of 9 October 1951
on the criminal jurisdiction of local national committees.
The Government of the Czechoslovak Republic orders pursuant to § 7 (2) of Act No. 89 / 1950 Coll., on Administrative Criminal Procedure (Administrative Criminal Code):
Local national committees prosecute in the first storehouse offences listed in the following provisions of the Administrative Act No. 88 / 1950 Coll.:
§ 55 (field and forest pride),
§ 57 (hunting protection),
§ 58 (protection of fishing),
§ 59 (protection of birds and animals useful for agriculture),
§ 60 (protection of animals against abuse),
Article 93 (failure to comply with the notification obligation),
§ 96 (damage to public decrees),
Section 122 (protection of teaching),
Article 129 (protection of public entertainment); and
§ 136 (exceeding the closing hour).
(1) The criminal jurisdiction of local national committees shall be exercised by a three-member criminal commission.
(2) The provisions of the Code of Criminal Procedure shall apply to the exercise of criminal jurisdiction of local national committees. However, local national committees may not take action under § § 12 to 20 of the Code of Criminal Procedure (on detention of a person, detention, other restrictions and home and personal search).
(1) In the exercise of criminal jurisdiction, local national committees may not impose penalties pursuant to Articles 12 (3) and 21 and 23 of the Administrative Criminal Code (declaration of higher sentence, forfeiture of assets and prohibition of residence).
(2) Where the legal conditions for the imposition of penalties are in accordance with the provisions referred to in paragraph 1, criminal proceedings shall be carried out in the first storehouse by the district national committee.
(1) The existing criminal jurisdiction of local national committees is no longer applicable (§ 91 of the Code of Criminal Procedure).
(2) The transfers which have been initiated before the application of this Regulation shall be discussed by the national committees responsible under the existing rules.
This Regulation shall enter into force on 1 January 1952; they shall be carried out by the Home Secretary in agreement with the participating members of the Government.
