sciences or disciplines;
(d) evaluate the inspection activities of its members.
(5) The crop shall meet at least four times a year.
§ 10
Presidium
(1) The Presidium of the Commission shall be composed of the President, Vice-Presidents, Scientific Secretary and other members of the Commission, who shall be appointed by the Chair of the representatives of the most important groups of sciences.
(2) In particular, the presidium exercises the following scope:
(a) prepare materials for the plenary proceedings;
(b) coordinate and ensure contact with the authorities of the Slovak Academy of Sciences, the authorities of the Ministry of Education of the Slovak Socialist Republic, the Ministry of Construction and Technology of the Slovak Socialist Republic and other central bodies;
(c) manage the inspection activities of the members of the Commission and check compliance with the rules issued by the commissions;
(d) prepare the Commission's work plan and continuously monitor and evaluate its implementation;
(e) allow exemptions from the conditions for the award of scientific degrees in individual cases;
(f) grants the right to set up a panel to defend the dissertation of candidate or doctoral work, or, where appropriate, to decide on the award of the status of an institution to which that right is not otherwise due;
(g) giving consent to the award of the honorary scientific rank of Doctor of Sciences;
(h) approve the notation of scientific degrees acquired abroad;
(i) decide on appeals against decisions granting or withdrawing scientific degrees;
(j) decide on complaints against the procedure of the institutions before which candidate trials or advocacy are held or which grant scientific degrees;
(k) in justified cases on its own initiative, review decisions on the award of scientific degrees;
(l) report regularly to the full committee.
(3) Presidium acts and decides on the matters which it has been ordered to do.
(4) In the period in which the plenary does not sit, the presidium may also act and decide on matters falling within the competence of the plenary, if the President so commands. The presidium shall report to the nearest plenary on the decision taken in such a case. However, the Presidium cannot issue generally binding legislation, the issue of which falls within the competence of the Commission.
(5) The presidium usually sits once a month.
§ 11
Negotiations and decisions in plenary and presidium
(1) Plenum and presidium are capable of acting and deciding if at least two thirds of their members are present. An absolute majority of the members present shall be required to adopt the resolution. In the event of a tie, the chairman shall vote. Voting is not done in secret.
(2) The plenary and presidium meetings are not public. However, representatives of central bodies, social organisations, the Slovak Academy of Sciences, universities and other experts may be invited; the admitted person is not entitled to vote.
§ 12
Working groups
As advisory bodies of the Commission, the Plenum, the Presidium or the relevant members of the Presidium may, as appropriate, set up permanent or temporary working groups. Only a member of the Commission may be the head of the group; experts who are not members of the Commission may also be members of the group. The group leader shall manage its work and report thereon to the plenary or pressidium. If there is no unanimous opinion within the Working Group, the Head of Plenum or Presidium shall also inform the group of divergences.
§ 13
Members of the Commission
(1) The members of the Commission shall attend plenary meetings and the relevant members as well as the pre-sidium meetings or working groups of the Commission. They shall also carry out the tasks assigned to them by the Commission's bodies or officials.
(2) The members of the Commission are obliged to undertake to monitor the level of the candidate examinations, the course, the level and the method of awarding scientific degrees and to ensure that the scientific level of the candidates for scientific degrees is assessed in a comprehensive and consistent manner. Each member of the Commission shall be entitled to request all necessary information from the authorities deciding on the award of degrees, from the defence committees and from the test committees and shall be entitled to attend its meetings and examinations. Knowledge acquired in this way shall be used by members of the Commission in the deliberations of its bodies in order to improve the level and manner of award of scientific degrees.
(3) Members of the Commission are required to remain silent on matters which they have learned in the performance of their duties, to the same extent as workers of public authorities.
§ 14
Secretariat
(1) The Secretariat shall ensure the activities of the Commission, its bodies, officials and members on an organisational and administrative basis.
(2) The Secretariat shall register the scientific grades awarded and notarized, the composition of the defence committees, the statement of defence, and shall issue forms binding on such records for the places covered by the register. If the records show that an infringement has occurred, they shall immediately submit the case to the presidium.
§ 15
Publication of notices and decisions
The notices and decisions of the Commission to be published shall be published in the Reports of the Ministry of Education and the Ministry of Culture of the Slovak Socialist Republic.
Final provisions
§ 16
Decree No. 172 / 1964 Coll., published by the Rules of Procedure of the State Commission for Scientific Positions, is hereby repealed for the territory of the Slovak Socialist Republic.
§ 17
These Rules of Procedure shall take effect on the date of its publication.
