on the central regulation of products and materials under construction
The Federal Ministry of Technical and Investment Development pursuant to § 53 (a) and (b) of Act No. 133 / 1970 Coll., on the jurisdiction of federal ministries, and the State Arbitration of the Czechoslovak Socialist Republic pursuant to § 395 (a) of Economic Code No. 109 / 1964 Coll. in the version published under No. 37 / 1971 Coll. provides:
Preliminary provisions
Scope
The central regulation of products and materials under construction (hereinafter referred to as "central regulation ') under this Decree shall be subject to the materials, products, parts and machinery and equipment listed in the lists issued pursuant to § 3 (hereinafter referred to as" selected products') if they are necessary for construction buildings and operating files designated pursuant to § 3.
Nature and purpose of central regulation
(1) In particular, the central regulation monitors the improvement of the conditions for securing the plan for the construction process and scope of construction and the avoidance of adverse effects in the development of the costs and prices of materials and products for the construction of selected building buildings and operating packages by ensuring consistency between technical progress, the planned growth of the standard of construction and the economic possibilities of the State.
(2) Central regulation
- the basic materials and products for use in the preparation and implementation of specified building buildings and operating sets shall be determined in accordance with the intended replacement of the assortment,
- production, extraction, processing, etc. (hereinafter referred to as "production") and supplies of such materials and products in the necessary quantities and quality,
- for suppliers, stability of production programmes and cost levels is ensured over a longer period while facilitating the planned application of the results of technical development in production.
Content of central regulation
Designation of building buildings, identification of selected products and issuing of their lists
(1) The Federal Ministry of Technical and Investment Development gradually identifies and publishes national lists of selected products subject to central regulation.
(2) Proposals for the determination of building buildings and operating sets for central regulation are submitted - with the exception referred to in paragraph 3 - to the Federal Ministry of Technical and Investment Development, to the Ministry of Construction and Technology of the Czech Socialist Republic or to the Ministry of Construction and Technology of the Slovak Socialist Republic (hereinafter referred to as the "Ministry of Construction and Technology of the Republics") by the central investor authorities at the same time as the draft lists of selected products discussed and agreed with the central authorities of manufacturers and suppliers.
(3) Proposals for the identification of building buildings and operating sets of complex residential buildings and construction buildings, where there are several central investors, are submitted for central regulation to the Federal Ministry for the Technical and Investment Development of the Ministry of Construction and Technology of the Republics.
(4) Proposals for the lists of selected products for residential building buildings and for construction buildings with several central investors shall be drawn up, discussed and agreed with the central authorities of the producers and suppliers of the Ministry of Construction and Technology of the Republic. Proposals for lists of selected products for building buildings and operational sets of civil and technical equipment shall be drawn up, discussed, agreed and submitted to the ministries of construction and technology of the Republics by the sectoral central authorities.
(5) Proposals for lists of selected products which have been discussed and agreed by jurisdiction with the central investor authorities or with the sectoral central authorities or with the ministries of construction and technology of the Republic may also be submitted by the central authorities of producers or suppliers in accordance with the procedure laid down in the preceding paragraphs.
(6) Proposals for lists of selected products agreed under paragraphs 2 to 5 shall be submitted by the Ministry of Construction and Technology of the Republics to the Federal Ministry of Technical and Investment Development.
(7) Proposals for the lists of selected products must be arranged according to the uniform classification of industries and products, 1):
(a) by type of product of the same functional purpose;
(b) by product, always by product name, by item number, by code according to uniform classification, unit of measurement and by wholesale price.
(8) Proposals for lists of selected products should be documented
(a) decisions or opinions of a public service where such products are subject to evaluation or approval or certification of suitability under specific regulations; 2) 3)
(b) price scales;
(c) for products manufactured according to approved type material by reference to these type materials, (4) for standardised products by reference to the applicable technical standards; 5)
(d) by expressing to the competent central authorities of manufacturers and suppliers that the supply of selected products can be ensured.
Changes to the lists of selected products
(1) The lists of selected products are aligned with the results of technical development (innovation) where the use of these results (innovative products) is not contrary to the purposes of central regulation (Section 2).
(2) The amendments (additions) to the lists of selected products issued shall be treated in a similar manner to their publication (Section 3).
Application of central regulation
Use of other products
Other products may only be used:
(a) where this is in accordance with the rules on above-standard fitting of flats; 6)
(b) for residential buildings carried out in self-supporting construction;
(c) under the construction of family houses;
(d) with the approval of the Federal Ministry of Technical and Investment Development at the request of the Federal Central Authority of the Investor or with the approval of the Ministries of Construction and Technology of the Republics at the request of the Central Investors of the Republics;
(e) with the consent of the investor, provided that the following conditions are met simultaneously:
1. the utility characteristics and technical parameters of other products are at least the same as those of the selected products they replace;
2. the utility characteristics and technical parameters of other products have been verified (approved testing laboratory, experimentally or otherwise), the products comply with the technical standards, delivery and installation conditions and the price has been determined for them;
3. the sum of the costs of the acquisition, transport, installation and completion of other products, including all other costs and surcharges, shall not exceed the sum of the costs of the use of the selected products.
Securing the production and supply of selected products
(1) The central authorities of manufacturers and suppliers ensure the production and supply of selected products by organisations they manage (Section 3 (2), (4), (8)) in accordance with their planned tasks.
(2) For these products, manufacturers and suppliers are required to close the supply necessary for the security of the buildings at the timely request of customers and in accordance with the results of the supply-customer relations negotiations in the planning process. The necessary scope is demonstrated by the customer, approved by project documentation and concluded by an investment construction contract.
Common and final provisions
Specific obligations of manufacturers and suppliers
(1) Manufacturers are obliged to provide the Czechoslovak Construction and Architecture Centre with all documents for catalogue sheets for publication in the Czechoslovak Construction Catalogue. 8)
(2) Suppliers may not refuse to agree to its technical solution when discussing documentation of buildings (parts of buildings), 9) in which selected products contained in the lists are used because it contains selected products.
Repeal
Directive No 5 of the Federal Ministry of Technical and Investment Development and the Federal Price Office of 26 May 1972 on the central regulation of products for residential construction are hereby repealed; (10) the list of selected residential products subject to central regulation issued under these Directives shall remain in force until the new list is published.
Efficacy
The decree shall take effect on 1 January 1978.
